Nh�. Drell explained that the proposal is for the vacant parking lot �.r area and existing Desert Magazine building on the easter end of El Paseo. Basically what is proposed is that the Desert Magazine building will be remodeled to extend necessazy to make it acceptable as retail building and will preserve its existing facade. The building will rap around corner partially one-story (46,000 sq. ft. ) and partially two-story (14,000 sq. ft. ) setback away fran . the corner. The super block plan will be imple�nented through the vacation of the frontage �oad, which will eliminate intersection of frontage road at E1 Paseo/Hwy 111 intersection and bring circulation back to the south where it intersects E1 Paseo, significantly away frcm the intersection; and a mid block right turn in/out access to Hwy 111 will be created. Also, acca�lished will be the ultimate widenux3 in this area of Hwy 111 to its full design width. Buildirx� height at street level will be 20' and setback a 30' elevation setback fran Hwy 111 pYr�perty line will be 30' and setback from E1 Paseo will be� 5' - from curb 15' and setback diagonally from corner to the building will be 50' . F�txance only at frontage break at Panorama. This project meets 100 percent of ordinance requirement for restaurant parking. This pro,ject has benefitted fran the frontage road with a wide landscaped area and a large bricked sidewalk. Also, not discussed prior to this time is bus turn outs. He indicated that there was a far side bus t�.irn aut, and either the bus turn out and/or bus shelter situation shrnild be included. Mr. Drell noted that there is an deceleration larle that will have to be designed. This will be an aesthetic oondition and the applicant will have to wr�rk with city engineer and sunline �o design and locate a bus shelter. Mr. Diaz asked if it was the intention that the applicant shall also design and aonstruct the bus shelter. N�. Folkers stated that these issues are included in the program, but it could be. Mr. Diaz stated that the applicant stx�uld be required to constxuct the bus shelter and design, subject to city appraval. Mr. Drell mted that these it�c�s cauld be added to the public w�orks conditions of appraval for the project. C/Z 89-3, PP 89-2, VAR 89-1 - O. I�IIC�� FCNi�, Applicant Request for appraval of a negative declaration of envirorm�ental impact, a chaix�e of zone frcm R-2 (7) (single family residential) to O.P. (office professivnal) and a precise plan and setback variance for 2650 square foot single story office ■,.,� building on a 72800 square foot lot on the east side of Nbnterey Avenue, 800 feet south of Fred Warirx� Drive. Mr. Drell gave the salient points of the project. Ma�or issues involved are: Change of zone will irnrolve the lot directly south of the FYed Waring building; vacant lot directly an the south side of San Nicholas; variance request that inwlves site plan of proposed office building. Office building fronting on Monterey. The car�plication is that the praposed project an the er�ty lot would ultimately share access to Nbnterey thraugh the street in front of them on the north and with a possible similar develognent to the house on the north. This could be carried out all the way to the Hacienda De Nbnterey. To achieve this site plan requires some setback variances. With the widening of Nbnterey city had to purchase a 65' wide lot of which .30' rernain. It is used as a 30' parkway which is catmitted to landscaping, because of this the front will look as though it has a large front setback; rear setback is proposed at a 10' setback next to a 5' setback (rear of property is adjacent to the side of a house to the east). Because the is more in proportion to residential than office builcling the 10' setback is proposed instead of the reqt.iired 20' for office buildings. What is being proposed is to relocate the cul-de-sac by the developer ane lot to the east, since the existing house would continue to have a portion of the right-of-way in fr�t of it and w�uld functi� as a private driveway to the cul-de-sac with a ten�orary landscaped wall barrier which would limit access for the office building to Nbnterey, and access for the resident to the residential street. It is hoped that the house on the east will follaw the proposed plan and be conver�ted to an office use. Chairman Erwood o ened the public testimony and asked if the applicant wished to address the cannissian. MR. RICHARD HOLDEN, HOLDEN AND JOHNSON ARCHITECI'S, 44-267 Nbnterey Avenue. Ne introduced himself as the architect for this project and was available for cannents. Clzairman �y�od asked if anyone present wished to speak in FAVOEt or OPPOSITIQ�J to the proposed. N�. William Rave, 73-026 San Nicholas, gave his opposition on the project for the following reasons: Monterey access � deletion, with spot zone it has a negative ir�act on the value � of his hcn�e and canryot sale his h�xxne, and because he will be blocked in on twr� sides by carmercial buildings, and potential fire hazard because the fire departrne.nt cannot get their trucks to his hcn�. When he was coaztacted by the city all he was told was that he wr�uld be gettirig a longer driveway. He stated that his neighbor has suLnitted a letter voicing his co�icerns an this project. He would like to see this project design to be built contiguous with the exis�ing camiercial and residential areas. N�. Drell informed commission that as part of the street vacation the maixitenarice of a pedestrian easement through the parking lot to Moa�terey will be required and a vehicular access to San Nicholas. The driveways will be aontinued out to the cul-de-sac. There should not be a negative impact on the value of Mr. Raves with the change of zone because of its location to the pro�ect it could be potentially usable in its present form as a stxucture. � Mr. Drell read the letter fran Mr. Carl Wm. Chairman Erwood asked how this project would i►�act Mr. Rave's property. N�. Drell replied that a new cul-de-sac will be extended to San Nic,holas and a portion of the existing parking lot will be used for pedestrian access to Nbnterey. Cam�issioner Whitlock asked for clarificatioQ-i on whether N�. Rave was being asked to make a change of zone frcm residential to office profession. Mr. Drell indicated that if the buffer wall is aonstructed between the two properties a change of z�e will rx�t be needed. Ntr. Diaz noted that there will r�ot be a fire hazard because the fire departr►�.nt can cane cbwn San Nicholas and Monterey. The fire station that will respor�d to N�. Rave will go dawn Plaza Way to FYed. Waring then to San Anse]mo and in to tt�se streets. He asked if Ntr. Rave wanted a rezoning. I�. SAtmY BAUM, 45-800 Deep Canyon, asked if traffic traveling sauth an Nkmterey left turn poc.ket at the break in the street for the north bound traffic. Mr. Folkers indicated that there are u-turn aper�ngs mt turn pocket, and that they might be closed off in the future and vehicles � will then have to north driveway of the Tc7wn Center and use that opening. Mr. Baum felt that closing the u-turn opening wwld only add to the problem and that this matter should be look into. N�. Folkers indicated that a left turn pocket aould be cut into the island. BOB FOSTER, 117925 Arnally Court, Wichita Kan.sas, indicated that because he was unaware of the time increments which the City of Palm Desert deals with. He felt that tw�o months w�ould be adequate to perform items necessaYy ur�ler the pexmi.t. He is a franchisee developer with Marriott. He has met with Marriott representatives and have committed to commence oonstruction prior to July, 1989. Chairman Ertiaood indicated that the cannission has been strict on application for time extensions and that as a rule anly two time extension are granted. He suggested that the applicant be granted a 1 year time extension to allaw for proper prepaxations on the pro�ect to be caYq�leted. Mr. Foster agreed. to the 1 time extension.
