I. CALL TO ORDER
Chairman Crites called the meeting to order at 2:03 p.m.
II. PLEDGE OF ALLEGIANCE
Commissioner Downs led in the pledge of allegiance.

IV. APPROVAL OF MINUTES:
Consideration for approval the minutes of July 1 , 1986.
Action:
Moved by Commissioner Wood, seconded by Commissioner Downs, approving
the minutes as submitted. Carried 3-0.
V. SUMMARY OF COUNCIL ACTION
Mr. Diaz outlined July 24, 1986, city council actions as they
pertained to the planning commission.
VI . CONSENT CALENDAR

Action:
Moved by Commissioner Downs, seconded by Commissioner Wood, approving
the consent calendar by minute motion. Carried 3-0.
VII. PUBLIC HEARINGS
A. Continued Case No. PP 86-32 DESERT CITIES BAPTIST CHURCH,
Applicant
Request for approval of a negative declaration
of environmental impact and a precise plan of
design to allow construction and operation of a
church facility (and use of temporary modular
structure for church services) on five gross
acres in the PR-5 zone (planned residential ,
maximum five dwelling units per acre) , located
on the east side of Portola Avenue, approximately
660 feet north of Country Club Drive.
Mr. Diaz outlined the salient points of the staff report and
indicated that public works wished to delete condition #11 regarding
the landscaped median.
Chairman Crites noted that the letter from the applicant had not
been attached to the staff report. Chairman Crites asked about the
comment made by the sheriff's department regarding acceleration and
deceleration lanes. Mr. Diaz explained that the public works
department had not found the acceleration/deceleration lanes
necessary. Mr. Gaugush indicated that Portola Avenue has been
widened to its fullest extent, but noted that acceleration and
deceleration lanes could be incorporated into the specific design of
the project.
Chairman Crites strongly urged that this be incorporated as a
condition. He also addressed the issue of deleting condition #11 .
He felt that the condition should be reinstated until after the
consultant studying the north area had completed a recommendation.
Mr. Gaugush indicated that if a bond was posted and it was later
determined that there would not be a median installed, a refund
would be made. Chairman Crites indicated that it would be included
in the condition.

Chairman Crites opened the public testimony and asked the applicant
to address the commission.
MR. AL BRUN, pastor, explained that this project had been
previously approved as PP 85-3, but indicated that it was just
a change in parcel location and nothing had been changed. Mr.
Brun asked for clarification regarding condition #14 pertaining
to the modular structure. Chairman Crites explained that
payment needed to be posted for the modular prior to
installation. Mr. Brun inquired as to the length of time the
church funds would be involved in this bond. Commission
determined that two years would be sufficient. Mr. Brun noted
that the project would generate little or no traffic during the
week.
Commissioner Wood asked about the time frame. Mr. Brun informed
commission October/November for the modular, and within two to three
months start construction of phase I . He stated the church had the
finances to begin construction almost immediately.
Mr. Diaz informed commission that staff had been instructed to look
into a moratorium in the area on everything in the city, which could
effect planning commission actions.
Chairman Crites asked if anyone present wished to speak in FAVOR or
OPPOSITION to the proposed. There being no one, the public testimony
was closed.
Commissioner Wood stated that because of the importance of the
location of the project along this major thoroughfare, he would like
to make sure the project met all of the city standards. Mr. Diaz
replied that it had been to architectural commission and would meet
all standards.

Moved by Commissioner Wood, seconded by Commissioner Downs, adopting
the findings as presented by staff. Carried 3-0.
Moved by Commissioner Wood, seconded by Commissioner Downs, adopting
Planning Commission Resolution No. 1162, approving PP 86-32, subject
to conditions as amended. Carried 3-0.
B. Case No. PP 86-23 - TONY LIZZA, Applicant
Request for approval of a 6, 000 square foot
single story retail furniture store in a C-1

