I. CALL TO ORDER Chairman Crites called the meeting to order at 7 :00 p.m, 11 . Moved by Commissioner Whitlock, seconded by Commissioner Richards, approving the minutes of November 4° 1986 as corrected' Carried 4-0, V. Continued Case No. PP 86-45 - THOMA5 MILLER, Applicant Request for approval of a negative declaration of environmental impact and a precise plan of design to allow construction of 168 unit inn, a fu| | service restaurant and a gas ytatinn on 10 acres in the PC, (4) S.P. and PR-5 N, S.P. at the northeast corner of H1ghway il \ and Deep Canyon Road. Mr. Diaz explained that staff was requesting a two week continuance to study plan revisions. Chairman Crites opened� the public testimony and asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposed. MR. J0NES, 44-691 Monaco, expressed concern regarding the '~ perking area in the back and the tennis court location, Mr. s Sandy Baum, app| irant, responded that the tennis court was eliminated in the new plan. Chairman Crites recommended that the applicant and Mr. Jones get together to discuss the changes. Action: Moved by Commissioner Erwood, seconded by Commissioner Richards, approving m two-week continuance to December 2, 1986, Carried 4-0. B. Continued Case No. Pp 86-46 - RlCHAA0 OLKPHANT & ASSOCIATES, Applicant Request for approval of a four unit apartment project on the west side of the southerly terminus of Lantana Avenue. Mr. Diaz outlined the salient points of the staff report and indicated previous staff concerns had been addressed. MA. RlCHARD 0L|PHANT, 77-900 Avenue of the State*, stated that he had no problems with the staff report, Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposed. There being no one, the public testimony was closed. Moved by Commissioner Richards, seconded by Commissioner Whit |ock` adopting the Findings as presented by yteff. Carried 4-0, Moved by Commissioner Richards, seconded by Commissioner Whitlock, adopting Planning Commission Resolution No, 1191 , approving Pp 86-45, subject to conditions. Carried 4-0. C. Continued Case No. PP 86-47 - HARRY SCHMlTZ, Applicant Request for approval of a negative declaration of environmental impact, precise plan of design � and conditional use permit to allow construction %WW of a seven unit senior citizen apartment project located on Santa Rosa Way, east of San Pascual Avenue, Ms, Sass stated that a continuance was being requested to review the plans with the concurrence of the applicant. Chairman Crites opened the public testimony and asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposed. There was no one. Action: Moved by Commissioner Erwond, seconded by Commissioner Whitlock, approving a two-week continuance to December 2, 1986. Carried 4-0, Q. Case Nos' CUP 86-5 and VAR 86-4 Amendment - RlCNARD AND MAY LEE, Applicants Request for approval of a conditional use permit and associated variance to a] low the conversion / of four existing standard rental units to eight ftw MINUTES PALM DESERT PLANNING COMMISSION NOVEMBER 18, 1986 senior citizen rental units under provisions of Chapter 25. 52 Senior Housing Overlay of palm Desert. Municipal Code, located at the southeast corner of San Rafael Avenue and Catalina Way. Mr. Drell noted that before the commission was a letter submitted by the applicant requesting a continuance to December 16, 1986. He indicated that there were some people in the audience and outlined the concerns. Chairman Crites asked if the landscaping would be installed and maintained as per the condition. Mr. Drell responded that it was staff's intention to do this. Chairman Crites requested that at the next meeting staff come back to commission with a specific plan for obtaining compliance with the original approval . Chairman Crites also noted that the existing house has a three to four foot block wall and oleander hedge on the outside of this property and indicated that commission does not usually require someone to build another wall and hedge adjacent to an existing one. Mr. Diaz replied that staff would like the two neighbors to work something out. He also indicated that the property owner with the hedge must maintain it to a maximum level of six feet and noted that the oleander could be cut back. Mr. Diaz suggested a continuance because the applicant wishes to modify the project to be senior units. Chairman Crites opened the public testimony and asked if anyone present wished to speak. in FAVOR or OPPOSITION to the proposed. MS. MARGARET COLLINS felt that a wail should be installed to Prevent excessive noise from the adjoining patios. Chairman Crites asked if the existing wall could be used as a foundation to make it higher and asked staff to work with the applicant and neighbors. Mr. Drell replied that it could be added as a condition of approval and