', Mr. Joy explained that this had been continued fran the previous

in excess of the requirement.

MR. PHILLIP MANUELL, applicant, described. the parking layout and
indicated that he would be building a quality building. He

for his own use and part for one other tenant.

Mr. Joy indicated that there had been scme confusion expressed fr�n
the way the legal notice was w�rded. He r�ted that the project under
consideration was for only 80 acres. He informed ccmnission that a

Cooper. He stated that there would be future public hearings when
the other portions of the 675 acres developed. Ntr. Jay outlined the
salient points of the staff report. He indicated that the applicant
was requesting a lesser density than what was appraved in the
develo�zt agreeinent by city council. Staff also indicated that the
applicant was requesting that the clubhouse be 40,000 square feet
instead of 30,000 square feet. Staff concurred and indicated that
the conditions of appraval would be chariged to reflect this. He
recomnended appraval of the project. '
MK. DAVID GRAF-iAM, Vice President of PlanniYx� and Developrnent for '
Westinghouse Develo�ient Canrnariities, stated that they would
bu.ild a high-quality country club typ� camnu�ity overall, which
w�uld be predan�nantly single family l�ccnes. He indicated that
they would be extensively using drought tolerant materials that
would be compatible to the area. He also stated that the golf
, course would be s.imilar to the Desert Highlands course near '
Phoenix. Mr. GY'aham inforn�ed camiission that they wr�uld be
caning before the carcnission in the next four or five years with
tentative tract maps. He indicated that they wr�uld proceed
slawly and study each piece of property extensively.

of the proposal.
MR. GORDON PAULUS, Planr,;� Consultant for the Del Gagnon Et.
Al., informed camussion that this group was totally in favor of
the project as presented.
MR. DAN EHRLER, Executive Vice Present of the Palm Desert
Chamber of Carmerce, read a letter fran the Board in favor of
the proj ect.
MR. BRUCE THOMAS, 72-225 Arie Road, spoke in favor of the
project as it was present to them. He indicated they had three
meetings with Westinghouse. He stated that aver the last eight
to ten years he has actively been on the board of the
improvement committee in Cahuilla Hills. They had been .
concerned about high density, but they felt that if Westinghouse
lived up to their pratLises, they were in fav�r. He also felt
that desert vegetation should be used for the landscaping. He
also expressed concern about the secondazy access being used as
a service entrance on Cahuilla Way. He suggested that sane of
the service vehicles use the main entrance because Cahuilla Way
was the only residential entrance and access to the conurnulity.

He indicated that there was an Art Smith Trail that he liked to
hike and was concerned about there being an entrance into the
trail and possibly a small amount of parkinq, Mr, Th�nas
described where the trail started.
Mr. Jay indicated that the trail would raot be located on the 80 acre
parcel being discussed. He stated that it w�uld be addressed when
that parcel was under consideration. N�. Z7icmas asked about the
total density; Ca�IInissioner Richards replied that it was 430. Mr.
Thanas stated that he was more than content with that.
Nff2. JOSEPH CADY, 71-855 Jaguar, asked staff what the setback
would be from Highway 74.
Mr. Joy indicated that the per�meter wall and curb face would be 40
feet of landscaping. Mr. Cady stated that there were already some
developments with bigger setbacks and did r�t feel 40 feet was
. erwugh. He also felt that the property near the Cahuilla Hills
should be acreage lots and wanted that aspect considered.
MR. DANIEL APPLEQiJITH, 71-445 Oasis Trail, stated that most of
the people present lived in the Cahuilla Hills. He noted that
the developer cam to the residents twu or three t�mes and was
caring and understanding of their needs. He also wanted to be �
assured that the developer would live up to his ccmnitnents. He
stated that Cahuilla Way was his biggest aoncern since it was
their only access. He was very concerned about haw it would be
used by the project.
Chairperson Whitlock asked if any�ne present wished to speak in
OPP06ITI�V to the proposal. �
MR. JIM DEFORGE, 51-000 Highway 74, stated that the Bighr�rn
Institute had a nwnber of ineetirigs with WestingYiouse. He felt
they would be sensitive to the envirorunent and they were not
opposed to the 80 acre proj ect, but they we�uld be caning 1�efore
con�nission when other requests were made.
Ngt. JOE C70pPER, 71-750 Cahuilla Way and 49-225 Buckhorn Trail,
stated that he was concerned about the golf course and asked if
the golf course was appraved. Staff replied no, the only
request was for approval of the 80 acres. He informed
co�n�riission that he had been told that construction on the golf
course would begin February 1. He was concerned about the size
of the lost in that area and requested that the lots be one acre

