Mr. Smith outlined the salient points of the staff report and info�med. c�►mission that a letter had beP.n received fran Supervisor Larson indicatirig that the city should process this request and a letter had be�.n distributed to cannission fran Mr. Thanas Schmidt outlining his concerns. Mr. Smith also reviewed previous conversations with a Mr. Carl Anderson, who was opposed to a chain-link fence, which w�uld be for the architectural ca�mission to review. Mr. Smith addressed tee area height concerns adjacent to Good Samaritan and Vista del Montanas and rx�ted that �ity development aond.ition #6 addresses this issue. He r�oted that after the landscape plan is completed trees and landscaping will pravide a screen. Mr. Drell outlined the salient points of the staff report and i�;cated that the plan before commission had been revised per � recommendations by the core commercial axrmittee, architectural catmission, and project area carmittee. He felt the applicant should re-think tt�e project. CamLissioner Richards questioned N�. Fox's ability to make aesthetic jud�neazts regarding the project' s ability to attract high-end development versus the developer's experience. NK�. Fox ar��wered that he felt he had the right to speak aga.irLst a project that might be detr�mental to property values, health, welfare and what might be the highest and best use of the property. NIl�. DAVE FLEPQ��Ft, 73-061 El Paseo, stated that he was opposed to the develapnent based an aesthetic values and suggested that scme individuality to the store fronts would be a nice addition. Nll2. MARVIN FRE:E1�lAr1, developer, indicated that the design idea was based on market needs and felt the concept allows pedestrians to see winc3aw displays shawing type of inerchandise sold. N�'. FY�nian indicated that he had r�ot previously spoken ,�, to Mr. Fox, but had spoken to the developer across the street, who expressed approval of the project. Catmissioner Richards concurred with the recommendation by the plaru�ing aannission secretaYy to continue the hearing to allaw Palm Desert Property Owners Associatian to review the revised plan. Based on arnnents by the plaru�zg departrnent and N�. Fox and review needed by PaLn Desert Property Owners Association, Commissioner Whitlack agreed that a aontinuance was appropriate and wr�uld possibly allaw ooncern.s to be mitigated before the matter returns to the cannissian. Conmissioner Rich�s rx�ted that the matter was being held up for aesthetic values and felt the matter should be expedited as quickly as possible. CamLissioner IXxails felt the matter shauld be approved and made a motion to close the public hearing and let staff handle the unresolved issues. The motion died due to a lack of a second. � 5 ... Qonta�yed Discu�ssian on the No�rth Sphere Specific Plan and Draft tal L[gact Repo�'t - QTY OF PAIM DFSII�P, Applicant • Request for oo��sideration of the North Sphere Specific Plan and Draft Environmerital Impact Report for the area generally located south of Interstate 10, west of Wash.ingtan Street, rorth of 42s1d ar�d the Whitewater C�iannel, and east of Nbnterey Avenue. Mr. Diaz s�um�arized the findings of the ocamission and indicated that rather than shifting or lawering density, the oamuttee retained the werall present zanirx�, which would allaw latitude to develop single family, hotels, and cot.urtxy clubs per develo�t agreernents. The next area the ca�ntittee studied was the greenbelt and Mr. Diaz explained that the cantrol district had changed its policy and would r�ot allaw indi.viduals to retain three days on site of a 100-year ,,,� storm. He indicated that cannercial/industrial zoning would be in the r�oise impacted areas and open for possible residential housing with appropriate mitigation measures. He stated that north of Gerald Ford an application has beeri filed for annexation, and a portion of land for a park wr�uld be designated and the city allawed to purchase it aver a ten-year period frcm in-lieu fees frcm developments and acquire the park land or relocate the park closer to the rx�ise impact area. He noted that while the wind-belt concept was good, under present ordis�ice the city already requires developers to pr�avide sane protection and that establishing a straight line was virtually impossible because of varied prnperty lines. Mr. Diaz stated that an area of 50 feet fran the curb has been set by staff, so the city will receive 35 to 40 feet of open space landscaped and would not count toward in-lieu fees, with the developer installing and maintai.ning it for two years and bonding for one year after project completion. He indicated that for long-term planning the city would be looking at the area-wide land.scaping and maintenanre and total acreage of greenbelt would be 79 acres plus an additional 25 to 30 acres added as development occurs north of Mo�zterey and along Dinah Shore. 7 .... Diaz stated that for traffic circulation Nbnterey wrn.ild be six lanes, Country Club s�x lanes, and C'.00k Street rgnauzing at four lanes. He stated that for long-tenm developnent of Cook Street vers�as Nbnterey Avenue, seriaus thought was needed on which to develop first. Staff recommended Monterey Avenue because Cook Street will be.nefit from cauity to the north and southeast and development of Nbnterey into six lanes w�uld benefit Palm Desert and the regioa�al as a whole. He stated that Havley would extend from Portola to Cook and will be provided with a traffic signal at the Havley/(bok intersectian, with the project � the r�ortheast corner providirig the fu�al funding sourc,e. Nh�. Diaz rx�ted that with the excha�x�e of property for rezoning to allaw 660 units, the city w�uld receive 30 acres in open space, and the active and passive uses of the