Acti�: Moved by Commissioner powns, seconded by Catnu.ssioner Whitlock, appraving the May 3, 1988 meeting minutes as submitted. Carried 4-0. V. S� OF Q7[IIaQL ACPICN Mr. Diaz s�.unnarized pertinent May 12, 1988 city council actions. Mr. Diaz explained that the Villages of Bella Vista matter would be caning to the planni.rx� catmission because a determination was made .that the reduction of unit number constituted a major change. Discussion ensued and Camussioner Richards stated that because of changes in circtm�,stance such as the hillside ordir�ance, the project should be reprocessed through the city. Catmissioner Ladlaw rioted that at least two mc�nbers of the catmission were not in attendance at the original heari.ngs and Mr. Diaz stated that the matter will be r�viewed as a new project and rx�ted that the city council is in the same position. N�. Diaz rx�ted that this matter had been continued fran the last meeting and felt the items had bee.n addressed. He indicated that on the joint city council, plaru�ig crnmission, architectural aannission tour the architectural conm.ission expressed a need for this ordinance �' amenc�nent. Mr. Diaz explained that enforceability of the ordinance w�uld be an admi.nistrative matter. He stated that the E1 Paseo Business Association, Chamber of Catrnerce, and Business Lice,��.se process wr�uld all be used to r�otify and regulate repainting in the camiercial areas, and press releases and the city newsletter would be used to nr�tify the hillside planned residential areas. N�. Diaz indicated that the reason for ooncern was that there have been buil�s repainted that were r�ot ocmpatible with the surrouncling areas. Commissioner Richards expressed concern regarding the Olinger residence on the hillside meeting all city requirements. He requested that staff look into the matter and cane back to the ca�nission with the results. Chairman Erwood opened the public testimony and asked if anyone present wished to speak in FAV�t or �'P06I'IZQd to the proposed. There being no one, the public testimony was closed. Diaz noted that the regulations were needed for outside hr,�c��eawner associati� areas, in additioaz to the associatio�s having problems entorcing their OC&R's. He noted that the repainting � E1 Paseo was of primary oaticern to the city c7rnu�cil. Mr. Diaz indicated that a pennit systecn oould be established similar to other items in the c�oc�e. Carmissicazer Richard,s agr�eed with Co�tissianer Dc�acls and suggested that the E1 Paseo area create a set of IX',&R's or an agreeir�lt. He felt the cannissioal was r�ot subjectively qualified to make these decisions. He also rx�ted that certain buildir�g treatrnents were part of the hillside ardinance. Nfr. Diaz indicated that on the joint meeting tour the architectural aannissioai requested sane guidance on color approval for the hillside areas, sinc.e the color of the hillside resi�e was tY�e aolor appraved. C�airntian F�ti�od r�oted that in the hillside ordinance the st�ctures were required to blend in with the natural terrain. He stated that the groblem occurs when the house is sold and the new awner is not baund by the original color and this amendment would allow the ,�, architectural cannission a chance to revie�w. He in�ciicated that he was more �erned with hillsides than �rcial areas. Catrnissioner Richar�ls rx�ted that every st.ruct�ar�e being built in the hillside area is sup�posed. to cxR�e to the plaruzi.rxJ aatmission. He stated that cannissio� has very diversified opinions. He felt that if a color scheme is established, when someone comes in with a differ�ellt color and are refused, hard feelings will be created. He ;*�;cated that while the city is discussing the color of hoia.ses, it has not seen fit to solve the illegal road situati�. Camtissioner Richards suggested that since the matter was generated by the council, the matter could be referred to them for a decision. Cannissio�er Ri�s expressed a willingness to make a motion to pass this alc�ng without an opinion. Chairman �Y��od felt tha� twr� strorig opinioa�s had been expressed and felt there might be more i rv�i viduals who woixld reaannend nQt appr�aving this amerx�nent. Ms. Allen indicated that enforcement had n�ot yet been researc.t�ed.
