N�. Drell outlined the changes that had been made. Chairman Erwood opened the public testimony and asked if the applican-t wished to address the ccx�mission. MR. Caimissioner Richard.s stated that the camtission takes zone changes very seriously. He indicated that a zone change would provide the applicant with an ecor�c►uc opportunity and felt that carmission's aoncerns should be addressed. He noted that the Alessandro area was a difficult one due to county construction years ago, and the city would like to imprave the area. Chairman Ei��od asked if anyone present wished to speak in FAWEt or OPP06ITIC[�1 to the proposed. There being no one, the public testi.cnony was closed. Catmissioner Whitlock felt that sane nice i�ravements had been made since the original plan, but expressed aoncern abaut the landscapi.ng to be provided. N�. Drell informed camussio� that the landscapi.ng on the plan as sha�m would be planted. Mr. Diaz stated that any landscaping concerns could be voiced to the arrhitectural crnmission. Ntr�. Drell further clarified that the tile shc�m o�n the plan w�uld be a clay S tile, possibly with different terra cotta shades. � Ccamissioner Richards asked for clarification on the lot coverage. N�. Drell stated that the building aoverage was 34$, paving was 28�, and parkirx� lot and landscaping was 38$. N�. Drell clarified for Commissioner Whitlock that only carports were being provided, no garages. Cannission felt that based on the drawing, the coverage looked more like 70$. N�. Drell indicated that cannission could continue the hearing and he would scale off to the exact square footage if th.at was the principle aoncern. He rx�ted that the R-3 zone permits 50$ caverage and was confident that building cc�verage was belaw the requirement. Camussioner Whitlock asked if e,x.isting carports could be converted to garages and the other parking lot side be cavered to hide asphalt parki.ng area. N�. Drell stated that it would require a variance to ' construct cazports that close to the property line. Mr. Picking addressed the catmission and stated that the asphalt could not been seen frrxn the street. He indicated that when looking . at the roof plane, the plan includes a three foot averhand all ' around, and there w�uld be shrubbery underneath �the averhang. rr.. 3 NIIIV[TI'ES PALM DESQZT PLADIIIII� Q'I�T�SSIQ�1 APRIL 4, 1989 <; � � � Commissioner Richards stated that he would mave to continue the hearing to discuss caverage, inadequate drawings - which look like it is totally roofs and parking lots; he requested the applicant to pravide a better drawing and staff should provide aoa�crete figures. He felt that a lot of building was being packed onto this lot. Mr. Drell s�mmarized the goals of the Palma Village Plan in relatian to this project. N�. Diaz suggested that if that was a concern, density versus developnent, cainussion should coilsider reducing the density. Carmissioner Richards conciarred that maybe the density was too high. N�. Drell stated that a more graphic representation of the open space oould be provided. Mr. Diaz stated that a study session at the next meetirig to discuss this issue would be scheduled. Caimissianer Richard.s stated that he would like staff to present this to city council with the idea in mind that the oaimission is having proble�ns and needed iriput. He requested that the council be sYx�m the exact same drawings for an official opinion, stressing that the pro�ect was drawn up according to code and oomnission would like canfir�mation that this is what the council envisioned when the �ner�x�t was ac7Qpted. � � N�. Drell stated that if the ccnmissian were to eliminate one unit � plus two parkirlg spaces, an additional 1400 square feet of open space would be pr�avided. Catmissioner Richards stated that he would like an accurate plot map. Chairman �ti�od stated that this is the time to get out all concerns because at the last meeting nothing was discussed abaut the grotuid caverage or parking. He indicated that all the continuances are rx�t fair to the applicant, camtission, staff or the audience and all concerns stx�uld be brought out. Commissioner Whitlock stated that she vaould like to see a full land.scape plan shawing the types of trees being pravided in front of the facade. Commissioner Richards nr�ted that the applicant was instzucted at previous meetings to pmvide better drawings. Ne stated that the issue of elevations at this point are moot because basics ha.ve not been met. It was nQted