Mr. Drell outlined the salient points of the staff report and "'r

Chairman Er�x�od Opened the public testimony and asked the applicant
to address the ccnmission.
MR. VICTOR VILLENEUVE, of the Flying Buttress, informed
commission that the land was originally three different
properties and the developer naw wishes to develop part of the
prope.rty; and rx�ted that all improvements exist.
Camlissianer Ladlaw asked if all requirements for size were met and

Request for appraval of a negative declaration of
enviro�rmmental itrq�act and a precise plan for a
15,450 square foot retail canmercial building
located on the southwest corner of E1 Paseo and
Sage Lane.
Mr. Drell outlined the salient points of the staff report and
i rx�i cated that the proposal had bee,n before the city's architectural
c�missian, the PaLn Desert Property Owners Associatian, and to the
El Paseo Business As.�ociatian. He rx�ted that the project physically
meets all standards. He stated that a letter had been received fran
the E1 Paseo Business Association with aonditions and indicated they
oould be canplied with, but questioned if the horizontally-angled
windaws w�uld require structural modification. He recommended
approval of the project.
Commissioner Whitlock asked if this eliminated the general
� aontz�aversy as mentioned in the staff report and Mr. Drell stated
that he believed that was the case.
Chairman Erwood opened the public testimony and asked if the
applicant wished to address the aannission.
, t�t. C��ARLES MARTIN, 72-757 FYed Waring Drive, explained to the
ca�m.issian tY� different steps taken for the developer to reach
the public hearing level and also gave a description of the
pro�ect.
Ucm[nissioner Whitlock if Mr. Martin oould foresaw any problem with
the par}tirx� being totally open and creating a thoroughfare. N�.
Martin replied that N�. Fox, Mr. C�azan and I�. FY�eeman had all
agreed to the parkirig access and did not foresee a problem.
C�airman �tiaood asked if anyone present wished to speak in FAVC�t of
the project.
MR. L�ARRY GROTBECR, Co-C�air of El Paseo Business AssoCiation,
felt that the letter indicated their position. He felt this

building would bring strength to the street with the
n�difications.
Commissioner Ladlaw asked Mr. Grotbeck where he would place the .
business names/identificatian signs. Mr. GY�otber.k stated that he
h�ed it would be ovex the first flat surface. He felt the developer
wrn.ild work �with the individual tenants and the association would keep
an eye on it. Camiissioaner Ladlc7w asked if the El Paseo Business
Association has a certain code for wirx9aws and signs. N�. GY�otbeck
replied that he had spoken to Bn.ice Altman and Jean Bec�san on
developing a manual with starulards for E1 Paseo.
Chairman Erwood asked if anyone present wished to speak in

Catmissioner Whitlock stated that based on the information received,
she was in fawr of a motion for appraval. Cannissian concurred.

N�. Drell explained the applicant's r�equest, which was to build more
two story town ho�uses. Commissioner Whitlock asked about the
setbacks and Mr. Drell replied that it would be abaut double
(approxunately 40 feet) and noted that the building sides would face
the s�t. He asked if the c�mission felt this was sanething that
. wo�.ild warrant a public hearing.

Catmissio�er Ladlaw asked if this was just the begiruzing or only one,
aryd expressed �,ern that this might be starting a precedent. N�.
Drell explained that it was nat unusual for a developer to request a
,,,�, modification after ooa�stxuctian had begun.
C�zai�i Ert�od stated that three to five may rx�t be that unusual,
but expressed �zcern abaut prod�zcing a piece-meal project and did
r�ot want to give the impression that arYytime a developer ccmes in
with a r.t�e it would be a director's modification. He also
mentianed that approval had been given at the last meeti.ng for a
similar change that was appraved because the parties effected were in
favor of the charx�e. He ind.icated that if the develaper were to oane
back with yet another change, he would be leery of approving it.
N�. Drell irxiicated that if this is a new averall philosophy for the
project then the developer could make changes throughout the project
and c�me back to the cannissian.
Nfft. MAFtIC TII�IPLE addressed the oannission and stated that they
were makirig changes as they go as the market dictates. He
suggested that if aamLission wished to they could conditian
appraval upon c�oncurrPazce by the adj acent land cx�mers.
Commissioner Whitlock noted that the change in this phase would
reduce the density fran 6.5 to 6 and asked if N�. Temple we�uld try to

make up the den.sity elsewhere. Nfr. T�le stated that he was trying
to follaw the market dictates.
Commissioner Ladlow com�d N�. T�nple an be3ng flexible, but
expressed oaricern an settir�g a preaedent and felt that while one
request might be fine if more chaixx��es are needed it might change the
character of the develog��nt that was decided at a public hearing.
, Mr. Temple indi.cated that each phase would cane to the planning
cannission and he looked on tt�i.s charx�e as a clarification of the
site plan.
Camtissianer Whitlock stated that since Mr. Te�le made the offer to
obtain acceptance of neighbors, she wr,uld like to see that in a
motiori. C�atrman F��u�od stated that it oould be part of the motion
that written proof that neighbors have no objection be provided
before the director's modification is appraved.

upon furnishing proof of r�o objection by the adjacent neighbors, the
director of community development is e�i�c7wered to apprave this

Mr. Drell explained that coiuicil was requesting several dates that
the aatmission w�.ild be available for a bus tour of city developments
to last half a day.
Carmissioner Whitlock stated that Nbndays and FY�idays were rx�t good

Nfr. Drell indicated that the matter was continued to allaw the city
atton�ey to address oomnission conaerns for city protection. N�.
Drell axplained that this was the fourt�h draft of this d�velogne�it
agreecnent and had been canpleted by the real estate expert at Best,
Best and Krieger. He explained the pu�pose of the develapnent
agreeme,nt and indicated that if the applicant were to default, the
city would take avpx. He also irxiicated that Charter Canrnuiities had
expressed s�ie interest in constructing the project but had failed to
sutrnit any kiu�d of bid.
Ms. Kandy Allen informed commission that this draft had been
oanpleted to address c�ouncil ooncen�s and comnents.
Chairman Erwood opened the public testimony and asked if the
applicant wished to address the cannission.
Ngt. WII�IDELL RYLEE felt that N�. Drell had cavered. the salient
points and iYxiicated that their rents wo�uld be significantly
lawer than C�iarter's proposal. He rx�ted that all applications
for the buildirx3 would be sutxnitted for revi�w like all other
pro�ects.
,r, Catmissio�er Ladlaw requested clarification on mortgage on the land
aryd a time schedule. N�. Drell indicated that there would be rx�
m�rtgage oal the land and Mr. Rylee stated that they would have nine
months for plan appraval and constructio� loan and 18 months to the
finished pro�ect.
Chai�l ���od asked if any of the camtissioners had any catnments.
Catmissioner Whitlock stated that she did not have a problem
rearnnending appraval to the city council.

CamLissioner Ladlaw asked if this was cxnn�n to other cities. Mr.
Drell indicated that it was fairly unusual in that the money beixig
