HomeMy WebLinkAbout1117 MINUTES PALM DESERT PLANNING COMMISSION MEETING TUESDAY - NOVEMBER 17, 1987 7:00 P.M. - CIVIC CENTER COUNCIL CHAMBER 73-510 FRED WARING DRIVE NO STUDY SESSION WAS HELD. I. CALL TO ORDER Chairman Erwood called the meeting to order at 7:02 p.m. II. PLEDGE OF ALLEGIANCE Commissioner Ladlow led in the pledge of allegiance. IIl. ROLL CALL Members Present: Rick Erwood, Chairman Faith Ladlow Jim Richards (Arrived after start of meeting) Carol Whitlock Members Absent: Bob Downs Staff Present: Ray Diaz Dave Erwin ,A, Dean Lewis Catherine Sass Tonya Monroe IV. APPROVAL OF MINUTES: Request for approval of minutes for the October 27 and November 3, 1987 meeting. Action: Moved by Commissioner Whitlock, seconded by Commissioner Ladlow, approving the minutes as submitted. Carried 3-0. V. SUMMARY OF COUNCIL ACTION Mr. Diaz summarized the salient points of the November 12 city council meeting. VI . CONSENT CALENDAR A. Case No. PMW 87-12 - CHAZEN CONSTRUCTION, Applicant Request for approval of a parcel map waiver to rr.. MINUTES PALM DESERT PLANNING COMMISSION NOVEMBER 17, 1987 create one parcel out of two existing parcels on MO Shadow Mountain Drive. B. Case No. PMW 87-13 - CHAZEN CONSTRUCTION, Applicant Request for approval of a parcel map waiver to create one parcel out of four existing parcels at San Jacinto Avenue and Portola Avenue. C. Case No. PMW 87-14 - CHAZEN CONSTRUCTION, Applicant Request for approval of a parcel map waiver to create one parcel out of three existing parcels on Fred Waring Drive. D. Case No. PMW 87-15 - WILLIAM COX & SONS, Applicant Request for approval of a lot line adjustment. E. Case No. PMW 87-19 - CHARTER COMMUNITIES, Applicant Request for approval of a lot line adjustment. Action: Moved by Commissioner Whitlock, seconded by Commissioner Ladlow, approving the consent calendar by minute motion. Carried 4-0. VII. PUBLIC HEARINGS A. Case No. PP 87-32 and VAR 87-3 - MIRALESTE INVESTMENT CORP., Applicant Request for approval to construct a 1467 square foot office building on the northwest corner of Highway III and Cabrillo Avenue. Ms. Sass informed commission that the city attorney felt that the legal notification was not acceptable and recommended the case be continued to allow for re-advertisement. Chairman Erwood opened the public testimony and asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposed. MR. CHARLES MARTIN, 40-840 Thunderbird in Rancho Mirage, indicated that he spoke to Tim Connor of the city attorney's 2 ..rr MINUTES PALM DESERT PLANNING COMMISSION NOVEMBER 17, 1987 office, drafted a petition and obtained signatures for the 300 foot radius stated that they waive their right to a 10-day notice and understood that this was acceptable. He stated that the matter was of concern because of escrow deadlines and explained that people had gone out on foot and obtained the signatures. He asked that the case be heard because information given to them by the city attorney was followed. Mr. Erwin stated that the problem was with the signatures of persons signing not being authorized to sign for the owners, not the procedure or terminology. Mr. Martin asked about the time involved in the continuance. Ms. Sass indicated that if the proper information was provided by Wednesday, November 18, the hearing could be scheduled December 1 . MR. MARK PICKING, 72-600 Fred Waring Drive, informed commission that he was not aware of any problem with the signatures and was shocked that the public hearing would not be going further. He stated that this was the first time he had heard of any problems with the signatures and felt that they should have been told. He informed commission that he was one of the people that obtained the signatures and felt that it was done in good �.. faith. Mr. Diaz stated that this was the first time in 20 years in planning that he has seen this done. He indicated that this was done because the property owners list was not supplied on time and indicated that the applicant should have provided adequate time for escrow. Since the item was already on the agenda, Mr. Diaz asked the city attorney if commission could comment on the case. Mr. Erwin stated that it was permissible if commission desired to do so. Commissioner Richards stated that he was