I. CALL TO ORDER
Chairperson Whitlock called the meeting to order at 7:02 p.m.

IV. APPROVAL OF MINUTES:
Consideration of the June 19, 1990 meeting minutes.
Action:
Moved by Commissioner Downs, seconded by Ccn<nissioner Richards,
approving the June 19, 1990 meeting minutes as submitted. Carried 3-
0.
V. SUMMARY OF COUNCIL ACTION
Mr. Diaz summarized pertinent June 28, 1990 city council actions.

B. Case No. PM 23176 - TRIAD PACIFIC DEUELOPMENr CORP., Applicant
Request for approval of a one-year time extension
for an industrial project that was originally
approved in the county and later annexed into the
city of Palm Desert.
Action:
Moved by Commissioner Downs, seconded by C,cmnissioner Richards,
approving the consent calendar by minute motion. Carried 3-0.
VII. PUBLIC HEARINGS
A. Cbnthxied Case No. PP 90-12 - BILL WIISCN, Applicant
Request for approval of a negative declaration of
environmental impact and precise plan for an
8,619 square foot industrial/showroom building at
the northeast corner of Boardwalk and
Mediterranean.
Mr. Drell outlined the salient points of the staff report and
recoRmended approval.
Chairperson Whitlock opened the public testimony and asked if the
applicant wished to address the ccnmissioz. The applicant indicated
no. Chairperson Whitlock asked if anyone present wished to speak in
FAVOR or OPP0SITION to the proposal. There was no one and the public
testimony was closed.
Commissioner Richards stated that he had no problem with the proposal
and felt the architect had created a nice building.
Action:
Moved by Commissioner Downs, seconded by Comnissioner Richards,
approving the findings as presented by staff. Carried 3-0.
Moved by Commissioner Downs, seconded by Commissioner Richards,
adopting Planning Commission Resolution No. 1452, approving PP 90-
12, subject to conditions. Carried 3-0.

B. Case No. TT 25945 - PETER DELUCA, Applicant
Request for approval of a negative declaration of
environmental impact and 16 lot residential
tentative tract map containing 15 residential
lots and 1 water retention lot on 5 acres in the
southwest quarter of section 4 north of Country
Club Drive, east of Portola Avenue.
Mr. Drell outlined the salient points of the staff report. He
explained that the applicant wished the option of building two
stories; he noted the conditions only included standards for one
story buildings. Staff indicated they had no problem with the
request. Chairperson Whitlock asked for and received clarification
as to location of the perimeter road and point of access onto Country
Club.
Chairperson Whitlock opened the public testimony and asked if the
applicant wished to address the commission.
MS. KAY SHURKIN, representing Mr. Deluca, stated that they would
like condition no. 5 to be amended to include two story
buildings, and public works condition no. 21 be reworded to
include that the retention area would be maintained until such
vow time as annexed into a city maintenance district.
Mr. Holtz indicated that was acceptable. Staff and commission
discussed the assessment district and Mr. Diaz concluded that
condition no. 21 should be reworded to add, "The applicant and
property owners association will maintain the retention area in that
the applicant will not object to the establishment of an assessment
district to ultimately maintain that area in the event the homeowners
association fails to do so. " Mr. Deluca concurred with the
rewording. Staff indicated that condition no. 5 should show the side
setback requirement as no one side less than 8 feet, not 5 feet as
stated.
Chairperson Whitlock asked if anyone present wished to speak in FAVOR
or to the proposal. There was no one and the public
testimony was closed.
Commission expressed approval of the project, but opposition to the
request for any two story use. Chairperson Whitlock reopened the
public testimony to allow the applicant to readdress the commission.

Mr. Deluca felt that he would be penalized if he were not allowed the
option of having two story buildings. After further discussion and
clarification that the property to the west's development would have
single story units adjacent to Mr. Deluca's property, Mr. Deluca
withdrew his request for the two story use.
Chairperson Whitlock closed the public testimony and asked for a
motion.
Action:
Moved by Commissioner Downs, seconded by CamLissioner Richards,
approving the findings as presented by staff. Carried 3-0.
Moved by Commissioner Downs, seconded by Commissioner Richards,
adopting Planning CcmTissicn Resolution No. 1453, approving TT 25945,
subject to conditions as amended. Carried 3-0.
C. Case No. VAR 90-6 - CALIFORNIA SEC[RRITY & PRoTBc'TICN SMnCES,
Applicant
Request for approval of a parking variance to
allow a school for protection officers to occupy
1,317 square feet of floor area during evening
hours, located west of Melanie Place 175 feet no
south of Merle Drive.
Mr. Diaz outlined the salient points of the staff report. He noted
that a letter had been received fran Cook Square and indicated their
concerns were addressed in the conditions of approval. He stated
that an additional condition could be placed that in the event of a
parking problem, the city would have the right to evoke the variance.
.Chairperson Whitlock opened the public testimony and asked if the
applicant wished to address the commission. They chose not to do so
and Chairperson Whitlock asked if anyone present wished to speak in
FAVOR or CPP06ITICN to the proposal. There was no one and the public
testimony was closed.
Action:
Moved by Commissioner Richards, seconded by Co nni.ssioner Downs,
approving the findings as presented by staff. Carried 3-0.
Moved by Commissioner Richards, seconded by Camtissioner Downs,
adopting Planning Commission Resolution No. 1454, approving VAR 90-
6, subject to conditions. Carried 3-0.

Resolution of denial for a senior housing unit to
be constructed with a new home south of Desert
Lily Drive - 400 feet west of Grapevine.
Action:
Moved by Commissioner Richards, seconded by Ccmmissioner Downs,
approving the findings as presented by staff. Carried 3-0.
Moved by Commissioner Richards, seconded by Commissioner Downs,
adopting Planning Commission Resolution No. 1455, denying CUP 90-10.
Carried 3-0.

Commissioner Richards ccmmented on the length of this meeting in
comparison to the last couple of meetings and suggested that staff
schedule agenda items more evenly.

adjourning the meeting. Carried 3-0. The meeting was adjourned at
7:40 p.m.