zone located at the northeast corner of San
Carlos and Palm Desert Drive (Frontage Road) .
Mr. Joy outlined the salient points of the staff report and
recommended approval of the project subject to conditions. He noted
that the project had received architectural commission approval and
also that the applicant would be required to join an assessment
district for undergrounding utilities.
Commissioner Downs asked if the building would conform to the
general design in that area. Mr. Joy showed commission the exterior
elevation plans.
Chairman Crites opened the public testimony and asked if the
applicant wished to addressed the commission. The applicant replied
that he did not wish to address the commission. Chairman Crites
asked if anyone present wished to speak in FAVOR or OPPOSITION to
the proposed. There being no one, the public testimony was closed.
Commissioner Downs questioned the use of a blue roof in that area.
Mr. Joy explained that most buildings had flat roofs in that area.
Commissioner Downs stated that he hesitated to approve a blue roof
because of problems in the past. Mr. Diaz explained that the
Learning Tree roof problem had occurred because of a change in
material , and noted that architectural commission had considered the
blue roof.
Commissioner Wood noted that a representative from the architectural
commission was present and asked him to address the commission.
Mr. Rick Holden stated that the feeling of the architectural
commission was that the Learning Tree was a bad example also because
of the height of the building. He stated that the architectural
commission did not object to the blue roof at all .
Action:
Moved by Commissioner Downs, seconded by Commissioner Wood, adopting
the findings as presented by staff. Carried 3-0.
Moved by Commissioner Downs, seconded by Commissioner Wood, adopting
Planning Commission Resolution No. 1163, approving PP 86-23, subject
to conditions. Carried 3-0.
C. Case No. PP 86-26 - MR. & MRS. J. WAMBAUGH, Applicants

Mr. Diaz outlined the salient points of the staff report and
recommended approval subject to the conditions of approval .
Chairman Crites opened the public testimony and asked if the
applicant wished to address the commission.
MR. WENDELL VEITH, architect, concurred with the staff report
and conditions.
Chairman Crites asked if anyone present wished to speak in FAVOR or
OPPOSITION to the proposed project. There being no one, the public
testimony was closed.
Action:
Moved by Commissioner Wood, seconded by Commissioner Downs, adopting
the findings as presented by staff. Carried 3-0.
Moved by Commissioner Wood, seconded by Commissioner Downs, adopting
Planning Commission Resolution No. 1164, approving PP 86-26, subject
to conditions. Carried 3-0.
D. Case No. PP 86-30 - PACIFIC EQUIPMENT, Applicant
Request for approval of a landscape equipment
warehouse/showroom located in a service
industrial zone at the northeast corner of
Corporate Way and 42nd Avenue.
Mr. Joy outlined the salient points of the staff report and indicated
that the extra driveway had been eliminated, which would allow for
only two driveway approaches. Staff recommended approval subject
to the conditions of approval .
Chairman Crites opened the public testimony and asked if the
applicant wished to address the commission.
MR. RICK HOLDEN, 73-330 E1 Paseo, stated that he was present to
answer any questions.
Chairman Crites asked if anyone present wished to speak in FAVOR or
OPPOSITION to the proposed.

MR. BILL CALLAHAN asked about screening from Corporate Way.
Mr. Holden outlined the proposed wall and roof line.
Chairman Crites closed the public testimony.
Action:
Moved by Commissioner Wood, seconded by Commissioner Downs, adopting
the findings as presented by staff. Carried 3-0.
Moved by Commissioner Wood, seconded by Commissioner Downs, adopting
Planning Commission Resolution No. 1166, approving PP 86-30, subject
to conditions. Carried 3-0.
E. Case No. PP 86-33 - BERMUDA PARTNERS, Applicant
Request for approval of a 9500 square foot
office/warehouse project in a service industrial
zone on the north side of Lennon Place midway
between Corporate Way and Eclectic Street.
Mr. Joy outlined the salient points of the staff report and
recommended approval subject to the conditions. He explained that
they had received preliminary architectural commission approval and
outlined the details of the proposed second access to the east and
landscaping on this projects property. He noted that the property
to the east would be coming for public hearing at the next meeting.
Chairman Crites opened the public testimony and asked the applicant
,
to address the commission.
MR. LEONARD MYERS, applicant, agreed with the staff report and
to the conditions.
Chairman Crites asked if anyone present wished to speak in FAVOR or
OPPOSITION to the proposed. There being no one, the public testimony
was closed.

the findings as presented by staff. Carried 3-0.

