Request for �pproval of the April 7, ]987 minutes. Commissioner
Richards indicated tl�at a motion of denial needed to t,e added on
page 3. Mr. Diaz also requesred r_ larifiication regarding the appr�v,31
of the resolution regarding the parking. Commission indicated that
they appr�ved the parking lot a� recommended by staff.

MR. BOB SANDERS, 45-F315 Edgehill , stated that he lived behind the
Palm Desert Community Center and expressed concern over its upkeep.
He also noted that the paint wa_ f{aking off.
Chairman Erwood informed Mr. Sanders that at a previous pl�nning
commission meeting a represent-ative of the Coacheila Valley Parks and
Recreation indicated discussions were being held with the
redevelopment agency to reloc�tP thF community center .

A. Case No. PP 87-10 - MIRALESTE INVESTMENT CORP. , Applicant
Request for approval of a negative deciaration
and precise plan of design to ailow construction
of a professional office buiiding in the office
professional z�ne on property loc�ted on the
west side of Monterey Avenue, 250 feet south of�
Sonora Orive (vacated) .
Mr. Diaz reviewed the staff report and outlined stal=f concerns and
recommended that staff be instructed to prepare a resolution of
denial .
Commissioner powns asked if this had been before the architertural
� commission. Mr. �iaz replied
yes, r�ut noted that it did not receive
architectural approval .
Chairman Erwood opened the public testimony and asked if the
applicant wished to address the commission. There being no rrsponse.
Chairman Erwood asked if anyone present wished to speak in FAVOR or
OPPOSITION to the proposPd. There being no one, Chairman Erwood
closed the public testimony.
Action:
Moved by Commissioner Richards, seconded by Commissioner Uowns,
directing staff to prepare a resalution of denial for the May 5,
1y87 meeting. Carried 5-(1.
B. Case Nos. PP 87-I1 AND TT 22393 - NEISON DEVELOPMENT COMPANY,
Applicants
Request for approval of a precise plan of design,
a negativE declaration of environmental impact
and tentative tract map to subdivide 6.3 acres
into thir-teen lots to construct eleven 4-plex

apartment buildings in the PR-7 zone on Magnesia �
Falls Drive approximately 700 feet east of
Portola.
Ms. Sass outlined the salient points of the staff report.. 5taff
indicated that the applicant was requesting a waiver of setback
requirements for the two eastermost buildings, which he would
address. Staff also indicated that F�ublic works conditions #22 and
23 would be stricken, and condition #l5 would be added to community
development conditions stating, "Applicant shall install landscaping
along the bikeway route along the east side" and also #l6 that, "All
conditions contained herein shall be compiied with prior to permit
issuance or recordation of the final map, whichever occurs first."
Mr. Diaz felt that A street would remain private and staff noted that
it had been added to community development conditions.
Commissioner powns felt that with an eight foot sidewalk, street
widening in some places might be impossible. Commissioner Richards
agreed and asked public works for some general cost figures for
installing a meandering sidewalk. Mr. Folkers responded that it
would be $20 t.o $30 per run foot plus, depending on landscaping and
curb and gutter additions. Mr. Folkers stated that it would be
desirable to have curb and gutter along that side. Commissioner �
Richards asked about provision in the capital improvement project �
budget to form some type of cooperation. Mr. Diaz informed
commission that staff had been critized in the past as to whether
the development was being charged for improvements. Mr. Diaz stated
that the question that needed to be answered was, "Are we requiring
improvements that the project is demanding?" Commissioner Richards
indir_ated that in this case the school district was building a
schoo 1 to create a demand and quest i oned i f they shou 1 d be a party
to put up some money for the demand and felt that some study should
be put into tr�is concept. Mr. Folkers indicated that other factors
were involved re�arding the r_urb and gutter because of property
owned by the water district and having to obtain an easement. He
stated that if it were approved, the city would be responsible for
$ 10, 000 t.o $ 15, 000 for improvements in the area. Commissioner
Richards in�icated that down-zoning has occurred plus new ways being
added. He also f elt there was a safety problem for youngsters
in the area.
Commissioner powns asked where the street would be widened and why.
Mr . Diaz stated that it might be that an eight foot meandering
sidewalk may not be possible, but that we ask for the maximum and
publir_ works can allow for it to be lower if needed. Mr. Folkers

