Request for appraval of a five lot tentative map
and negative declaration to allaw four hanesites
and dedicated open space on 7.73 acres generally
located on the west side of the Palm Valley Storm
C�aruzel across fran the Sanr�rset Cor�Cniniums.
N�. Diaz explai.ned that the matter had bee.n oontinued and was called
up by city council to provide direction regarding the paving of
streets outside of the subdivision area to the subdivision area. The
city council at its meeting of April 12 vr�ted to inform the plannirig
c�nmission at this time that paved access outside of the tentative „r„�
tract map itself should n�ot be required of this specific subdivision
in the hillside area. He rx�ted the matter was aontinued to allow
staff to investigate a possibility of the involvemerit of the Air
Quality Management District regarding the PM 10 particles of sand,
air quality that could require sane paving. A secorid council concern
was that providing paved access into the area wauld encourage
additional tratfic into the hillside area. In terms of tract maps
and developnent in that area, council felt that it should anly be
interior local streets under consideration at this time.
Commissioner Richards asked if this would prohibit a gr�aup of
hon�mers f�rn building their awn road. N�. Diaz replied no, but
indicated there was sca� strong sentiment in that area not to have
paved access.
After further discussion an safety, paving standards and access
issues, Chairperson Whitlock o�ened the public testinarYy and asked
the applicant to address the aonmission.
NIFZ. RIC�IARD HOWARD, 41-910 Boardwalk, Suite B3 in Palm Desert,
stated he was present to ai�,swer any questions.

''�' Camiissioner Richards asked if Mr. Haward had a meeting with adjacent
property awners regarding road paving. Mr. Howard replied yes, that
it was with property cxariers in his general area and they all agreed
that some type of safer, cleaner access was needed. He explained
that there were two issues involved: the GVWD maintenance road and
road far access to the properties--the road to the channel arbd the
road to the individual Yx�me sites. It was rx�ted that the Miller
property might be developing their 640 acres, as well as the Clem
property, which might be able to pravide scme type of futzare access.
Calmissioners Richards and Jonathan expressed ooncern as to safety
and traversing the spillways, fire deparanent access, and formation
of an assessmeizt district for road paving prior to beginning of
construction. After further discussion, N�. Diaz suggested the
follawing be added under c7anm,uzity develoFcnerit conditions: 10) Hanes
sh�uld be sprinklered to the satisfaction of the fire depart�nent; 11)
Access along the Coachella Valley Water District maintenance road
shall be approved by the Palm Desert City Engineer; and 12) Applicant
and his successors in interest on the property shall agree to join an
assessmerit district for the pavirig of said maintenanc,e road shauld
one be established in the next five (5) years. Cannission and the
applicant r,oncurred with the add.itional conditians.
Cnairperson Whitlock asked if anyrme present wished to speak in FAVOR

MS. DORIE CREE, 47-205 South Cliff Road, spoke in favor of the
project and inforn�d carmission that several haneawners in the
area were anxious to get a paved access and were tryirig to fonn
an assessmexit ciistrict to provide this to their t�anes. She
noted that there had beP_n na problem with gettirig fire erigines
up to that area and indicated there was sufficient area at each
house for adequate turn around space.
C�airperson Whitlock asked if anyone else wished to address the
varrnission; there was no one and the public testimony was closed.
Action:
Nbved by Cannissianer Richards, seconded by Carmissioner Jonathan,
approving the findings as presented by staff. Carried 4-0.
Maved by Camussioner Richards, seconded by Catmissioner Jonathan,
adopting Planriing Cannission Resolution No. 1432, apprr�virig TT 24866
and a negative declaration, subject to conditions as amer�ded.

Ms. Sass �ted that the planning aam�issian had been oo�ncexned about
the look of the building and the landscaping. She indicated that new
plans had been sutrnitted and delineated the changes that had been
made. She stated that staff's concerns had been addressed and
reaannended appr�aval of the develoFxnecit agreeme,nt and precise plan,
with the addition of a condition that the applicant submit a final
landscape plan prepared by a professional landscape architect to be
appraved by the arch.itectural oaimission.
Commission asked for and received clarificatian as to wall/ferice
material and height.
C7�airperson Whitlock opened the public testimony and asked if the
applicant wished to address the cannission.

arLswer any questions.
Criairperson Whitlock asked if Mr. Patscheck had any problem with the
addition of the last aandition regarding the landscaping plan. Mr.
Patscheck replied no.
Chairperson Whitlock asked if ac�ne present wished to speak in FAWR
or O�POSITICN to the proposal. There was r� oa�e and the public
testimony was closed.
Carmissioner Richards noted that the applicant made changes that were
more in keeping with Palm Desert's quality standard.s. He felt that
when mQre care is given to a plan, the project turns out better.

senior apartinent project on San Rafael Avenue,
south of Catalina Way.
Ms. Sass outlined the salient points of the staff report and
illdicated that the ar�chitectural review cannission had appraved the
landscape plans oonditioned that four more palm trees be pravided on
the street side of the buildings and that the seoo�id story baloonies
be extended for the length of the building. Staff reccnmended
appraval of the developnent agreement and precise plan.
After discussion as to the architectural caimissian's intent for
extending the balconies, Chairperson Whitlock � the public
testimony and asked if the applicant wished to address the
catmissian.
"'" N1Ft. HARRY SC�II�IITZ, developer, stated that he was present to
answer questions. He r�oted that the tawer elemerit wauld hou.se
the elevator and as to the extension of the balaarLies, they were
still aonsidering extei�ding the actual walking area of the
balcony. He indicated that it might be a safety point to extend
the balcony so that in case of a fire, there would be access
from one balcony to another and felt that it would be
aesthetically more appealirig.
Chairperson Whitlock asked if anyone present wished to address the
catmission in FAWR or OPP06ITI�I to the proposal. There was r�o ane
and ChaiYperson Whitlock closed the public testimony.
Commissioner Jonathan informed commission that he would be
abstaining.
Camiissioner Richards felt that the plan/developer had been creative
� and felt it was a nice project.

Ms. Sass outlined the salient points of the staff report, rx�ting
there were a couple of chariges to the resolution's conditions of
approval; community development n�o. 12 to read three affordable
units, not two; and in the developnent agreement, page 6 item i .�1
changed from minimt.un age of 55 to a mininnnn age of 62. Staff and
catmissior� discussed parking, as well as acce.ss to the senior center,
with N�. Diaz notirx� that handicap access might need more study.
Camiissianer Jonathan noted that on page 4, item 9a should also
reflect the �ao units; staff c7oncurred.
Chairperson Whitlock opened the public testimony and asked if the
applicant wished to address the canni�sion.
MR. A.J. WIGGINS, developer, stated that he was present to
answer any questions. He noted that they had spent a lot of
t�me on the plan and noted that the senior center was in fawr
of access to their project.
Catmission, staff and Mr. Wiggins further discussed the access to the
senior center and Mr. Diaz indicated that if it c�uld not be worked
out at staff level, it w�uld be brought back to the cor�nission.

proble�ns with their general plan and reca►mended that Palm Desert
provide Indian Wells with assistance to create a spirit of
aooperation between the cities.
