GPA 87-2, C/Z 87- AND PP 87-20 - ZRIAD PACIFIC DEVELOPNIEIV'P, Applicant Request tor appraval of a general plan amer�nent, change of zone, precise plan of design and draft environmental impact report to construct a mixed-use office/residential project consisting of 139,000 square feet of professional office space and 224 apartments on 34 acres at the rx�rtheast corner of Cook Stxeet and Havley Lane. Ms. Sass outlined the salient points of the staff report and noted that three letters in opposition had bee.n received. She indicated that canrnuiity development condition #25 should be amended to include a t�rie frame and public works oonditian #10 sYx�uld include Havley Lane. Catmissioner Whitlock asked for and received clarificatian regarding � installation of inedians on Cook to Havley and signalization, as well as whr� is responsible for payment. Ntr. Folkers indicated that the signalization fees go into the general fund for the city, not necessarily for the intersection at Hovley and Cook. C�airman Er��-�od asked for and received clarification on the present zoniuig and niunber of units allawed under the PR-5 zoning. Chairman Erwood opened the public testimony and asked if the applicant wished to address the catmission. MR. C�-NCK STRO'I'f-IERR stated that he has been a valley resident for 10 years and outlined the history of Triad Pacific Develogne��t and the property. He infozmed cannission that he started with the city to develop a viable pro�ect and has met with the board of directors of the Lakes and with Vista del Nbntanas. He outlined the design evolution that had taken place fran concerns and described the final plan. C7�airman Erti�od asked if anyr�ne present wished to speak in FAVOR to the project. 2 � MIN[T�FS PAIri DFSE�ZT PI�ING CO�AffSSI0�1 JAN[1ARY 19, 1988 � Nff2S. LOIS MALL, 41-055 Largo in Palm Desert, stated that she was the secretary to the board of directors at Vista del Montanas. She indicated that the project was w�rthwhile, hawever, she expressed concern for the change in density, the two-story building height blocking the views, and r�ise frccn recreational facilities. PHYLLIS THCN�SON, representing the Marriott Corporation, spoke in fawr of the project and stated that Chuck Strother has been a good neighbor and did not see any negative icr�acts on the area from the proposed. project. C�airmari Ec��od asked if anyone present wished to speak in OPP(�ITIO�I to the proj ect. MR. EDWARD ET��II,, 336 Red River in the Lakes Country Club, spoke again.st the change of zone. He stated that they bought into the Lakes with the intent of having c�n�atible neighbors. He expressed concern for the follawing: increased de.nsity in residential neighborrr�od changes its acRiplexion; office rentals with iuicontrolled access, because bur�glaries are a problem; potential invasion of privacy and blocking of views; impact of increased traffic on Cook and Countzy Club. Mr. Ethel indicated �r that if commission feels this is a suitable project, then suggested they consider views and privacy and limit the project to one story, and install sane type of security barrier. MR. PHIL FIDDERGREIN, 138 Running Springs in the Lakes Country Club, stated that he was representirig 174 hcmeoaaners against the charige of zone and general plan amencbnent. He indicated that the averall txaffic study in the EIR has rbt b�en canpleted and reviewed discussions that had taken place at the January 14 city council meeting regardirx� Sunterra, Avenue 42 and Havley and felt that for this reason alone the matter should be continued. He disagreed with the line of sight study also and stated that ten days ago that he and Chuck Strother looked south aver the perimeter wall and Mr. Strnther had agreed that winc�aws w�uld be eye level fr�an 50 feet away. He felt that south and west views wr�uld be lost. �He read a letter fran N�. Dick Mendenhall to the Lakes board of directors outlining past problems e,xperienced with rental units. He had the hr,�ieawners present at the meeting stand in support of his cannents. MR. WILLIAM REm, director of security at the Lakes CountYy Club, requested continuance until further study could be made of the security. � 3 MIlV�TI'FS PALM DF�ERT PI,I�NNING O�MISSI�I JAN[JARY 19, 1988 . r � Catmissianer Richards asked for suggestions by Mr. Reed as to what kind of security measur�es he felt wauld be appropriate. N�. Reed suggested scme type of perimeter fenc�ng arid olear�der growth as a barrier, but felt that he hadn't had adequate t�me for an in-depth study. He felt the sheriff's departrnent sl�o�ild have oarmerits. Catnu.ssioner Richards stated that all projects are sent to the sheriff's depart�nt for oam�e.nts. Ms. Sass read the oam�ents by the sheriff's departrnent, which pertained to security within the proj ect. Commissioner Richards noted that Lieutenant Bowser was in the audience and asked him to address the carmission with �nts. Lt. Bawser stated that the Lakes is having problesns with security and wall jt.unpers and did ryot recommend electronic security devices (which tend to be expetlsive and is set off easily by birds and animals) or barbed wire (for aesthetic reasons), but noted that pyracantha pravides an excellent hedge and having neighbors pravides extra security. Ca�missioner Richards thanked Lt. Bawser £or his camients. Chairman Er�n�od called a ten minute recess at this point. The time was 8:21 p.m. The meeting was reconvened and Chai�z E��n�od asked if the applicant � wished address the cannission. MR. STROTHER agreed with the planting of pyracantha