'r+ stated that applicant shall work with staff to get some type of curb
and gutter, sidewalk and som? street widening.
Commissioner �adlow expressed concern regarding erosion of the wash.
Mr. Diaz explained that certain requirements had to be met that
dealt with that specific concern.
Chairman Erwood opened the public t.estimony and asked if the
applicant wished to address the commission.
MR. DAVID NELSON, 74-606 Oriftwood Orive #l , stated that he
would like the the street to be public, saying that setbacks
are increased for private streets. He indicated that the
greenbelts would be the same and felt. that they have complied
with all the other conditic�ns for entrances and pyramid ro�fs.
Regarding the Whitewater Channel he indicated that they would
be cementing the si�e of the bank.
Commissioner powns asked Mr. Nelson why he wanted a public st.reet.
Mr. Nelson indicated that if it remains private, half the lots would
be public, half private. He felt there would be problems with s��me
residents paying for the private street. Mr, Diaz felt the city
should not have to maint.ain what was essentially a iarge access
drive and suggested the use of CCBR's to mitigate the cancern.

Chairman Erwood asked if anyone present wished to speak in FAVOR or
OPPOSITION to the proposed.
MR. KEN NELSON asked for and received clarification regarding
added candition #16. Mr. Nelson expressed opposition to the
street remaining private due to the fact that l00 percent of the
lot owners would have to pay and only 50 percent would actually
have use.
MR. ED MALATTI , 385 Via Sorno-Wedgewood Glen, indicated that now
was the time to development this property and felt this pro,ject
w�s viable.
Chairman Erwc>od closed the publir_ testimony.
Corr�nissioner Richards asked staff about creating findings. Mr. Uiaz
expVained that if the majority of the commission feels that because
of the spec�ial circumstances associated with the history of this site
and feels the demands for off-site improvements are not warranted to
be born by this particular dPvelopment in regards to equity, s�me
solution could be wc�rked out between the city and the developer.

Commissioner Ri �:hards stated that would eliminate his concern. �
Commissioner powns agreed.
Commissioner Richards stated that he would like to make the motion
to inciude the necessary findings that would waive the off-site
requirement for� property that heads east and asked staff to change
one of the conditions of approval to assure: 1 } meandering sidewalks
of some size is installed; and 2) if not practicle to widen street,
city and public works will come up with a solution, even if
temporary, assure safety and allow st�ff and public works the
ability to make changes they might need that are not exactly spelled
out in thesP conditions. Mr. Diaz stated that there would be added a
planning commission condition of clarification stating that it is the
intent of the planning commission that public improvements be
designed in cooperation between tr�e applicant and the city in such a
manner as to achieve the ultimate balance of the needs of the city
and assure the quality of the development. and design would be both
before the commission for approval .

Moved by Commissioner Richards, seconded by Commissioner powns,
adopting the findings as presented by staff. Carried 5-0.

C. Case No. PP 87-13 - MIRALESTE INVESTMENT CORP., Applicant
Request for approval of four single-story
apartment units located on the south side of
Shadow Mountain Drive, 500 feet west of Portola
Avenue.
Mr. Diaz outlined the salient points of the staff report and
rer_ommended approval subject to the addition of a condition for a
six foot masonry wall ,
Chairman Erwood opened the publir_ testimony and asked if the
applicant wished to address the commission. There being no response,
Chairman Erwood asked if anyone present wished to speak in FAVOR or
OPPOSITION to the proposed. There being no one, Chairman Erwood
closed the public testimony.

�" Commissioner Whitlock asked if the block wall would ad,join with a
wood fence. Mr. Diaz indir_ated that. it would go all the way around
the project,
Commissioner Richards noted the po��r quality of the drawings and
recommended that staff require a certain level of competency ��f
drawing� to be submitted. Mr. Uiaz stata�y that he would bring the
workiny drawings back after architectural commissfon review. Mr,
Diaz recommended approval with the addition of r_�ndition #7
indicating that a six foot masonry wall be const.ructed around the
site and that planning commission would rEview and approvai final
working drawings.

adopting Planning Commission Resolution No. 1216, approving PP 87- 13,
subject to conditions as amended. Carried 5-U. .
D. Case No. CUP 87-5 - ST. MARGARETS EPISCOPAL CHURCN, Applicant

