IV. APPROVAL OF MINUTES:
Consideration for approval of November Ifs, 1986 meeting minutes.
Action:
Moved by Commissioner Richards, seconded by Commissioner Whitlock ,
approving the November 18, 11486 minutes, as submitted. Carri?d i-6- 1

V. SUMMARY OF COUNCIL ACTION
Mr. Diaz summarized council .action rrom its last meeting.

VII . ORAL COMMUNICATIONS
MR. JOSEPH DUNN, 4j-94`i San Ysidro, stated that his project was
approved at the last meeting, but indicated that hF had an amendment .

Mr. Diaz responded that the request was for a duplex split ,and he �
refit that it was a minor amendment that could be handled at staff-
level . Commi,sion concurred.
Vlll . PUBLIC HEARINGS
A. Continued Case No. PP 86-45 - THOMAS MILLER, Applicant
Request i-or approval of a negative declaratior of
environmental impact and a precise plan of
design to allow construction of 166 unit inn, a
full service restaurant and a gas station on 10
acres in the PC (4) S.P. and PR-5 N, S.P. at the
northeast corner of Highway 111 and Deep Canyon
Road.
Ms. Sass outlined the five issues that were to be addressed by the
applicant as discussed in the staff report. Staff requested a
two-week continuance. Mr. Dial.- also noted that photos were neing
sent from t�rottsdale and Santa Barbara of the gas station.
Cr,airman Erwood opened the public testimony and asked if the
applicant wished to address the commission.
MR. SANDY BAUM, 45-800 Deep Canyon Road, stated that he was
aware of the request for a continuance and had notified all the
parties.
Commissioner Whitlock asked if the case would go to the architectural
commission hefore the next planning commission meeting. Ms. Sass
repiied yes.
Action:
Moved by Commissioner Richards, seconded by Commissioner Downs,
approving a continuance to December lh, 1'_+86. Carried 4-0.
B. Continued Case No. PP/CUP 86-47 - HARRY SCHMITZ, Applicant
Request for ;approval of a negative declaration
of environmental impart, precise plan of design
and conditional use permit to allow construction
of a sevt-n unit senior citizen apartment project
locat?d on Santa Rosa Way, east of San Pascual
Avenue.

Ms . Sas, outlined the salient points of the staff report and
recommended approval .
Chairman Erwood gpenecq the public testimony and asked if the
applicant wished to address the commission.
MR . HARRY SCHMITZ, applicant, stated that he would prefer a
two-story site plan which would require eight units to make the
project feasible because of an elevator and balconies, and
asked the commission to con�J der this concept. He indicated
that the present plan was one story and seven units. He
expressed concern regarding condition #li under community
development regarding wall height because of the grading
required by public works. Mr. Diaz responded that because of
the sensitivity of grading, the condition should remain as
stated and further studied by public works. Mr. Schmitz also
indicated that condition #15 under public works required a 1%
slope . Mr . Gaugush concurred and indicated that some
adjustments can be made in certain situations and that the
entire lot may not be 17. Mr. Schmitz also indicated that one
wall was already chain link with oleanders, but that staff was
requiring a block wall .
`.. Mr. Diaz indicated that since the lot could be raised three feet
with a building on top of that, staff would need some type of
preliminary grading plan for this project.
Commissioner Richards stated that the commission did not need to be
involved with this unless it could not be settled between the
applicant and staff, and in that event it shou'd be referred to city
council . Mr. Diaz stated that the condition should be modified oy
the addition of the words, ". . .to the satisfaction of the director
of public works and the director of community development . "
Commission concurred. Mr . Schmitz said that was .acceptable.
Mr . Schmitz stated that he was opposed to condition #S regarding
school impart fees imposed by the school district. He stated for
the record that it ha, not been proven satisfactoriiy that persons
of age 62 and older impact the school system.
Mr. Diaz stated that even if that condition was not required by
community development , the building department would require it
before a building permit was issued.
Chairman Erwood asked if .anyone present wished to speak in FAVOR or

