He felt that the Silver Sancls Boar�d of Directors had ryo right to represent the haneo�mers since no vote was taken uryder their OC&R's. He stated that he was totally opposed. He also felt that corner lots should not be discriminated against because of tw� frontages; he felt that all lots should have the same requir�nents and felt the zone r.tzarx�e we�uld r.har�ge the quality of life in the area. Diaz stated that if the cannissio� wished to limit floor area ratio, that it we�uld be° a mitigation measure to the e.nvirarniental docim�e.nt, but urged th,at the cannission not limit two stories. Cannissioner Richards requested cannents frcm the other aaimissianers on the per�centage of a7verage, uniformity between paYr,�ls, two story ; elemerits (i.e. limit or leave as is), and other issues discussed by staff. �.�i Camiissioner Da�ms stated that if these standards are adQpted, this would be the future develoFxnent starldards, and projects would be appraved by the oo�mission. Catmissioaner Richards stated that he wanted to ensure that in the future, the oarnussion's intent w�uld be clear. N�. Diaz stated th,at as part of the reoord, whe,n this pro�ect was built, the first thi.rig staff looks at are the adjacent parcels. All of the property awners are being nc�tified and would beccme part of the north sphere, and there wr�uldn't be a total change on the cannission because of the staggered tezms. Catr�dssioner Richards stated that it should be understood that these � standards would be for "professional office parks" and be made }arxx�m to the public. Ntr�. Diaz stated that as part of the north spd�ere plan those standards could be inaorporated and wr�uld be do�ie srnietime in the next three months. Commissioner Ric1�s stated that the 25' height, 25$ floor area j ratio, 35' setbacks, driveway accesses, lighting and inter- circulation parkirig should all be rx�ted by staf f as future standards. He indicated that he was still ur�acmfortable with a blanket allavance for two story for a whole project. He also felt that developers should be considering cavered parking, for employees as well as custaners. He also was ooa��cexned that landscapir�g be adequate to caver big buildirigs. Mr. Diaz felt that the shade approach to cavered parking was the best solution in tern�s of the envirar�ne_nt. �.. I�. Smith outlined the salient points of the staff report. He noted the "N" zoriirig (Natural Overlay) and indicated that staff was looking for scme indication as to haw many palm txees tt�e city would 13ke to save on the averall 10 acres, plus a minimum ni.unber saved per lot. He stated that conditions w�uld include res�xictions against the property to ensure that the txees would remain on tt�e site and in the � area. Staff indicated that the locatioaz of the trees wr�uld fall � under the jurisdiction of the architectural ornmissioaz, unless plannir�g catmission wished to be further irn�lved. N�. Diaz added a requir�ne,nt for a sceaiic easement alar�g Deep Car�ron of eight feet, giving the city 20 feet of area for the eight foot meandering sidewalk. He indicated that the homes were setback 20 feet frcm the property line so that the applicant oould recaver the eight feet by reducing each lot in width or nndifying the setback requir�ient. Ccmnissioner Dawn.s rx�ted that there was only so much roan on a lot and felt that 200 was a large number. Commissioner Whitlock suggested that scme trees be used to line the sidewalk. Canntssic�er Richards noted that there was a serious problem with having residential homes around date palm trees because of harmful herbicides, and indicated that the natural overlay zone was established 15 years ago. Commissioner RichaYY3s felt that the conmission shQuld obtain the city crnubcil's opinian. Carmissioner Richarrls indicated that this was a good area for single family hat�s, but w�uld like �.uzcil's opinion on the natural zonirx�. She stated that they . were in aatipliarice with the existing z�ing; the project wbuld � be only mar.•ginally feasible with the lot sizes proposed and requested that cannissio� take that into oa�siderati�n; she also felt that the lot sizes proposed were in compliance with surrnunding lana uses. She stated that the seaoild exception they had with the recamieridations was the rnunber of date palms � to be retained. She felt that they were messy, difficult and exper�,sive to maintain, pose a fire hazard and serious liability and virtually pravide n� shade. She agreed to sane type of preservation plan that would provide a mininn.an of two per lot. She indicated that she was available for questior�s. Chairman ��n�od asked if Ms. Gamlin meant a total of 74 with the two �. per lot suggested. N�s. Gamlin replied that they would aan.sider more because additional trees might be desirable to line the streets, which were be approximately 115 trees total. N�. Diaz inforn�d cr�mission that when retention of trees along Deep : Canyon is discussed, the problem arises as to whQ will maintain the , trees. Catnussioner powns also noted the potential danger to pedestrians. Camiissioner Richarrts indi.cated that these are all . questions that needed to be ans�,vered with directioci from council. She indicated that she has six date trees on a 12,Op0 square foot lot, three in the froa�t and three in the back. Or�e tree was built with the garage ir�dented arour�d the tx�ee, which had cracked the Y�use: ar�ott�er tree was planted with the pool it, and the oa�arYy that will be renx7ving that tre� told her that after it was remaved, the pool would probably be damaged. DAVID MI�,L, Box 833 in Indio, stated that he was the manager of this par�cel and part o�mer of the date trees to the east and north. He indicated that the place was started years ago in the desert and tY� city has expanded closer to them. He stated that the trees were older rx7w and many have fallen; he ;�;cated that pesticides are necessary against bugs, but felt the end of the date garden was caning close. MS. C��ARLE�IE McQ�EAN, 73-720 Irorn�od in Palm Desert, stated ' that she has lived in the desert aver 30 years. She iiuiicated � that these trees are aver 60 feet tall and 60 years old. She stated that the previous speaker's fathex planted the trees, so they were rx�t natural to the area, but brought in and planted. She felt that the date trees sYx�uld be presexved, but in an appropriate place. The applicant expressed a desire to line the lots to reduce the liability. She rx�ted th,at she too}c pictures of trees that were blaun aver as a result of the recent strong winds and questioned whQ w�uld be responsible if trees were to fall ciaari on the proposed hanes. Chainnan E���od asked if anyone present wished to speak in OPPOSITI�J to this praposal. MS. IRENE BRAWLEY, ?4-479 ButtArrwood, stated th3t her' m3in concern was the driveway location and incr�eased traffic. She also expressed oppositian to the date graves and the pesticide spraying.
