I. CALL TO ORDER
Chairperson Whitlock called the meeting to order at 7:03 p.m.
II. PLEDGE OF ALLEGIANCE
Chairperson Whitlock led in the pledge of allegiance.
III. ROLL CALL

IV. APPROVAL OF MINUTES:
Consideration of the December 4, 1990 meeting minutes.
Action:
Moved by Commissioner Jonathan, seconded by Commissioner
Downs, approving the December 4, 1990 meeting minutes as
submitted. Carried 3-0-1 ( Commissioner Erwood abstained) .
V. SUMMARY OF COUNCIL ACTION
Mr. Diaz summarized pertinent December 13, 1990 council
actions.
VI . CONSENT CALENDAR
A. Case No. TT 25436 - THOMAS SCHMIDT, Applicant
Request for a first one year time
extension for a 37 single lot project
located at the northwest corner of Hovley
and Carlotta.

Richards, approving the consent calendar by minute motion.

VII. PUBLIC HEARINGS
A. Continued Case No. CUP 90-22 - CLAUDIA HAMBURGER,
Applicant
Request for approval of a conditional use
permit to allow an outdoor magazine and
newsstand located at the northwest corner
of San Pablo and Highway 111/Palm Desert
Drive.
Mr. Drell explained that staff was instructed at the last
meeting to work with the applicant and that afternoon they had
met with Mr. Fox and Mr. Chazan. He indicated that there was
still some negotiation to be worked out and recommended a
continuance to January 15 and the noticing of a second
conditional use permit hearing for the new site to allow time
for a lease agreement to be made.
Chairperson Whitlock opened the public testimony and asked the
applicant to address the commission.
MR. GIL CHAMPION noted that certain architectural
details, pest control, trash requirements would have to
be met, but did not feel there were any major stumbling
blocks and would do their best to reach a satisfactory
arrangement.
Chairperson Whitlock asked if anyone wished to speak in FAVOR
or OPPOSITION to the project. There was no one and the public
testimony was closed.

Moved by Commissioner Downs, seconded by Commissioner
Richards, continuing CUP 90-22 to January 15, 1991 . Carried
5-0.

B. Case No. TT 26068 - WESTINGHOUSE DESERT COMMUNITIES,
Applicant
Request for approval of a 35 lot single
family subdivision in the southern portion
of Bighorn Country Club - southwest of
Highway 74 and Cahuilla Way.
Mr. Joy outlined the salient points of the staff report and
recommended approval subject to the addition of the condition
stating that "any development standard applied to the hillside
estate lots in the implementation agreement shall also apply
to the estate lots identified on the map. " He noted that
council authorized 27 estate lots in the original open space
area of the Bella Vista plan and any standards applied to
those 27 lots in the future would also apply to these 12 lots
on this map.
Commission and staff discussed the number of units allowed,
the development agreement, and history of the property.
Chairperson Whitlock opened the public testimony and asked if
the applicant wished to address the commission.
MR. DAVID GRAHAM informed commission he was present to
answer any questions and supported the staff
recommendation.
Chairperson Whitlock asked if anyone wished to speak in FAVOR
or OPPOSITION to the project. There was no one and the public
testimony was closed.
Action:
Moved by Commissioner Downs, seconded by Commissioner
Richards, approving the findings as presented by staff.
Carried 5-0.
Moved by Commissioner Downs, seconded by Commissioner
Richards, adopting Planning Commission Resolution No. 1486,
approving TT 26068, subject to conditions as amended. Carried
5-0.
C. Case Nos. PP 90-25/PM 26702 - SMITH PARTNERS, Applicants
Request for approval of a negative
declaration of environmental impact, a
parcel map splitting 1 . 33 acres into four

individual parcels, and a precise plan to
allow construction of four freestanding
concrete tilt-up industrial buildings on
individual parcels at 42-060 Beacon Hill .
Mr. Winklepleck outlined the salient points of the staff
report.
Commissioner Jonathan expressed concern regarding parking and
conversion of warehouse uses to offices. Mr. Winklepleck
explained that these uses are monitored through the business
license/certificate of use process.
Chairperson Whitlock o ened the public testimony and asked the
applicant to address the commission. There was no one
present. Chairperson Whitlock asked if anyone present wished
to speak in FAVOR or OPPOSITION to the project. There was no
one. Chairperson Whitlock closed_ the public testimony and
asked for commission comments
Commissioner Downs asked if someone representing the applicant
was present. There was no one. Per commission policy, he
recommended a continuance. Commission concurred. Chairperson
Whitlock reopened the public hearing. Jr

Moved by Commissioner Downs, seconded by Commissioner
Richards, continuing PP 90-25/PM 26702 to January 15, 1991 .
Carried 5-0.
VIII. MISCELLANEOUS
A. Palm Lakes Golf Course fencing adjacent to residential
rear yards on Gary Avenue.
Mr. Drell outlined the salient points of the issue. After
extensive discussion between commission, staff and the
residents, planning commission adopted the minute motions as
amended. Commissioner Richards also assured residents with
existing fences that they would be fixed.
Action:
Moved by Commissioner Downs, seconded by Commissioner
Richards, approving by minute motion the shared cost steel
fencing offer with homeowners contributing a maximum of $5 per
foot. Carried 5-0.

Moved by Commissioner Downs, :seconded by Commissioner
Richards, affirming by minute motion that rear yard fencing
%No need not be uniform as long as there is cooperation between
the golf course and homeowners in fence and perimeter
landscape design. Carried 5-0.
IX. ORAL COMMUNICATIONS
MR. THOMAS SCHMIDT, 75-701 Easy Street, President of the
Building Industry Association of the Desert, thanked Mr. Diaz
and Mr. Gaugush for their assistance with the model tour
signage program.
X. COMMENTS
Mr. Diaz noted that the next meeting would be January 15,
1991 .
XI. ADJOURNMENT
Moved by Commissioner Downs, seconded by Commissioner
Richards, adjourning the meeting to January 15, 199 Carried
r.. 5-0. The meeting was adjourned at 8:05 p.m.
