CALL TO ORDER Vice Chairman Richards called the meeting to order at 7:00 p.m. II. PLEDGE OF ALLEGIANCE Commissioner Erwood led in the pledge of allegiance. III. ROLL CALL Members Present: Jim Richards, Vice Chairman Bob Downs (arrived after item B) Rick Erwood Sabby Jonathan Members Absent: Carol Whitlock, Chairperson Staff Present: Ray Diaz Kandy Allen Joe Gaugush Tonya Monroe IV. APPROVAL OF MINUTES: +rrr+ Consideration of the November 6, 1990 meeting minutes. Action• Moved by Commissioner Jonathan, seconded by Commissioner Erwood, approving the November 6, 1990 meeting minutes as submitted. Carried 3-0. V. SUMMARY OF COUNCIL ACTION Mr. Diaz summarized pertinent November 8, 1990 council action. VI. CONSENT CALENDAR None. VII. PUBLIC HEARINGS A. Continued Case No. PP 89-5 - DR. S.C. SHAH, Applicant Request for approval of an amendment to an approved precise plan of design for a 19, 750 square foot office building at the MINUTES PALM DESERT PLANNING COMMISSION NOVEMBER 20, 1990 southwest corner of Highway 111 and Lupine. ewe The request was withdrawn by the applicant. Action: No further commission action was needed. B. Continued Case Nos. PM 90-20, PM 26609, VAR 90-7 - NELCON INC. , Applicant Request for approval of a precise plan of design, parcel map and variance to the minimum lot size limit and negative declaration of environmental impact as it pertains thereto for an 11 unit apartment project and proposal to resubdivide the recently merged property into 3 lots, one of which will be below the 10, 000 square foot minimum for the R-3 zoned property at the northeast corner of Abronia Trail and Sunset Lane. The request was withdrawn by the applicant. Action• No commission action was needed. C. Case No. CUP 90-22 - CLAUDIA HAMBURGER, Applicant Request for approval of a conditional use permit to allow an outdoor magazine and newsstand located at the northwest corner of San Pablo and Highway 111/Palm Desert Drive. Mr. Diaz outlined the salient points of the project and recommend approval . Commission and staff discussed architectural review, traffic circulation and future super block improvements. Vice Chairman Richards opened the public testimony and asked if the applicant wished to address the commission. 2 MINUTES PALM DESERT PLANNING COMMISSION NOVEMBER 20, 1990 MR. GIL CHAPMAN AND MS. CLAUDIA HAMBURGER, Applicants, were present to discuss the project. Mr. Chapman explained that they would be offering between 700 to 1, 000 international and domestic magazine and newspaper titles. He explained that the newsstand would be placed against the wall as a freestanding structure under the awning. He also noted that this would take approximately two and a half feet from the existing nine to nine and a half feet of sidewalk. Mr. Gaugush of the public works department indicated that was sufficient clearance. Upon questioning by Commissioner Erwood, Mr. Chapman explained that the newsstand would be secured and locked to look solid, similar to restaurants. Following further discussion, commission expressed concern regarding the proposed location, ingress and egress from San Pablo, and lack of two-way traffic. Commission felt an area on El Paseo or a more pedestrian oriented area would be more suitable. Vice Chairman Richards expressed concern regarding a percentage of right-of-way being used and the project not being part of a building. After more discussion with the applicant, commission determined a continuance would be appropriate to look at other alternative sites. Mr. Chapman *MW concurred with a two-week continuance and requested assistance in selecting a location. Commission directed staff to help Mr. Chapman in this endeavor. Action: Moved by Commissioner Downs, seconded by Commissioner Jonathan, continuing CUP 90-22 to December 4, 1990. Carried 4-0. D. Case No. ZOA 90-3 - CITY OF PALM DESERT, Applicant Request for approval of a zoning ordinance amendment relating to signs, Section 25. 68. Mr. Diaz outlined the salient points of the staff report and recommended approval . After further clarification as to the type of signs that would be allowed by the amendment, Vice Chairman Richards o ened the public testimony and asked if anyone present wished to speak 3 %WW MINUTES PALM DESERT PLANNING COMMISSION NOVEMBER 20, 1990 in FAVOR or OPPOSITION to the proposal . There was no one and the public testimony was closed. wry Action: Moved by Commissioner Downs, seconded by Commissioner Erwood, approving the findings as presented by staff. Carried 4-0. Moved by Commissioner Downs, seconded by Commissioner Erwood, adopting Planning Commission Resolution No. 1482, recommending approval of ZOA 90-3 to city council . Carried 4-0. VIII. MISCELLANEOUS None. IX. ORAL COMMUNICATIONS None. X. COMMENTS None. XI. ADJOURNMENT Moved by Commissioner Downs, seconded by Commissioner Richards, adjourning the meeting. Carried 4-0.