OPPOSITION to the proposed. There being no one, the public testimony �rrl
was closed.
Commissioner Richards addressed the issue of a two-story project and
stated that he was not prepared to expand the site to eight units.
He felt that the final project was better and asked staff about the
six foot high block wall . Mr. Diaz replied that if the adjacent
property owners do not object with the lower three foot wall , staff
did not have a problem and the oleanders were fine.
Action:
Moved by Commissioner Downs , seconded by Commissioner Whitlock,
adopting the findings as presented by staff. Carried 4-0.
Moved by fommissioner Downs , seconded by Commissioner Whitlock,
adopting Planning Commission Resolution No. 1193, approving PP/CLIP
86-47 subject to conditions as amended. Carried 4-0.
IX. MISCELLANEOUS
A. Presentation to Planning Commission Chairman Buford Crites.
Chairman Erwood presented to former Planning Commission Chairman TWO
Buford Crites a resolution to commend him for his service on the
planning commission.
Mr . Diaz also presented Mr. Crites with a certificate from
staff.
Mr. Crites thanked the commission and Mr. Diaz and indicated
that it had been a pleasure working with each member of the
commission.
X. COMMENTS
A. Commissioner Downs stated that there was a wholesale supply
business in operation that has built two buildings illegally in
the past: and is now planning to expand on the block where
Keedy's restaurant was located. He strenuously objected to this
type of use on Highway ill or El Paseo. He felt that Ordinance
Section 25.28.030 should be amended by the deletion of Section
B. He fe I t that wi th a 1 i the work that the c i ty has done to
improve this area, wholesale types of business would defeat that
purpose.

Commissioner Richards felt that because it borders on Presidents
Plaza it should be studied, but was not convinced that the
commission should go after wholesale businesses in the C- 1 zone.
He felt that the idea of wholesale did not fit the reraii
r_haract?ristics of Presidents Plaza. He expressed re,uctance
to change the whole area in the C- 1 zone.
Action:
Moved by Commissioner Richards, seconded by Commissioner Whitlock,
directing staff to look into the usages that are currently allowed
within proximity to the Presidents Plaza. :tarried 4-0.
B. Mr. Diaz stated that staff needed a clarification regarding the
Rusty Pelican Expansion on the parking situation. He asked the
commission to determine if the expansion was minor or if they
should apply formally.
Commissioner Downs asked which direction they were expanding.
Ms. Sass replied to the east side, the grass area.
Commissioner Whitlock indicated that it would be in the
greenbelt between the building_.
low Commissioner Richards felt that the expansion should come back
formally. Commissioner Whitlock disagreed. Commissioner Down
stated that they were not going closer to the street and not
changing the entryway. Commissioner Richards asked if this
would reduce the open space. Ms. Sass replied yes, but to what
exrent would have tc) be studied. She felt the issue that
needed to be addressed was the parking.
Commissioner Whitlock asked if Pietro's opposed. Commissioner
Richards responded that it had not gone that far yet and
indicated that he was not opposed to them expandina 700 square
feet , but felt that iF the expansion changed the character of
the current restaurant in some way it should come back .
Commissioner Downs agreed.
Mr' . Diaz stated that letters of support from the neighbors
could be required. Commission concurred.
C. Mr . Diaz explained that Commissioner Erwood automatiraily
assumed the role of chairman until the end of the term, but
indicated that a vice chairman was needed.

Action:
Moved by Commissioner Whitlock, seconded by Commissioner Downs,
electing Commission Richards as vice chairman. Carried 3-0-1
(Commissioner Richards abstained. )
D. Commissioner Whitlock asked for the status of the Shadow
Mountain Cooperative situation and if financing had been
obtained.
Mr. Diaz replied that financing has not been obtained and would
be on the study session agenda for December 16, 1986.
XI . ADJOURNMENT
Moved by Commissioner Downs, seconded by Commissioner Richards,
adjourning the meeting. Carried 4-0.