indicated that he would have a building inspector look at the wall and also informed commission that the applicant was considering withdrawing the request. Chairman Crites stated that if the change is requested, the answer to the concerns would be positive. Action: Moved by Commissioner Richards, seconded by Commissioner Whitlock, approving a continuance to December 16, 1986. Carried 4-0- 4 MINUTES PALM DESERT PLANNING COMMISSION NOVEMBER 18, 1986 E. Case Nos. C/Z 86-9 and PP 86-48 - CHAZEN CONSTRUCTION, Applicant Request for approval of a negative declaration of environmental impact, change of zone from single family residential to office professional , and a precise plan for a 11 ,255 square foot office building located at the southeast corner of Fred Waring Drive and Fairhaven Drive. Mr. Drell outlined the salient points of the staff report and recommended approval subject to the conditions. Chairman Crites opened the public testimony and asked if the applicant wished to address the commission. CHARLES MARTIN, 73-725 El Paseo, indicated that his client purchased this property with the desire for this style of architecture and noted that the design was consistent within the city. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposed. tow MR. KEN COSGROVE, 44-115 San Luis Drive (east of the proposed project) , stated that he did not oppose the zone, but felt that the lots next to this property should be changed also. Mr. Drell explained the process of the Palma Village Specific Plan and how the lots had been designated for the office professional zone. He stated that only lots facing Fred Waring Drive and the small section of Fairhaven was designated for office professional . The committee felt that since both sides of San Luis Drive were single family residential fronting on a local street, it should remain single family with no viable reason for change. Chairman Crites did note that a change of zone could be applied for. MR. JENSON, 44-147 San Luis Drive, stated that the 40 foot buffer did not stop any of the noise. He felt that all the property should be zoned for office professional and not done in a "piece-meal " fashion. Chairman Crites informed him that it would require a totally separate public hearing. MR. WILLIAM COSGROVE, Cactus Drive, Palm Springs, felt the zone change might not be compatible with the residential lots and recommended that all the lots be residential or all the lots be commercial . 5 %bow MINUTES PALM DESERT PLANNING COMMISSION NOVEMBER 18, 1986 Commissioner Richards also reviewed the principles of the Palm Village Plan and indicated that Monterey Avenue and Fred Waring Drive have both developed into busy traffic streets with empty lots that the city would like cleaned up. He felt that this was the best solution to the problem. Commissioner Richards also mentioned the possibility of combining the county-owned lots to the empty lots for development with access onto Fred Waring and a large setback on San Luis Drive. Mr. Drell noted that Riverside County never owned the lots in question and only purchased a portion of the two remaining. Mr. Diaz indicated that the county would be contacted and felt that based on the information available, a rezone for the other properties was not warranted. MR. WIt_LIAM COSGROVE recommended that commission send the proposed back to staff for further compatibility study. Mr . Drell stated that office professional was determined to be compatible and noted that there would be no night-time hours and it would be much quieter than residential . MR. JENSON asked how it would be possible to utilize 30 foot- county lots. Chairman Crites responded that it would be further studied. Mr . Drell stated that if the property owners wished to purchase those lots and get a plan worked out they could come and apply to allow the combined lots to face Fred Waring with a suitable setback onto San Luis Drive. Commissioner Richards noted that a lot of public input had been included in the original studies and stated that none of the office professional buildings were intended to harm residential property and indicated that this plan was not unusual . Chairman Crites directed staff to work with these people to contact the county and talk to the people on San Luis Drive to see if they would be in favor of office professional across the street with the proper setbacks. Action: Moved by Commissioner Richards, seconded by Commissioner Whitlock, adopting the findings as presented by staff. MISCELLANEOUS None- X. COMMENTS Commissioner Richards congratulated Chairman Crites on his being elected to fill a city council seat and wished him success on this new venture on behalf of the commission. Chairman Crites responded that it had been a pleasure and honor working with the commission. X1 .
