Chairman Erwood called the meeting to order at 7:00 p.m.

Consideration for approval minutes of January 20, 1987 meeting.
Action:
Moved by Commissioner Whitlock, seconded by Commissioner Richards,
approving the minutes as submitted. Carried 3-0-1 (Commissioner
Downs abstained. )
V. SUMMARY OF OOUNCIL ACTION
Mr. Diaz surtmarized the pertinent items of the January 22, 1987 city
council meeting.

VIII. PUBIIC HEAR[NGS
A. Conti�ued Case No. PP 86-51 - TEO LENNON E ASSOCIATES,
Applicants
Request for approval of a precise plan of deslgn
and negative declaration of environmental impact
for a 17,625 square foot retail office complex
in the C-1 zoned property at the southeast corner
of E1 Paseo and Larkspur Lane.
Mr. Smith outlined the salient points of the staff report, clarifying
the requirert►e�t for parking spaces.
Commissioner powns requested the width of the proposed driveway
connection. Mr. Smith replied 24 feet. Cortmissioner Oowns noted
that on occasion a 10 percent variance is granted for parking. Mr.
Diaz indicated that variances were evaluated on a case by case basis
and also indicated that a parking authority was being formed to
acquire land and create a parking area. �
Chairman Erwood opened the pubiic testimony and asked if the
applicant wished to address the commission.
MR. TED LENNON, 72-058 Clancy Lane - Rancho Mirage, described
the fountain and pedestrian area and indicated that the top
peak of the tower goes above the height limit. He indicated
that there would be a third floor open air roof/deck and
discussed the parking provided.
After further discussion, the applicant stated that he would reduce
the size of the building area to 16,000 square feet, which would
meet the parking requirement with a provisio� of three ta�dem
parking spaces.
Cortmisstoner Richards indicated that three story bulldings are not
permitted in this area. Mr. Lennon replied that it would be withln
the height limit . Commisstoner Richards responded that the
cornnission could not recortxnend approval of this third story.
During discussion of the parking spaces and tandem parking,
Cortxnissioner Whitlock questioned the retention of the fountain for

r"" use as parking spaces that were lacking from the requirement. Mr.
Lennon replied that the redevelopment committee felt the fountain was
a good feature and would provide a strong focal point.
Chairman Erwood asked if anyone present wished to speak in FAVOR or
OPPOSITION to the proposed.
MR. JOE STEIN, 46-930 Eldorado Orive, asked the commission if
they could approve a development without first determining if
the proJect could pay. Chatrman Erwood replied that this was
not a factor in their decision. He indicated that their
decision was based on what the zoning requirement, generai
plan, zoning, and if the architecture are compatible.
Chairman Erwood closed the publlc testimony.
Mr. Smith noted that at the last meeting canmission asked the city
attorney to look into the matter of requiring first floor retail to
be provided.
Mr. Connors stated that it could be done, but after discussio� with
Mr. Erwin, they felt that a new zone should be created for this use
and recommended that the commission direct staff and the city
,` attorney to create this new zoning use.
Cortxnissioner Richards explained the background for the discussion of
this new requirement and asked the appiicant if this wouid effect
the pro,�ect. Mr. Lennon replied that it would be serious because of
a possible restaurant use and financing and stated that he would not
like to see this happen. Mr. Diaz stated that staff would recommend
that cortmission could use their discretion when requiring this use
and noted that the uses vary between blocks along El Paseo.
Cortmissioner Richards stated that he would move for approval with
the understandtng that a condition will be added as a condition of
approvai dealing with this ge�eral matter.
Mr. Diaz suggested that staff be directed to prepare a resolution of
approval with all the conditions and prepare an ordinance amended
setting forth the retail on El Paseo, which would give commission
the power of discretion depending on circumstance.
Commissioner Richards indicated that he would like staff to note the
conditions that could be approved implementing, on the assumption
that the I6,000 square feet of retatl is correct, 1 ) no activity on
third story, and 2) obtain fuii parking requirement. Cortxnissioner

