Chairman Erwood called the meeting to orde� at 7:00 p.m.

Consideration for approval mi�utes of December 16, 1986. Chairman
Erwood noted a word change on page 3 from "wall" to "door."

Moved by Commissioner Whitlock, seconded by Commisstoner Richards,
approving the December 16, 1986 meeting m9nutes as amended. Carried
3-0.

Mr. Diaz s�ximarized the salient points of the city council meeting
of December 30, 1986.

MR. NOEL ROBINSON, homeowner in Sagewood, stated that he was
representing five homes in Sagewood and the homeowhers association.
He explained that his wife had attended previous hearings on the
Germafn development and had outlined their concerns. He outlined
their present co�cerns and indicated that the concerns had not been
addressed adequately.
Cortmissloner Richards noted that the mayor was already involved in
this matter. Mr. Diaz also explained that the item Nas on the city
cou�cil agenda for January 8 and stated that if any of the co�ditions
of approval had not been complied with, it would be determined by
the city council and resolved. Mr. Robinson stated that he hoped
that wouid hold true.
MS. MARY STOLTZMAN, 74-055 Highway 111 , stated that she wes before
the commission for a study session and had requested a definition
to a�llow offices in the PR zone.
Cortmissioner Richards noted that under the new B�ow� Act any item
for discussion would have to be placed on the agenda 72 hours in
adva�ce. He stated that the issue was if the PR ordinance should be
revised to include med9cal office uses. Mr. Diaz recommended that a
revision to the ordinance not be made at this time. He indicated 'r'�
that commission could not take any action, but indicated the item
could be put on the agenda for January 20. Commissioner Richards
noted that he was in agreement with Mr. Diaz. Commissior�er Whitlock
concurred. ChaSrman Erwood stated that this item could be piaced on
the January 20 agenda, but noted the opinion of the cortmission.
Commissioner Richards noted that the council had placed a moratorium
i n that area to a 1 1 ow the c i ty to take a 1 ook at what i t wants for
the future. Ms. Stoltzman noted thet she was not in the moratorium,
but on the south side of Country Club. Commissfoner Richards noted
that a change like this would affect hundreds of acres of land. Ms.
Stoltzman indicated that in the R-3 she could apply for a conditional
use permit under health organization o� community facility.
Commissioner Richards stated that this would mean that the property
was similar to the Foundation of the Retarded. Mr. Diaz noted that
at study session it was the general consensus of the commission that
off i ce uses wou 1 d not be cons i dered a cannxm i ty fac i 1 1 ty and wou 1 d
not be different from other office types.

"' VIII. PUBLIC HEARINGS
A. Case No. PP 86-51 - TEO IENNON R ASSOCIATES, Applicants
Request for approval of a precise plan of design
and �egative declaration of environrtiental impact
for a 17,625 square foot retail office complex
in the C-I zoned property at the southeast corner
of E1 Paseo and �arkspur lane.
Mr. Smith outlined the salie�t poi�ts of the staff report and asked
for dlrection from commission regarding the parking issues and
written approvel from the owner to the east for driveway sharing.
Commissioner Richards felt that staff's observation regarding the
parking was correct. He noted that if there was a straight driveway
through there wou 1 d be a 1 ot of peop 1 e us i ng i t and i t Wou 1 d be an
active alleyway.
Chairma� Erwood opened the public testimony and asked if the
appiicAnt wished to address the commission. After no response,
Chairman Erwood asked if anyone present wished to speak in FAVOR or
OPF�OSITION to the proposed. There being no one, the public testimony
� was closed.
Cortxnissioner Richards provided background information and indicated
that staff had valid concerns. He suggested that the applicant
revise his plans based on staff requirement�.
Mr. Diaz recommended a contlnuance of one month to allow the
applicant to make changes; if changes are not made by that time, a
resolution of dental be prepared.
Commissioner Whitlock asked that the first floor be required for
retail use only. Mr. Diaz stated that he would discuss this with
the city attorney. Cormiissioner Whitlock also felt that lack of
parking was a critical issue for all of El Paseo. She felt that
this needed review. Cheirman Erwood concurred.
Chairma� Erwood reopened the public testimony and asked for a motion
continuing this case to the first meeting in February, �oting that
unless substantiai changes have been made, this wiii be denied, as
well as parking concerns needing to be addressed.

