corner of Santa Ynez and Alessandro Drive, adding
a driveway onto Santa Ynez Avenue as required by
the Fire Marshal.
Mr. Drell outlined the salient points of the staff report and
distributed a letter signed by Ms. Abby Flemming indicating no
objection to the driveway onto Santa Ynez Avenue. N�. Drell
in�;cated there would be a left-turn only sign installed and
recomnended approval.
Cannissioner Daan.s stated that he was only in favor of an emergency
access use only, otherwise he wnuld have voted against the pro�ect
from the begiiu�ing.
(�aizperson Whitlock opened the public testimony and asked if the
applicant wished to address the ccmnission.
MR. RICHARD HOWARD, applicant, infom►ed cannission that he
canvassed the neighborl-iood with a letter that asked if the awner
had concerns with the access and received a great rn.unber of
hr.�ieawriers' signatures in favor of the access. He felt that
traffic fran the access wc7uld be minimal.
Mr. Drell also noted that a condition was added that the planning �'
commission would close the access to allaw emergency only if a
problem developed.
Carmissioner pown.s felt it wr�uld be pn.ident to allaw only emergency
access and avoid any probl�ns. Mr. Dre11 explained that the access
being available provided better circulation. Upon questioning by
CaYmissioner Jonathan, Ntr. Drell explained that the appearance of an
emergency access anly w�uld be a n�r�wer street with a physical gate
or sane type of barrier. Mr. Haward i.nforn�d carmission that the
fire marshal preferred to have clear access. Cannissioner Richards
nated that there didn't appear to be much opposition from the
neighborP�ood and felt it wr�uld be a better pro�ect with the access.
C�airperson Whitlock asked if anyone present wished to speak in FAVOR �
or OPPOSITION to the proposal. There being no one, the public
testimony was closed.
Catndssioner ErNn�od agreed with cannents by Ca�ussioner Richards.
Corm�issioner powns spoke in opposition because of the negative impact
the traffic would have on the neighborhood. After further

denied.

Moved by Commissioner Richards, seconded by CamLissioner DavrLs,
instructing staff to prepare a resolution of denial for adoption at
the next meeting. Carried 4-1 (CcRmissioner Jonathan voted rx�).

INC., Applicant
Request for appmval of a Negative Declaration of
Environmental Impact, Precise Plan, Tentative
Tract Map and Variance to allaw construction of a
28 unit single story residential
condominiwn/apartrnent project on 2.53 acres at
the southwest corner of Portola Avenue and Santa
Rosa Avenue.
Mr. Drell outlined the salient points of the staff report and
in�icated that the applicant wanted the option of having apartme,nts
or converting the units into condominiums. Staff did rwt feel there
� was justification for the variance. Ntr. Drell recam�ended appraval
of the project, but denial of the variance.
Carmission and staff discussed zoning, density and parking. Mr.
Drell noted that the architectural carmission was requiring trees and
landscaping ir. the parking area.
Chaizperson Whitlock opened the public testimoriy and asked if the
applicant wished to address the carmission.
MR. J.P. BROWN, 25 Lafayette in Rancho Mirage, President of USA
Properties, stated that they have a senior project on La Serena
of which only 65 units out of 150 have been rented. He felt
that having 28 units at a one-story height was a good trade-off
rather than a twr� story buildirxJ. He i.ndicated that the project •
wr�uld be an �mpraveinent to the area and was only requesting a
half-unit variance. He informed commission that it was
i.mportant to the ecoricmics of the project.
(�airperson Whitlock and the applicant discussed the project being
converted to condaniniums and the lc�cation of the other two parking
spaces that w�uld be needed.

MR. JACK BROWN, 1828 N. C7aig in Altadena, informed cannission
�hat on the original site plan the other tw� spaces were in the
mi.ddle of the pzroject. He explained that they weren't aware of
the difference in requirements for a cond�xninit.un project.
Chairperson Whitlock asked if anyone present wished to speak in FAVOR
or OPPCXSITICH�1 to the project.
MS. MAOGIE LEON, 44-251 San Jose, infornled catmission that she
had given USA Properties aver 200 names of people in the area
who were looking for a senior project and she noted that this
area was ideal because of its location to the senior center.
She spoke in favor of the project, but wished it was a senior
project. She suggested that seniors be given preference in
renting.
Mr. Diaz rioted that the city oould not require the applicant to give
preference to seniors and noted that if the project were proposed for
seniors, it wr�uld be at a higher density to achieve the lower rents.
MR. HOWARD MASON, 73-978 Catalina, awner of three pieces of
property on Portola and Catalina, asked if the 14 foot
dedication wr�uld also be required of this applicant and Mr.
Drell replied that it was included. Mr. Mason spoke regardiux� �..itr'
fire department access and also suggested that a traffic survey
be done at Catalina and Portola. He indicated that this could
be part of an environmental impact report.
Chairperson Whitlock closed the public testimony and asked for
ca�mea�ts.
Cannissioners Da�ms and �Y��od indicated that they were in favor of
the project with 27 units. Carmissioner Richards felt the intensity
of the project was too much and commented on the road width.
Catmissioner Da�m suggested a continuance. After further discussion,
commission felt this pro�ect would be preferable to a tw�-story
project and mwed to apprave the project at 27 units, sub3ect to a
revised site plan being sutxnitted to them for appraval. •
Action:
Nbved by Cannissioner Jonathan, seconded by Cannissioner Richards,
appraving the findings as presented by staff. Carried 5-0.
Moved by Commissioner Jonathan, seconded by Richard.s, adopting
Plaruzing Catmission Resolution No. 1441, approving PP/CUP 90-7 and TT
25987 subject to conditions, and denying VAR 90-2. Carried 5-0.