Downs also indicated that it show unanimous approval of the �
commission to retain the fountain area.
Action:
Moved by Commissioner Richards, seconded by Cortxnissloner powns,
directing staff to prepare a resolution of approval with added
conditions. Carried 4-0.
Moved by Commissioner Richards, seconded by Commissioner powns,
instructing staff to prepare a retail use ordinance to be presented
at a future meeting. Carried 4-0.
B. Continued Case No. ZOA 86-6 - CITY OF PALM DESERT, Applicant
Request for approval of an amendment to Chapter
25 . 28 of the Zoning Ordinance specifically
related to sections 020 and 030, Permitted Uses
and Conditional Uses in C-1 general commercial
zones.
Mr. Smith reviewed the background of the case.
Commissioner Whitlock commented that she was expecting some input
from the commercial cortxnittee prior to agreement of option B. Mr. �
Smith replied that he thought that was the intention as an interim
measure, which could be changed.
Mr. Diaz questioned the ambiguity of the terminology which could be
applied to several uses when dealing with assembly. Cortmissioner
Richards stated that the definition of wholesale, assembly and
rt►anufacturing is provided for already.
Chairman Erwood noted that one reason for the agreement on option #B
was that it offered the ability of review on a case by case
determination at the discretion of the cortxnission.
Commissioner Richards commented that it was lacking in the general
plan that a goal intent that all the area on the south side of
Highway 111 and the north and south side of E1 Paseo be retail . He
felt that now concer�s have surfaced and a clearer determination was
needed.
Mr. Connors noted that legally the commission is attempting to make
the ordinance more spec9fic in itself. Mr. Diaz noted that the
wholesale option B view requires a conditional use permit in C-1
zones and recommended a continuance.

� Chairman Erwood opened the public testimony and asked if anyone
present wished to speak in FAVOR or OF'POSITION to the proposed.
There was no one.
Chairman Erwood recortxnended that a motion be made continuing this
matter to allow staff to prepare anothe� alternative as suggested by
Mr. Diaz. Upon further discussion, it was determined that approval
would be possible with an amendment as follows, "That the intent of
the ordinance is to limit wholesale uses in the C-I zone and,
therefore, a conditional use permit is required." Mr. Connors
concurred.
Action:
Moved by Commissioner powns, seconded by Cortmissioner Whitlock,
adopting the findings as presented by staff. Carried 4-0.
Moved by Commissioner powns, seconded by Cortmissioner Richards,
adopting Planning Commission Resolution No. 1200, recommending
approval of ZOA 86-6 as amended to city council . Carried 4-0.
IX. MISCELLANEOUS
A. Possible traffic hazards at 74-280 Highway 111 - RICHARD

Mr. Diaz reviewed the request and tnd9cated that public works
substantiated the claim that there is a hazard.
After discussion it was determined that a formal request should be
submitted.
Action:
Moved by Commissioner Richards, seconded by Commissioner powns,
directing staff to bring this case before the cortxnission as a public
hearing item with the preparation of a staff report. Carried 4-0.
B. Appointment of Ecor�omic Development Advisory Can�ittee Liaison.
Mr. Diaz noted that prior to appointment to the planning cortmission,
Commissioner Whitlock had served of the committee.
Action:
Moved by Commissioner Richards, seconded by Commissioner powns,
electing Cortmissioner Whitlock as liaison to the Economic Oevelopment
Advisory Committee. Carried 4-0.

X. OOMMENTS �
Cortxnissioner powns thanked staff for handling the zoning ordinance
amendment in a timely fashion.
Mr. Dtaz noted that the plan�ing commissioners conference was coming
up and indicated that if anyone wished to attend, to let him know so
that. arrangements could be made.

Moved by Commissioner Richards, seconded by Commissioner powns,
ad,journing the meeting. Carried 4-0.
