Request for approval of a one-year time extension for a previously appraved proj ect consisting of 11 four-plex apartment buildings on Magnesia Falls Drive, approximately 700 feet east of Portola. Mr. Diaz explained that staff was recrxrniending that PP 86-45 be denied the tiune extension. Action: Moved by Commissioner powns, seconded by Cc�r�n.issioner Whitlock, approving Item B of the consent calendar by minute motion. Carried 3-0. VII. PUBLIC HEARINGS A. Co�tinued Case No. PP 88-2 - NII�RVIN-DAVID INVESZMIIV�I'S, Applicant � Request for. appraval of a negative declaration of environmental impact and precise plan for a 21,200 square foot retail cor�anercial building to be constructed on the north side of E1 Paseo between Sage Lane and Highway 74. Mr. Diaz explained that PP 88-2 was continued to allow the applicant to receive appraval from the Palm Desert Property Owners Association, which it did and also received approval from the Palm Desert Architectural Commission. He reca�nended approval and adoption of the resolution. Vice Chairman Richards opened the public testimony and asked if the applicant wished to address the co�Lission. MR. CLII�ITE TRAt�1COS0, 1900 E. T�iitz McCallum Suite B4 in Palm Springs, stated that he concurred with the staff report. He explained that in order to allow individuality of the stores, the individual store owners would be allawed to design their own store fronts. Vice Chairnian Richards asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposed. MR. MARVIN FREFI��1N infornied carmission that there had been some concern expressed that the individual stores would look like one continuous building. He explained that they are talking to a jewelry store who will create their awn look, so it won't look like one continuous store. MR. JRC�C CLATON, 78-180 El Cortez in Indian Wells, felt that this building would an.swer the need for retail stores and would allaw good windaw displays. He felt the project would do well. MS. DARLENE LITTLE, 73-080 El Paseo, stated that the architectural design is compatible with the design of her building. She requested clarification on square footage and ;n�;cated that her only concern was parking. Mr. Diaz reminded comnission of the orclinance adopted that limits the first floor to retail carmercial. He noted that if a restaurant �„�„ were to be requested, it w�uld have to come back to conmiission. He felt that with retail caimercial use emplayee parking needs would be less. MS. LITTLE stated that the proposal next door would be of value to her property and she was in favor of appraval. MR. LARRY GRO'I'BEQC, El Paseo Business Association Co-Chairman, expressed concern that individual store fronts are optional and was also concerned that the design standards were not what El Paseo wants to see in the future. He suggested that caia�Lission continue this case and send it back to the architectural comnission for further review and study. Vice Chairman Richards stated felt that these standards should not be placed solely on the few vacant parcels left, but should apply to all property oumers on El Paseo. Vice Chairman Richards requested specific architectural changes from Mr. Grotbeck. Mr. Grotbeck replied that- he wr�uld like variated store fronts, more depth and texture, roof line variation, and a more creative use of material. Mr. Marvin Freeman informed the conanission that the original building design had variation and the homeoumers association turned them dawn. 3 � MIN[TrES PALM DFS� ����G ��ION MARC�i 15, 1988 Upon discussion of the validity of Mr. Grotbeck's group versus the � Palm Desert Property Owners Association, Mr. Grotbeck indicated that they would be trying to separate or succeed E1 Paseo from the Palm Desert PropertY OHmers Association. Vice Chaizman Richards felt that issue should be resolved and stat� �etd p�o fd��stforethe stat�ient frcm Mr. Grotbeck�s 9ro p licable when rest of the street that wr�uld be retroactive and app prnperty changes hands or when a request is made. Mr. Grotbeck stated that they wr�uld be requesti.ng that PDPOA succeed El Paseo from their purview and should they not canply with the request, a vote will be taken. MR. JIM FOX addressed the cai�nission and indicated that the applicant had scheduled a meeting with him, but later cancelled. He stated that he was rx�t requesting changes in the floor plans or site plan, but w�ould be satisfied with much less. He felt that the green awnings should not be allawed to extend across the building and cannission should not allaw a sign prograa► on the awning. He also felt that individual store fronts were needed. He stated that the public does not find out about projects until they are advertised for plarin.ing co�rmission, so this would be the appropriate time for input fran the public. Mr, FYeeman stated that he would be willing to meeting with Mr. Fox � and Mr. Grotbeck, but did not feel it was fair that they have to go back for further review by the homeowners association and architectural coinnission. Mr. Diaz rioted that if the project were to be approved a 15 day appeal period would be in effect if concerns could not be resolved, and informed coRenission that if the meeting were to take place within the next few days the item could be placed on the architectural cannission's ne�t agenda. Co�lission concurred with staff and felt that a condition should be added that the applicant and representatives from the El Paseo Merchants Association, as well as Mr. Fox, meeting within the next 15 days and if alterations are made it will be ingnediately referred to the architectural cc�mnission, and the architectural designs shall ►�e part and parcel of the approval. C��,sent Calendar Co�tinued Case No. PP 86-45 - THOI�.S MILLER, Applicant Request for a one-year time extension for a project located at the northeast corner of Highway 111 and Deep Canyon Road. Mr. Diaz explained why the time extension request had been continued and indicated that staff wanted to add a condition to allaw the aligrunent of Deep Canyr�n and the hotel not be allawed to cam�ence until the a restaurant foundation had been poured. Staff recor�nended denial of the t�me extension if the conditions were r�t added. Mr. Sandy Baum, representative, felt that the close proximity of the Velvet Turtle, Cleve's, and Johns would prohibit adding a condition regarding the restaurant and did r�ot see a problem with the alignment of Deep Canyon. � Ms. Kandy Allen of the city attorney's office advised the carmiission that if escrow did not go through, the city would have nothing. After further discussion cannission felt that the project should placed back on the consent calendar and approved without adding any conditions. Staff explained that the appraval would only require a minute motion action. Action• Moved by Vice Chairman Richards, seconded by Co�nissioner Dawns, granting the one-year time extension. Staff requested that the matter be continued to the next meeting. Conmission concurred, Action• Moved by Commissioner powns, seconded by Co�Lissioner Whitlock, continuing this matter to April 5, 1988. Carried 3-0. IX. Commissioner Whitlock indicated that the landscaping at Travelers Inn should be reviewed for adequacy. � XI.