and suggested sat►e type of lightirig which could be worked out. He noted that security for Ironu�od, Nbrningside and El Dorado Country Clubs all pravide security fran within the project. He ;n�;cated that he would continue to w�ork with this issue. Mr. Strother stated that in regard to the views and privacy issue, he had photographs which stxxaed that rx�t one wir�daw in the Lakes faced their property. He indicated that the Lakes residents had to stand in their garages to face the proposed project winc3aws and showed -photographs of the surrounding property lines on Cook and Rtu�irx� Springs with the height of trees. Nfft. JOE KICAK, 41-555 Cook Street Suite 220, reviewed the line of sight study for the proposed project. C7iairman EY��od asked for clarification on the line of sight for the present zonirx�. Mr. Strother also high-lighted points on the line of sight. Mr. Strother indicated. that he w�uld provide obscured glass in windaws facing the Lakes. MORRIS, 75-220 Valencia in Palm Desert, stated that Vista del Nbntanas board of directors had expressed concern regarduzg line of sight and it was his understanding that this project was not a real problem. He felt that it was a good project and should be approved. Mrs. Mall addressed the cannission and clarified her earlier crnments. MS. DORA INGLESON, 41045 Largo, stated that she bought her property eight years ago and indicated that the members of Vista del Nbntanas were never poled and expressed opposition to the project. Chairman Er��od closed the public testimony and asked for c�me.nts. Catmissioner Da�n�s felt that it was one of the best prepared projects and 95g of the probl�ns had bee.n worked out before canirig before the ccRmission. He noted that very few projects have cartpleted EIR's and iridicated that he could rx�t vote against this ane. Ca�missioner Richards felt that the security issue was a valid one, but one that could be addressed and felt that the applicant had done evezything he could to mitigate any problems. He spoke in favor of the project. �... Chairman Erwood spoke in opposition and felt that the EIR was biased, citing page IV 2Q where it states that it is apparent that the density range for law density residential is rbt sufficient to� pezmi.t the project to proceed, and therefore a change to high density is required. Also on the last page of section VI 13 alternatives, the present zoning is stated to be the superior plan and whe.n hr..x��ecx�mers bought property in the city they had a right to rely an existi.ng zonirx� unless extenuatirig circiunstanr,es could be proven to e.xist. Surrounding roads in sectian IV page 43 are not designed for this project and block views as stated in section IV page 109. Commissioner Ladlaw agreed with Cnairman Erwood and Carmissioner Richards that it was a good presentation, but was opposed to the proj ect because of concerns with views and indicated that she w�uld be in fawr of a continuance to allaa hrnieowners fx�cm the Lakes and the applicant to wc�rk out problems. Ccnmissioner Whitlock stated that at the beginnuig of the meeting she was of the opinion that the density was too high, Yx7wever, after listening to Mr. Strother and seeing the ptx�tographs and line of sight views, rio windaas, and two story units being at least 250 feet �.. 5 MIiV�TI'FS PALM DFSERT PLANNING OONA'LISSIO�T JANUARY 19, 1988 � away fran the closest Lakes resident changed her opinion. She felt the office professional zoning was appropriate because the nature of Cook Street, and therefore was in favor of the project for this site. Camtission reviewed the conditions to be amended and added a condition that on the second story, only opaque windaws would face the Lakes Country Club. Commission also addressed the issue of phasirig and Mr. Strother ;nr�i cated that if possible, the residential and oatmercial w�uld be con.stxucted simultaneously and can be addressed at the council level. Coa�tinu�ed Discvssiori oai th�e North S�Y�ere Specific Plan and Draft EYivir�[�ntal Inq�act FLeport - CITY OF PA�i DFSFRT, Applicant Request for consideration of the North Sphere Specific Plan and Draft Environmental Impact Report for the area generally located south of Interstate 10, west of Washington Street, r�rth of 42nd and the Whitewater C�aruzel, and east of Nbnterey Avenue. Mr. Diaz pravided an update of the ca�mittees recamiendations and reaannerided a continuance to February 16, 1988 to allaw staff to address the changes and discuss with WRT the alterations. Catmissioner Ladlaw asked for and received clarification on the Havley Lane and E1 Doracb re-connection and Mr. Diaz also outlined provisions of the open space requirements. C7iainnari Er��od felt that more ballfields were needed, rr�t just open space. Mr. Diaz explained that a recommendation was going to the city council for a suboamiittee to be established to study recreational needs. Chairman Erwood o�eried the public test�mony and asked if anyone present wished to speak in FAVOR or OPPOSITI0�1. �r.r MR. F.X. MAC�ONALD, 1900 E. Ocean Boulevard, expressed a need for east/west roads to allaw travel between the cities. He felt that the city needs to look to the future needs of the valley and also felt that Hc�vley Lan�e was needed. Caimissioner Richards stated that he has r�t seen a problem with people tryi.ng to find east/west roads and did r�t feel that Havley Lane was equipped to handle any traffic other t.han residential. N�. MacDonald felt that the averall plan sY�ild be looked at and circulation problems in the year 2000 considered.