park could be separated. He rr�ted that the city is attempting to secure a aonference center in Section 4; country clubs total 2640.04 acres and they provide a good deal of recreational uses such as tennis courts and swirmting pools; the total park land needed to service this area is lawered and north sphere need.s sh�ould r�ot negatively impact facilities to the south. He indicated that with total build out, permanent population within the mrth sphere area was estimated at 16,000 to 20,000 people or 4.9 persons per acre, canpared to 200 acres per person in other � areas. He stated that staff is i.n the process of annexing areas to the east. Mr. Diaz stated that oa�ussion should instruct staff to prepare a resolution and rwted that the revised EIR has an overall less intensive use than the old plan. CamLissioner Richard..s stxessed that in the r�oise impact areas the use shauld basically be for service industrial and carmercial uses and did rx�t feel multi-family residential was appropriate, even with mitigation measures. He agreed that active recreational uses in this area would be suitable. He indicated tha� at the intersections at Monterey and Cook some latitude would be given for highway/aannercial develo�ients. He noted that staff believes the developme�zt of Cook sh�xld be a lawer priority, but wr�uld eventually be developed into six lanes and Cook Street at the Whitewater C�zannel would have sane type of all-weather structure, possibly similar to Portola or Bob Hope Drive. Caimissioner Richards liked the passive/active park concept. He felt that staff was right on target for the next 10 to 20 years of park needs. 8 �,�, NIII�TI�S PALM DFSII�T F'I,AI�II�III� �NMISSI�I � 1, 1988 '"' Commissioner powns indicated agreement with the commercial, sexvice/industrial zones and open space and parks and concurred with the rest of the plan. He felt that an avernight recreational vehicle park as well as parks should be considered in the noise impact area. He did not feel anyone shQuld have to live in that area and noted that tt�e recreatioa�al vehicle park wcwld be for temporary use only. Chairman Erwood concurred with Commissioner Richard's catments regarding cc�nnercial zailing along the railroad txacks and felt that residential would be inappropriate. He indicated that he oould accept more of N�. Diaz's aoncept of oountxy club providing open space, but not for people who don't live in them. He dic�'t want the city to lose sight of the fact that sane people clo rx�t live in oountry clubs and ryoted that they dr�n't include ballfields and parks. Cannissioner Richard.s stated that he dic�'t feel that this subject came up in the meetings in a manner that was fully explained. He had been aroui�d people in the city who feel the city has not done er�zgh and noted that it is expei�sive to the city and indicated that he has beP.n protective of the city in the past. He felt that this sYxxild be one goal of the plan to allocate or camLit to the amount of ballfields (whether 5 or 10 or 2). �... N�. Diaz informed cannissian that four ballfields are planned for in the civic center master plan and indicated that a carrnittee is being formed composed of parks and recreatian ccRmission and different groups praviding all recreational need.s to cane up with a statement of 1) total needs, 2) cost, and 3) priorities and possible sites. He stated that sane groups to be represented an the cannittee are PDYSO, Family Y, Coachella Valley Parks and Recreation District, Senior Citizens, and Sand Sharks. Catmissioner Richards rx�ted that one problem before the aarmission has been a lack of space for parking recreational vehicles for owners of property in Palm Desert. He asked if the city has discussed setting aside areas for public or private use. Catmissioner Dawns rx�ted that there will be a meeting to discuss RV parking and possibly re-draft the ordinance, but nothing concrete. Catmissioner Richards asked that Catmissioner po�vr�s get a consensus of the c�armittee and fjnd out if people wc�uld utilize a municipal facility to park RV's, suggestirig the use of odd-shaped parcels around the city which are hard to develop (i.e. Haystack at Portola). Camtissioner Dc�ms stated that this issue was brought up and 80$ said no, they would not use the facility and the code compliance 9 ... BILL KELLY, local bay scout master, stated that they did rx�t have anythi.rlg in this oanrnanity relatirig to scouts and they have been here for 35 years. He irxiicated that he has beer� workirx3 with Mr. Altlnan and Mr. Hunt of YMCA for the last three years to establish sanethizig. He did rr�t feel that country clubs we.re praviding recreational uses for the carmunity and noted that it usually isn't fami.lies that mave into country clubs. � Mr. Diaz requested that Mr. Kelly call him to get put on the oannittee studying the park and recreational needs. C7�airman �,Y��od closed the public testimony. � Commissioner Richards reviewed the comments made regarding recreatioa�al facilities and noise impact areas with residential being lawest priority in that noise area. Cr.�missianer Whitlock r�oted that in c�amuttee discussions on the north sphere it was suggested that law-oo6t h�ou.sirig might be used for that area and did not like to see that option eliminated. Ca►missio�ers Richards and Dawns did rnt agr�e with that option. Chairman Erwood stated that on the resolution that a statement/paragraph should be included on the intent of the commission and indicate the direction the commission wanted develop�c�nt to go for future clarification. He did r�ot want the intent to be lost or misinterpreted in the future. N�. Diaz stated that it oo�.ild be put in the resolutian. CamLissioner Richards felt that this was a goad point.