parcels plus a setback and was concerned about the amount of
landscapi.ng provided and the height of the houses. �
Commissioner Richards asked staff what the height limit was as
'� approved in the development agre�nent. Mr. Jay replied 18 feet �ust
'� for the 80 acres. CamLissioner Richards inforn�ed Mr. Cooper that
when that section of property canes before the c�omnission, it w�ould

be considered in a public hearing.

' Chairperson Whitlock asked the applicant if he wished to offer any `
other c�ients. '
Mr. GYaham indicated that in reply to Mr. Thanas' cocnnents, 450
single family hr.x�ies was apprc7ved and the acreage was 675. He
indicated that the trails were being discussed. He stated that
they would be wr�rking with staff within the next tw� months on
the dedication of land to the city and indicated they were
, highly motivated on getting this taken care of. He assured
camLission that they wr�uld stand up to the pranises they made to
i the area residents. He indicated that he wr�uld like to address
the items of concern that were for areas other than the 80 acres
when they cane up. He indicated that six units per acre was
what was approved. He stated that they had no approvals for the
� golf course fran city staff yet, but they would like to begin ' �
construction on the golf course Februazy l. He indicated he
would like to outline their intentions and work with staff to
proceed so that the golf course would be open by Thanksgiving or
Christmas. He stated that there was a 24 foot height limit on
the five units clustered together, but the other units abutting
Highway 74 would be 18 feet. He stated that the 24 foot height
was what was appraved for the hotel and that was the reason for
the units being 24 feet. He indicated that they were working
with the neighborhood and stated that the service vehicles w�uld
be using the front and side entrances for access.
Chairperson Whitlock closed the public testimony and asked for ,
comnents.
j Cc�tissioner Erwood felt this was a much better project than the
previous one and had no problem with the request. Commissioner
Richards noted that he had attended a meeting with the developer and
residents on the 30th that took approximately t�ao hours. He felt the
character and nature of the developnent was one of the best he had .
seen and did not have a problem with the proposal. He stated that �
the 24 foot height limitation on the five units seemed appropriate
and felt the trails w�uld be kept in focus. He e�pressed a ooncern

that the amount of cars that could be permitted be small. He did r�t �
want to make this into a big deal. He also suggested that the water ;
district be contacted to wr�rk out access. �

Mr. Drell outlined the salient points of the staff report, stressing
that the purpose of this application was to have sufficient control
on the magnitude of the business in case it b�canes tr�nendQusly '
popular. Staff recatmended appraval, subject to the limitations `'�
specified in the conditions.
Mr. Drell clarified the location and possible effect on Tony Rana�s
for carmission. ;

MR. ERIC JONES, 1390 Marrin Way in Palm Spririgs, inforn�d
cannission that they had been in business for the last five to �
six years and needed their awn location. He r�ted that Tony
Rana's provided their awn parking, He indicated that he had no
objection to the conditions of approval.

Ms. Sass outlined the salient points of the staff report and

C�airperson Whitlock asked for and received clarification that the
landscaping plan presented was prelimiriary and would return to the
architectural review commission with a final landscape plan.
Co�r�nissioner Richards asked, if the only wiu�daws on the buildirx� wr�uld

be in the area designated as office; Ms. Sass replied yes.
' Chairperson Whitlock opened the public testim�ny and asked the
applicant to address the caimission.
MR. SVE[�it PEULIC�, J.P. Constxuction, stated that he read the
staff report. He stated that they had su�cnitted a revised
landscaping plan and objected to the requir�nent of a four foot
planter on the r�rth property lin�e and noted that they had
pravided the total landscape requir�nent withQut the planter.
He noted that the ext�reme heat from the wall would make it
difficult to maintain plants and that six of the parking spaces
wr�uld be covered which would make it a difficult area for
9rowth•
Ms. Sass indicated that the condition would be to canply with the
master parking lot tree plan that the city council was requesting
compliance to. She felt it might be prudent to leave the decision of
placement up to the architectural ca�u.ssion's landscape architect.
Camussion deterntirled that the final decision should be left up to
the expertise of the architectzzral calmission and amended condition