Request for approval of a conditional use permit
to allow expansion of existing church Facilities
including construction of a 27,692 square foot
sanctuary on 6.72 acres in the P, S.P. and F�-1 ,
S.P. zones bounded by Highway 74, the Palm Valiey
Storm Channel and the Palm Desert Community
Church property.
Ms. Sass outlined the salient points of the staff report and
indicated that the project. met. all the requirements except for the
48 fo�t high sanctuary which was approved by the r_ity council , an��
recommended approval phase 1 , 2, 3, and 4, subject to the addition of
conditions #7 that all access driveways shall be designed for high
speed ingress and #8 that all driveways and curb entrance throats be
designed to r�ave a minimum length of 50 feet and parking area be
redesigned to meet this requirement. Staff stated that the applicant
sr�ould return with specific plans for phase 5.
Commissioner Richards asked about these types of uses for a church
and the p�ssible need t=or a policeperson on duty for high traffic
periods and any possible design modifications for this. Mr. Folkers
stated that it was designed for non-offir_er control , but felt that

an officer would make a differenr_e. He felt a good design was
needed.
Commissioner Ladlow asked for and received clarification regarding
the sanctuary height.. Ms. Sass clarified that the adjacent structure
was actually higher.
Chairman Erwood opened the public testimony and asked if the
applicant wished to address the commission.
MR. MI�TON CHAMBERS, 72-484 Milraney Drive, stated that there
was a mis-reading in the city council minutes and that St.
Margarets was lower in height than the Community Church, not
higher , as indicated, and asked for questions from the
commission.
Commissioner Richards complimented Mr. Chambers on the nice set of
plans.

E. Case No. PM 22499 - William Murray b Associates, Applicant
Request for approval of a tentative parcel map
to consolidate eight parcels into three along
the east side of the Palm Vailey Stormwater
Channel south of Hedgehog Street, west of the
Kings Point development.
Ms. Sass noted that the name on the legal notice needed to t,e
amended to William Murray & Associates as the applicant. She stated
t.hat the conditions needed to be amended by t.he deletion of community
development condition #1 and the addition of 17 public works
conditions.

calling a five minute recess. Carried 5-0. The time was 8:34 p.m.
Chairman Erwood recovened the meeting and opened the public testimony
and asked if the apF�licant wished to address the commission.
MR. BILL MURRAY, 49-630 Paradise Avenue in Morongo Valley,
stated that he had reviewed the condit.ions and requested
conditions #4, #7, and #it) based on issuance of grading permit .
Chairman Erwood clarified that the request was in regards to
the time these would be required. Mr. Murray replied yes and
indicated that the purpose of the parcel map was to establish
boundary lines. He felt that the project was long overdue and
stated that all conditions would be met.
Mr. Folkers requested clarification regarding the time element the
applicant was requesting. Mr. Murray replied at the time of grading
or building permit being issued. Mr. Diaz indicated that he did not
have a problem. Chairman Erwood reiterated that the request was for
conditions #4, #7, and #10 to be amended and effective ��pon issuanr_e
of grading permit or construction permits. Mr. Murray replied yes.
Mr. Diaz noted that this applicant had been very cooperative with the
city and the redevelopment agency in the past.

MR. GARY CHANEY , 72-555 Hedgehog, stated that he was not
against the project, but requested clarifir_ation regarding the
access points. It. w�s determined that Mr. Chaney was discussing
a previously approved project and Ms. Sass stated triat the
plans could be reviewed at the community development department.
MR. GARY JOHNSON, 72-579 Hedgehog, stated that he was also nat
at the last meeting and expressed concern regarding traffic,
building height, and phasing. Chairman Erwood informed Mr.
Johnson that all of these concerns had been expressed at the
last meeting and indicated that he should meet with staff. Mr.
Johnson asked for and received r_larification regarding grading.
Chairman Erwood closed the public t.estimony.

A. Case No. PP 16-83 Amendment #! - PALM DESERT DISPOSAL, Applicant
Request for ciarification of use for the Palm
OPsert Disposal transfer station located on the
south side af Lennon Piace, between Eclectic and
Corporate Way.
Mr. Diaz explainer� that the applicant wouid be before the commission
an May 5 under public hearing, but wished for clarification on the
permitting of a transfer station.
Mr. Raymond Burke of Palm Desert Disposal reviewed the request and
felt there was a definite need for this facility.
Mr . Diaz suggested a one-day tour of the Anaheim facility.
Commissioner Richards requested additional written information in
lieu of a tour. �
Mr. George Berkey, Boardmember of Corporate Center Property �wners
Association, felt there was a need for this type of facility, but
requested an alternate site.
Commissioner Richards stated that he would like to hear a detailed
report at a public hearing and Commissioner powns stated that he
would like to see the transfer station use proposed under a
conditional use permit at any location.
Mr. Diaz recommended that Mr. Burke talk to adjar_ent property owners
prior to the May 5 public hearing.
Action:
Commission determined that more information was needed and felt ttiat
a conditional use permit might be appropriate.
