Case No. PP 86-52 - TRlN_Y NOLEN PEST CONTROL, Applica�t Request for approval of a precise plan of design and negative declaration of environmental impact to ailow construction of a 4000 square foot industrial office building located on St . Charles Place, east of Boardwalk. Ms. Sass outlined the salient points of the staff report and recommended approval . Chairman Erwood questioned the imposition of condition #6 for school impact fees. An explanation of calculation was given. Commissioner Richards asked about any adverse impacts of storing chemicals on the site. Mr. Hottz stated that the fire marshal was aware of the situation, Chairman Erwood opened the public testimony and asked if the applicant wished to address the cortmission. MR, CNUCK STROTHERS, representative, addressed Commissioner � Richard's concerns regarding the storage of the chemicals and described the process for disposal of water residue from truck washing. Mr. Strothers indicated that public works condltion #7 was discussed with the public works department and should be amended to reflect that an elght foot mea�dering sidewalk would not be possible whe�e there are 35-40 foot mature trees growing. Mr. Holtz indicated that the condition read, ". . . to the satisfaction of the department of public works." He indicated that the sidewalk would be as close to the eight feet as possible. Chairman Erwood asked if this was part of the bike path. Mr. Holtz replied no. Chairman Erwood asked is anyone present wlshed to speak in FAVOR or OPPOSITiON to the proposed. There being no one, the public testimony was closed. Carried 3-0. 8. Case No. PP 86-53 - PAUL MOLLER, Applica�rt Request for approval of a 2816 square foot cortxnercial building on the west side of Painters Path, 400 feet south of Highway 111 . Ms. Sass autlined the salient points of the staff report and recortxnended approva 1 . Chairman Erwood opened the public testimony and asked if the applicant wished to address the cam�issfon. There was no response. Chairrt►en Erwaod asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposed. There being no one, the public testimony � was closed. Action: Moved by Ccxnmissioner Whitlock, seconded by Commissioner Richards, adopting the findings as presented by staff. Carried 3-0. Case No. PP 87-1 and GPA 87-1 - MARRIOTT'S DESERT SPRiNGS DEVELOF'MENT OORPORATION. Applicant Request for approval to change the general plan . land use designatfon. for the westerly quarter from "Park" to "Open Space, " to change the proposed alignment of Hovley Lane from curvilinear to a straight east-west line between Portola Avenue and Cook Street, and to construct a golf course project with a maximum af 120 residential units on 158 acres located on the 3 r.�. Ms. Sess outli�ed the saifent poi�ts of the staff report and recortmended approval . Cortmissioner Richards commented that the development coming from the north has solved a serious city problem of what to do with the land. Chairman Erwood opened the public testimony a�d asked if the applicant wished to address the commission. MR. PAUL GILMORE, ASl Consulting Englneers, stated that he was available to answer any questions. Chairman Erwood asked if anyone present wished to speak in FAVOR or OPF'OSITION to the proposed. MR. JOHN AVETA�[, Silve� Sends, stated that he had �o objectio� to the project, but indicated that a letter addressed to Mr. Diaz srating that a portion of the land was dedicated to improve Hovley Lane in its current curvllinear alignment. He requested that the la�d be returned to Silver Sands for the installation of three tennis courts. He stated that Mr. Diaz would be � taking this into consideration. MR. GEORGE BERKEY, 73-625 Joshua Tree, stated thet he had no ob,�ection to the proposal , but expressed interest in hoW the plans from WRT affected this area. He indicated that the plans showed ,�ogging and strolling paths and felt this should be taken into account. Ms. Sass noted that the area in question was not included in the area being studied by WRT. Cortmissioner Richards indicated that anything lncluded in the plans outside of the specified area under consideration could be an artist's co�ceptio�. He stated that the city was not at a point in time where the conmission could glve a� adequate answer. Mr. Berkey expressed understanding for the situatian. Chairrt►an Erwood ctosed the pubiic testimony. Commissioner Richards asked staff for input regarding land being returned to Silver Sands. Ms. Sass responded that a portion might be used as park access. Mr. Holtz stated that the city was underway 4 � MINUTES PALM DESERT PLANNING COMMISSION JANUARY 20, 1987 �" to develop the park as a retention basin for an outlet for the storm drain at Hovley and access would be needed to the back of the park. He did not see the city relinquishing the whole piece of property back to Silver Sands. Commissioner Richa�ds felt that it was not in the realm of the commission's duty to encumber this pro,�ect with that type of condition. Mr. Avetali stated that it was r►ot his lntention to delay the pro,�ect. Commissione� Richards felt that the city was fortunate that the Marriott Corporation proposed a low density project.
