I. CALL TO ORDER
Vice Chairman Richards called the meeting to order at 7:01 p.m.
II. PLEDGE OF ALLEGIANCE
Commissioner Ladlow led in the pledge of allegiance.
III. ROLL CALL

IV. APPROVAL OF MINUPFS:
Request for approval of the August 16, 1988 meeting minutes.
Commissioner Ladlow noted a change in the vote on page two.
Action:
Moved by Commissioner Whitlock, seconded by Commission Ladlow,
approving the minutes as amended. Carried 3-0-1 (Cam-issioner Dawns
abstained).
V. SLNMARY OF COUNCIL ACTION
Mr. Diaz explained that no council meeting had taken place since the
last planning commission meeting.
VI. CONSENT CALENDAR
A. Case No. PP 86-37 - AFFILIATED CONSTRUCTION CO. INC., Applicant
Request for approval of a six-month time

B. Case No. PM 21915 - HOUSLEY ASSOCIATES, INC., Applicant
Request for approval of a one-year time extension
for a parcel map, located at 44-311 Monterey
Avenue.
C. Case No. PMW 88-11 - MARVIN-DAVID IlWESIMNM, Applicants
Request for approval of a parcel map waiver to
consolidate three lots for a project located on
El Paseo, between Highway 74 and Sage.
Action:
Moved by Commissioner Whitlock, seconded by Commissioner Downs,
approving the consent calendar by minute motion. Carried 4-0.
VII. PUBLIC BEARING'S
A. Case No. CUP 88-6 - IRD A. SONS, Applicant

Request for approval of a conditional use permit
to allow a chiropractic clinic to occupy 3,000
square feet within an office complex at 72-880
Fred Waring Drive.
Mr. Diaz explained that medical offices larger than 2,000 square feet
required a different ratio of parking. He noted that Dr. Scans'
office has been in operation. Staff reccmmended approval subject to
the condition on the resolution.
Commissioner Ladlow asked for and received clarification regarding
the parking and conditional use. Commissioner Ladlow expressed
concern regarding office buildings being turned into other uses such
as this medical facility. Mr. Diaz indicated that the conditional
use permit offers protection by insuring that uses like the medical
office will have the required parking.
Vice Chairman Richards opened the public testimony and asked if the
applicant wished to address the commission.
DR. SOAKS, 72-880 Fred Waring Drive Suite D, stated that he had
submitted all his cc mmments to Mr. Drell of the planning staff

and assured the commission there were no parking problems. He
informed camnission that average visits to his office were 15
minutes and indicated that additional parking was available in
the front of the building.
Vice Chairman Richards asked if anyone present wished to speak in
FAVOR or OPPOSITION to the conditional use permit. There being no
one, the public testimony was closed.
Action:
Moved by Commissioner Whitlock, seconded by Commissioner Downs,
adopting the findings as presented by staff. Carried 4-0.
Moved by Commissioner Whitlock, seconded by Commissioner Downs,
adopting Planning Commission Resolution No. 1307, approving a CUP 88-
6 subject to condition. Carried 4-0.
VIII. MISCELTANEOUS
A. Case No. PP 88-11 - OTRA III, LTD., Applicant
Request for adoption of a resolution denying a
Now precise plan of design for construction of a 17
unit apartment project at the northeast corner of
Abronia Trail and Sunset Lane.
Mr. Diaz reminded commission that at their last meeting staff was
directed to prepare a resolution of denial with the findings that the
street should not be vacated, the site plan does not contain adequate
recreational amenities, and a walkway should be constructed on
Abronia Trail. He noted that the street vacation issue was scheduled
for the September 8 city council meeting, but felt the matter would
be continued. He stated that the applicant had appealed this denial
and the matter would probably be heard simultaneously by the council
on September 22.
There being no further comments, Vice Chairman Richards asked for a
motion.
Action:
Moved by Commissioner Whitlock, seconded by Cammmissioner Downs,
adopting the findings as presented by staff. Carried 4-0.

Moved by Commissioner Whitlock, seconded by Commissioner Downs,
adopting Planning Commission Resolution No. 1308, denying approval of
PP 88-11. Carried 4-0.
IX. ORAL oamJNICATIONS
None.
X. COMMENTS
A. Vice Chairman Richards commented on the letter from Ms. Margery
Hartnett concerning pad elevations for property discussed at the
August 16 meeting and Mr. Folkers' response and stated that
after looking at the property in question again, he also felt
the pad elevations were too high.
Mr. Gaugush of the public works department informed the
commission that the northerly and southerly pads were most in
question and field checks prove that the elevations are higher
than approved and work would be done to lower them. He stated
that pads 2 and 3 in the middle had already received
certification.
After discussion and review of the grading plan information,
Vice Chairman Richards requested that original plans and
information be checked to determine if the correct figures had
been used and he indicated that a letter to the developer would
be appropriate to inform them of commission's concern.
Action:
Moved by Commissioner Whitlock, seconded by Commissioner Ladlow,
directing the public works staff to investigate more thoroughly
the elevations that were in place before the developer's
involvement in the property and serving notice on the developer
that concerns exist and further examination will be made.
Carried 3-0-1 (Commissioner Downs abstained).
B. Commissioner Whitlock requested information on the city's review
of conditional use permits.
Commission was informed by Mr. Diaz that if a regular review is
made a condition of approval, staff makes a note of it on a
calendar; otherwise, a conditional use is only reviewed if a

problem arises. If an unresolvable problem arises, the
conditional use permit can be revoked.
C. Mr. Diaz noted that there would be a presentation before the
economic development advisory cc nLLttee on September 15 at 2:00
and encouraged the commission to attend.
Commissioner Whitlock stated that as the planning commission's
representative, she felt it would be a great benefit for all
commissioner's to attend and offer comments and suggestions.
XI. ADJOURNMENT
Moved by Commissioner Ladlow, seconded by Commissioner Whitlock,
adjourning the meeting. Carried 4-0. The meeting was adjourned at
7:42 p.m.