continuing PP 86-51 to February 3, 1987. Carrled 3-0.
8. Case No. ZO�A 86-6 - CITY OF PALM OESERT, Applicant
Request for app�oval of an amendment to Chapter
25 . 28 of the Zoning O�din�nce speclfically
related to sections 020 and 030, Permitted Uses
and Conditional Uses in C-( general commercial
zones.
Mr. Smith noted that commission directed staff on December 2 to look
into this matter. He outlined the optlons in the �taff report and
noted that Cortmissto�er powns preferred option "0." Staff asked for
direction from the commission.
Chairman Erwood o e�ed the public testimony and asked if anyone
Wished to speak in FAV'OR or OPPOSITION to the proposed.
MR. SANDY BAUM, 45-500 Deep Canyon, stated that on two recent
occasions he had seen pipes on the sidewalk, although he did
not know if they were for sale or if they had ,�ust been ,�
unloaded.
MRS. GANNON, owne� of the Desert Wholesale Supply, responded
that the supplies were being unloaded into the store and that
she had twa employees who moved the supplies within ten minutes
to a half hour. She indicated that they never sold anything
from the sideaalk.
Chai�man Erwood closed the public testimony.
Cortmissioner Richards lndicated that option "B" would provide the
mo�t flexibility where the wholesale uses would be permitted without
complicated deftnitions. He asked if unloading onto sidewalks was
permitted. Mr. Diaz replied that they had to unload there.
Commissioner Richards noted that there had been an evolvement of use
over the years and now there were problems with this type of use on
this property. He indicated that this was the first time someo�e
has complained about loading large types of mater9als in this area
as well as parking a�d vehicle traffic problems. He felt that the
business community was concerned with this type of business. He
indicated that the city would have to come up with somethi�g that
defines this and that cortmission should take some action and create a

�""' definition everyone could understand. He indicated a preference for
option "B."
Moved by Commissioner Richards directing staff to prepare a
resolution based on option B. The motion died due to a lack of a
second. Commissioner Whitlock stated that she could not second the
motion because she preferred option D involving the commercial
committee. Mr. Diaz replied that a resolution could be prepared for
the next meeting establishing option B and still have option D
available, and in the interim as part of item B that cartxnission could
refer the matter to the cortmittee.
Mr. Diaz noted that staff could pinpoint what land they are looking
at in terms of the overlay. He indicated thet city council would
also be reviewing this.
Moved by Commissioner Richards, seconded by Commissioner Whitlock,
continuing ZOA 86-6 to January 20, 1987, and directing staff to
prepare a resolution to be presented at that time. Carried 3-0.
Mrs. Gannon stated that they had been going to submit pians for the
corner of Larkspur and E1 Paseo and enclose Highway 111 with a block
aa11 to allow trucks to de) iver, but indicated that it seemed to
� create an uproar after it was known that Keedy's was leaving. She
stated that they never got to submit any plans which were done by Mr.
Martin showing their proposed concept. Mr. Diaz responded by saying
that this item could be scheduled for a study session, where the
plans could be reviewed.
Cortxnissioner Richards stated that he did not feei a fence on Highway
111 would be compatible, but agreed to look at the plans. Chairma�
Erwood indicated that the matter could be brought up for the January
20 study session.
Mr. Sandy Baum noted that the commercial cam►ittee would not be
meeting prior to January 20. Commission amended the motion by
continuing the case to February 3, 1987.

contin�ing ZOA 86-6 to February 3, 1987, and directing staff to
prepare a resolution to be presented at that time. Carried 3-0.
