pr��perty from. Fie felt that the �ersz�n who tinld th� property wr3s
aware �f the expansion pians and part of the praperty owners
as�ociat.ion. Chairman Erwoc�d felt the c�c�r�porate Cent�r went. i�to
thi � with t.hpir eyes open. Mr. RomFr st,�ted that there was a
;uk�sequent r�uyer in between. Chairman Erwood felt that the city
shoui� nGt be put. in the middle of this situation because the r_it.}�
was not part of the CC&R's. Aft�r further di,russion Mr. Ui��
directiy asked Mr. R�mer if the city would be named in a law suit if
the proposa I were tc� be approver_l. Mr. R��mer answered th�t he cr.�u;d

C�mmissi�ner F�ir_hards outlined the use af the service industrial
zone, reviewed the history of th� rorporate cent�r's existence and
�llowanc� ot= offiice u�es in this arpa, and ir,dicat.ed that the
service in�ustrial busines��s shauld be prbtected. �
MR. GEt�RGE BERKEY, Corporata Ce�tc�r Property Gwners Association,

Richards comments, but felt tr�at many propert;e� in the �rea

minded person interested and deeply concerned with the ongoing welfare and
permanent well-being of our desert carmunity. I will be in New York at the
time of your hearing, therefore, I have asked �1rt McKay to present rny thoughts
on the subject of case #PP16-83, amencfinent #1.
I unequivocally state I am not opposed to progress and readily appreciate and
realize full well the in�ortance of all the servioes vital to the w�ll-being
of our ccnmLmity.
With great civic pride I have watct�d the development of such high quality
'� proi�.erties as the Desert Springs t�larriott hotel and the many newly designed
attractive buildings in the Corporate Center Park. 2'he possibility of
allowing a garbage business to now become tt� major lanchnark of this other-
wise outstanding develo�nt causes great concern and apprehension -- in
fact, it is absolutely offensive. The developer of the industrial park
and representatives of the City of Pa]m Desert persuaded my par.tner, Elynor
Fa1);, and myself to donate to tt� city (at rx� renimr_ration to us) an
ac�ciitional 20 feet on the 42rxi Street frontaye, ereating an ur�proved
'� alignment for the existing road. This free gift on our part toclay
represents approximately $100,000. W� agreed to the developer's and
the city's request in our desise to he c�ood citizens and br�caus� we are
�nscientious and truly care about the area. YJe most certainly 4n�uld
not have made the donation if we woul.d have been told that this gift was
" to facilitate the expansion of a garbage business.
If this application goes forward -- we want the gift of our lancl back!
� A full scale E.I.R. should be rec�uired in any case. Th.is report should
include the effect that this garbage expansion proposal would l�ave on each
individual's property enc�assing the entire area and the further effect
it would have on each ind.ividual's business in the existing tract. It
should certainly inclucle the effect the e�ansion would have on prope.rty
such as ours on 42nd and Corporate Way which is presently zor�d for multiple

� housing. I am sure the health departlr�nt str�uld be irnrolved in evaluating
the air, noise and sanitary conditions. Consideration should be given by
the garbage axnpany � m�ving the existing location of their c.�any to
a lesser dense area, One has only to drive by the gar}xzqe calp�any and
look through the chain link fen� as the business exists today. It is
• certainly not a very pleasant experience to view property on which
millions have been spent to beautify, and then, to cane t�on the dozens
upon dozens of garbage trucks lined up along the chain link fence. Pddi-
tionally, the hundreds of outhouses located in the garbage ccx�any's yard
as well as the"l�ney wagons"that service people wh� have trouble with
. their septic tanks are clearly evident.
It is my opinion that all of those ltm�be.ring awlaaard garbage trucks w�uld
create a safety hazard in tt� inrr�diate vicini_ty both ccBning and c�ing, At
the very least they would disturb the aesthetics of the area. Based �on
the present zoning that w� have on our 40 acre property, it would create
, a great disturban�e to the population of the mobile k�ne park and weuld
adversely affect our property values.