that the unresolved issues include covered parki.rig, elevations, and caverage should be taken into consideration. . Continued Case No. TT 24287 - C�IA77.AN �g'ANY, Applicant Request for apprwal of a tentative tract map subdividing 10 acres into 37 single family dwelling lots on the east side of Deep CarYyon Road, 1325 feet r�rth of FYed Waring Drive. Mr. Smith surm�arized previaus discussions and indicated that the , feecD�ack fran the council was that retentioaz of the date palm txees and development of single family residences were n�ot axnpatible. ' Council indicated that it would rather create a younger date preserve in another city location, possibly on Havley Lane, and that the natural averlay on the property was r�o langer applicable. N�. Smi.th noted that a neighbor had expressed ao�ricern over possible rodent infestation with the elimination of the date pa7ms. He indicated that the Nb��;to Abatement District felt that the elimination of ten acres would not force the rodents out of the date grove. He also autlined the cond.itions that had been added to mitigate these issues. Ms. Allen asked if an in-lieu fee would be included; Mr. Diaz explained. that this would be w�rked out as part of the agreement. ri.r Carmissioner Richards asked if staff could provide a possible monetary value that the i.n-lieu fee might be. Staff indicated that they did not know. Mr. Diaz informed commission that these conditions were being tied to the appraval to allaw the applicant to proceed with the tentative map and in the event that agree�nent aould not be reached, the matter would cane back to catmission or go directly to council. Commissioner Richards suggested the Haystack Park area to be oonsidered for the placement of the trees. Chairman Enaood opened the public testimony and asked if the applicant would like to address the catmission. . MS. C�iARLENE McLEAN, 73-720 IronH�od, stated that they had met with [�. Diaz and Mr. Smith and agreed to proceed forward with the appraval. Commissioner Richards asked if the applicant had researched the potential costs relating to the trees. FIItN, Applicant Request for approval of a negative declaration of enviror�ztal impact, conditioa�al use permit for a 5,470 square foot expac�.sion and facade remodel of a aannercial ocniplex on the north side of El Paseo, 200 feet east of Highway 74. Mr. Drell outlined the salient points of the staff report. � Catmissioner Whitlock requested clarification on the height of the corner clock tower and at Club 74. N�. Drell stated heights of 36 feet. CaTmissioner Richards asked if a parkirig stz.idy had bee.n done. He inc3icated that the parking was always crowded. He also stated that he did not have any problem with the tawer height if it provided sane aesthetic/architectural benefit. He felt that the expansion was r�ot needed for the rernodel to be ca�leted. Comni.ssianer Richards also felt that the concept of �layee parking might not work if the buildings had different cx�mers in the future; he also objected to the look of the storefronts. Mr. Drell explained that each tenant would design their own storefronts. He also noted that restaurants wr�uld be prohibited. C7iainnan Erti�od opened the public testi.mony and asked the applicant to address the cannission. MR. RICHARD FISCHER, architect, described the project and discussed the issue of office versus retail parking uses. He noted that pedestrian crosswalks w�uld be installed and the tawer w�uld be strictly an architectural ele��ent. Mr. Diaz rx�ted that the creation of the specialized walk area was sanethirx� that the El Paseo I�ravemerit Association had wanted to make E1 Paseo more "pedestrian friendly." He indicated that the applicant was willing to do this at his expense and the safety aspects would be addressed by public works. Mr. Fischer also stated that the paver w�uld be the real thing and a water elemP,nt would be pravided in the center. FRID FEFtN, 49-591 Canyon View Drive, stated that the par}cing was a practical problesn and they focused on that and the main concept of tieing the two properties together with the walkway to allaw people to utilize parking an both sides of E1 Paseo. Carmissioner Richards noted that today the parkirig lot is probably 30�-40$ under parked and not well designed. He indicated that if the Savings and Loan buildiny were to change, the wt�ole area would be +�. "wiped out". He indicated broad support of the project, but felt that the re�iodeling could be done without building