not in favor of acting upon this proposal until proper noticing has been done and public testimony after that noticing is taken. He indicated that he had no problems with a two-week continuance. Chairman Erwood asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposed. There was no one. Mr. Diaz asked if commission wished to express any concerns about the project to the applicant. Commission indicated they wished to wait for future public testimony. ,` 3 MINUTES PALM DESERT PLANNING COMMISSION NOVEMBER 17, 1987 Action: Moved by Commissioner Richards, seconded by Commissioner Whitlock, continuing PP 87-32 and VAR 87-3 to December 1 , 1987. Carried 4-0. B. Case No. PP 16-83 Amendment #2 - HOWARD PARSELL, Applicant Request for approval of a 3.5 acre expansion to a parking and storage area and a second story addition to an existing structure (5400 sq. ft. ) located on the south side of Lennon Place between Eclectic and approximately 500 feet east of Corporate Way. Mr. Diaz outlined the salient points of the staff report and reviewed the concerns generated by the last application. He noted that a letter from the Riverside County Health Department had been supplied by the applicant; a letter had been received from George Berkey relaying agreement to the application per compliance with the provision of trees and landscaping; and with the mitigation measures, Mr. Diaz recommended approval . Chairman Erwood opened the public testimony and asked if the applicant wished to address the commission. r MR. GORDON PAULUS, representative, concurred with the staff report and provision of trees and landscaping per Mr. Berkey's letter. He addressed the issues of "port-a-johns" and explained how they would be cleaned before coming onto Palm Desert Disposal 's site. He also discussed the garbage trucks and the process used to clean them. Mr. Paulus read the letter from John Fanning of the Riverside County Health Department and asked commission for any questions. Chairman Erwood asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposed. MR. ROGER LANGER, 74-489 Gary, President of Palm Desert Country Club Homeowners Association, explained that the only concerns he had were flies and odor and assurance that there would be no transfer station. Chairman Erwood explained that the transfer station was not part of the application. Chairman Erwood closed the public testimony. 4 MINUTES PALM DESERT PLANNING COMMISSION NOVEMBER 17, 1987 Commissioner Richards commented on the mitigation measures and felt that the expansion was acceptable. Commissioner Ladlow asked for and received clarification from Mr. Paulus that this expansion was for 15 years. Commissioner Whitlock stated that her concerns had been addressed and was in favor of the expansion. Chairman Erwood felt that the applicant and staff had answered all the questions and concerns from prior meetings and impacts on neighbors, and indicated that the city has adequate ordinances to deal with odor and noise if a problem ever occurs. Action: Moved by Commissioner Ladlow, seconded by Commissioner Whitlock, adopting the findings as presented by staff. Carried 4-0. Moved by Commissioner Ladlow, seconded by Commissioner Whitlock, adopting Planning Commission Resolution No. 1263, approving PP 16-83 Amendment #2, subject to conditions. Carried 4-0. Mr. Diaz noted that at the last commission meeting there was discussion regarding land for recreational vehicles to park and noted that two lots are not being used by Palm Desert Disposal for their expansion. He felt that possibly an agreement could be discussed for this use. Mr. Ray Burk of Palm Desert Disposal and Mr. Paulus indicated that they were willing to discuss this possibility. VIll. MISCELLANEOUS A. Request for determination of Community Development Director's modification. Commission instructed staff that the above request should be brought back as a public hearing item. IX. COMMENTS Commissioner Ladlow spoke regarding mini-malls and expressed opposition to the overall mini-mall concept and aesthetics of parking in the front. Commissioner Richards also expressed opposition to mini-markets from a practical stand point. Xi. ADJOURNMENT Moved by Commissioner Richards, seconded by Commissioner Ladlow, adjourning the meeting.