Request for appraval of a precise plan for a
35,523 square foot office/warehouse complex
consisting of three buildings on three lots
totaling 66,183 square feet of area within the
service industrial zone at 42-600 Melanie Place. +� �
Mr. Drell noted that the applicant had provided a model of the
proj ect. He indicated that the project had received preliminaxy
architectural commission approval, noting that one area of
controversy was the loading door facing the street. The
architectural coi�anission required the applicant to place additional
landscaping in the 26 foot landscaping setback in the loading area.
Staff recommended approval of the pro�ect. Staff provided
clarification that the ordinance allaws a 15$ deduction for parking
calculations.
Chairperson Whitlock opened the public testi.c�ny and askecl if the
applicant wished to address the cannission.
ROBERT HYATT, 73-390 Ironwood in Palm Desert, informed
ca�tission that concerns could be handled with landscaped
screening. He stated that it was their intent to build a
quality building in design, materials and wor}ananship. He felt
any area of concern with the doors could be taken care of with
landscaped screening or perhaps a block wall.

of the proposal. There was no one. Chairperson Whitlock asked if
anyone present wished to speak in OPP06ITICY�t to the proposal.
NIlZ. LARRY C��AI�C, Executive Vice President for association
representing John Hooter and George Herkey and architectural
camLission at Cook Square. He stated that they were very
concerned with this buildirx� and having the loadirig door facirig �
the street. He felt that it did nr�t conform to the style and
architectural standards. He stated that any buildirig plans must
be approved by their architectural review cannittee. Mr. Ch��k '
;n�;cated that the architectural board w�uld be voted on by the
awners in the near future. He indicated that they had asked
them to revise the plans, which they have rlot done, and until
they d� revise the plans, he requested that commission not
appmve the project. Mr. Chank informed aamtission that the
architectural standards were part of the association's CC&R's.
Chairperson Whitlock noted that the city's architectural cannission
had approved the design with additional land,scaping. Mr. Chank did
not feel the design was consistent with the rest of the area's
development and the added landscape trea�nent was rx�t acceptable.
NIl�. Dt1KE BAKER, 73-435 Agave Lane in Palm Desert, stated that he
� was delighted that Richard Miller was building on those lots,
but was concerned about the front loading on the street. He
noted that every other develo�cnent had side or rear loading.
Mr. Hyatt readdressed the catmission and indicated that with the
wall and landscaping, he felt the project was acceptable with
the loading in the front.
Chairperson Whitlock closed the public testimony.
Ca�rtissioner Richards asked if there were any elevation changes and
Mr. Drell replied there was approximately three feet difference frcm
the curb. Conanissioner Richards noted that the city's architectural
ca�anission did not have a problem with the front loading and if they
had not felt it was right they would have suggested a change.
Chairperson Whitlock agreed and felt that the disagreement of the
CC&R's was between the association and the developer. CamLissioner
Erwood also agreed and indicated that the issue of the CC&R's would
have to be settled in court. He stated that he had no problem with �
the proposal.

Mr. Joy explained that a copy of the amended ordinance was
distributed to the camiission, but since additional changes needed to
be made, staff was recamtending a continuance to January 16, 1990.
, Staff asked if cam�ission had any cannents to incorporate into the
plan.
Chairperson Whitlock asked why this issue was being brought up and
Mr. Joy indicated that city council had concerns with parking lot
shade. Chairperson Whitlock asked if it could be ass�.nned that the ��
present ordinance was bei.ng met when this issue was not discussed in �
the staff reports. Mr. Jay infornled camtission that the present
ordinance required one 15 gallon tree per ever�r seve,n spaces; he
stated that the new ordinance would require r,onsiderably more trees,
Chairperson Whitlock felt this was good.
Cacmissioner Richards expressed concern for visibility problems and
felt there might be sane opposition in the future from businesses
along the frontages if signs/businesses were nQt easy to locate. N�.
Jay clarified that at the present time the ordinance only applied to
parking lots, not street trees and indicated that frontage roads were
public parking.