expansion. Mr. Fezn stated that the main problems frcm the retail perspective was the step dawn, averhang, and the sink c3a�nz of the winc�aws. He indicated that to correct that, the great bulk of the expansion would go to the averhand and sunken area. N�, Fern also indicated that he went to each a�mer with easernent and they signed their support, except for Carl's Jr. , which had to be sent to Paris for the signature. Upan questioning by Camtissioner Whitlock, Mr. Fern stated that the primary addition of square footage was to the front, but also included the narraw walkway, which he felt was an obstruction, as well as the re�rr�deled center area and tawers. Cnaizman Es�rood asked if anyone present wished to speak in OPP06ITI�i to the proposed. MS. JUDITH BURNS, leasing agent, expressed concern for the • rehabbirig mettx�ds used for the building across frcm this one by Mr. Fern. With pop out windaws and addition.al square footage the air conditioners were just not adequate. She suggested that each unit be studied for sunny wir� exposure. Ms. Burr�.s also felt that the vacant spaces were an eyesore an+d the f irst tenarits bear th�e burden of these problems. Nfft. AI�IDRE KfJLtMiCK, manager's of Margo's Beauty Salon, stated that the air aonditionirx� had never bee.n so cald and all the air conditioners were new. NIl�. GERALD C�-IA7,AN, 72-757 FY�ed Waririg, expressed concern about this buildiulg being the gateway to El Paseo and felt that the round towers on the corners were not compatible with the architecture of the area, as well as being dispz�oportionate. He felt that the tc7wer should be spanish or mediterranean. Mr. Fischer clarified that the tawers were ryot round but square, and they style was mediterranean. Ca�ussioner Richards stated that he did not want to be part of any increase in the square footage. He felt the building could be remodeled without excess square footage because of the parking situation. � Catmissioner Whitlock stated. that to see an unfinished store in the middle of a building was an eyesore and suggested that the applicant use sane creativity in this new building with a fake front. N�. Fern indicated that the point was well taken and stated that the glass windows would be installed in the new buildirig if it's not aanplete when leased off. Camdssioner Dc�ms stated tha� he wc�uld like to see the store front level with the sidewalk in the front, but any additional square footage he disagreed with. ' N�. Diaz indi.cated that when it was stated that more square footage would generate more parking, the additional 23 spaces needed were being proposed across the street. CaYmissioner Richards felt that the parking across the street could not be guaranteed years into the future. Mr. Diaz noted that this is the solution the city is aonteinplating for the President's Plaza situation. Chairman Erwood stated that past mistakes have c�me fran making adjustrnents to the parking requirements. Camussioner Richarrls noted that this center included Baker's Square, the pizza place, Tony Rana's, and Stanley B's. Mr. Drell felt the issue was whether the e�layee parking was an effective soluti�. He also stated that the vacant parcel would have to pr�avide its awn parkirx,� and weuld r�t be part of the center. Calmissioner Richards stated that he aould agree to the front, but r�ot the sides or back. Charlene McLean addressed the corirnission and e.xplained that she wr�rked at Classic Realty and agreed with Carmissioa�er Richards on the parkiux�. She noted that the building is approximately 40$ vacant . today and it is a]most impossible to parkirx,� there. She stated there was another pad available on the aorner. Ms. McLean agre�d that retail was needed and the building needed help, but did not feel 20 spaces across the street behind the other buildu�g w�ld suffice and in�lcated that with heavy traffic, pedestrian walking was hazardaus. CamLissioner Richards stated that he was willing to mave to approve the findings as n�d.ified. Mr. Drell stated that the degree of expansion wr�uld only include that area on the front of the existing facade, not arly expansion of the �r sides or rear. N�. Fischer stated that the client was willirig to live with that. Mr. Diaz also indicated that a condition relating to the win�xas w�uld be added. SAI�IDY BAUM, 45-800 Deep Canyon, clarified that rental units were caused by people who have second and third hanes and rent them out and had nr�thing to ck� with the desirability of livirig on a street.