F. Case Nos. PP 86-36, TT 21791 - GERMAIN DEVELOPMENT CO. , INC.,
Applicant
Request for approval of a negative declaration
of environmental impact, precise plan of design
and a tentative tract map to create 20 single
family lots and detached residences on a PR-5
zoned 5.02 acre parcel on the north side of
Hovley Lane, approximately 650 feet east of
Monterey Avenue.
Mr. Diaz outlined the salient points of the staff report. He noted
that commission had reviewed this project at a previous study
session. He indicated that city council , the Year 2000 committee,
and planning commission felt more single family housing was needed.
Mr. Diaz stated that the following condition should be added as #11
to require that the applicant shall meet all recommendations of the
Coachella Valley Water District. He also explained that a wall
would be provided composed of slump stone and chain link. Staff
recommended approval subject to the conditions as amended.
Commissioner Wood expressed concern regarding possible CVWD
r .. conditions. Mr. Diaz replied that if anything unusual was required
the case would be brought back before the commission.
Commissioner Downs questioned the three lots being consolidated into
one. Mr. Diaz explained that the map was incorrect.
Chairman Crites opened the public testimony and asked the applicant
to address the commission.
MR. DAVE GERMAIN, applicant, stated that he was present to
answer any questions.
Chairman Crites asked if anyone present wished to speak in FAVOR or
OPPOSITION to the proposed project.
MS. EDNA POPPEL, an adjacent property owner, stated that while
all major cities have traffic problems, this project was not
dense enough. She felt that the density proposed was much too
low.
MS. CAROL ROBINSON, 46-224 Sagewood, stated that she could not
be more delighted to have single family houses built. She
indicated that she was not sure if her property was effected or
not, but expressed concern about privacy because of the height
of the grading, but did not wish to hold the project up. Mr.
Diaz explained that while those lots are above the existing

lots, the applicant would be providing a wall , as well as the
position of the proposed houses, would eliminate that problem.
Chairman Crites asked if the applicant had sent anyone out to talk
with these people. Mr. Germain replied that it would be done.
MS. ROBINSON stated that she could not determine how tall the
wall should be and expressed concern about her water pressure
being very low. Mr. Gaugush indicated that he would contact
the Coachella Valley Water District about the matter and stated
that she should also contact them.
Commissioner Wood stated that he would like to see the developer and
residents work together to mitigate any concern about the wall
without holding up the project. Chairman Crites stated that this
could be added as a condition. Mr. Diaz stated that as condition
#12 the applicant would be required to work with adjacent property
owners on the final design of the wall at the northerly property
line. Mr. Germain agreed to this addition. Mr. Germain noted that
there were four lots on Sagewood effected, but that they were a
considerable distance away. Mr. Germain indicated that the sideyards
back up to the houses.
Commissioner Downs commented on the mound of dirt being so high, and
also about the applicant talking to the property owners to solve
concerns. Chairman Crites noted that this item would not come back
if the issue was resolved.
Chairman Crites closed the public testimony.

Moved by Commissioner Wood, seconded by Commissioner Downs, adopting
the findings as presented by staff. Carried 3-0.
Moved by Commissioner Wood, seconded by Commissioner Downs, adopting
Planning Commission Resolution No. 1167, approving PP 86-36 and TT
21791 , subject to conditions as amended. Carried 3-0.
VIII. MISCELLANEOUS
A. Chairman Crites reminded the commission of the joint meeting
which is scheduled for August 25, 1986. He encouraged everyone
to attend.
B. Chairman Crites asked that all reports contain the project data
information, especially items that have been continued.

C. Mr. Diaz informed commission that the city was involved in a
lawsuit with San Tropez Villas regarding school impact fees.
Commissioner Wood asked for and received clarification regarding
planning commission responsibility toward requiring school
impact fees on developments.
IX. ORAL COMMUNICATIONS
Mr. Phillips introduced Mr. Greg Swajian to the city attorney's
staff.
X. COMMENTS
A. Commissioner Wood asked for a copy of the report delineating the
three types of senior housing. Staff replied that it would be
sent to him.
B. Commissioner Wood thanked Chairman Crites for speaking before
the Board of Realtors.

Moved by Commissioner Downs, seconded by Commissioner Wood,
adjourning the meeting. Carried 3-0.
