CALL TO ORDER Chairperson Whitlock called the meeting to order at 7:01 p.m. II. PLEDGE OF ALLEGIANCE Commissioner Downs led in the pledge of allegiance. III. APPROVAL OF MINUTES: Consideration of the July 2, 1991 meeting minutes. Action: Moved by Commissioner Downs, seconded by Commissioner Richards, approving the July 2, 1991 meeting minutes as submitted. Carried 3-0-1 (Commissioner Jonathan abstained) . V. SUMMARY OF COUNCIL ACTION Mr. Diaz summarized pertinent July 11, 1991 city council actions. VI. CONSENT CALENDAR A. Case No. TT 24214 - DEVELOPMENT 2000, Applicant Request for approval of a first one year time extension for a tentative tract map, 16 lot residential subdivision on the north side of Country Club Drive, 700 feet east of Portola. MINUTES PALM DESERT PLANNING COMMISSION JULY 16, 1991 Action• Moved by Commissioner Downs, seconded by Commissioner Jonathan, approving the consent calendar by minute motion. Carried 4-0. VII . PUBLIC HEARINGS A. Continued Case No. PP/CUP 89-3 Amendment and PM 26994 - CUSACK RADAKER DEVELOPMENT INC. , Applicant Request for approval of a precise plan/conditional use permit amendment and parcel map for a 70, 000 square foot office/restaurant complex on 4. 7 acres at the southeast corner of E1 Paseo and Highway 111 . Mr. Winklepleck noted that this case had been continued from the last meeting to allow the applicant and staff to study access, the frontage road and the project ' s effect on the property to the east. Mr. Safavian indicated that three scenarios were included in the staff report. He stated that staff and the applicant had worked out a scenario that was similar to scenario 2 in the staff report. He described the proposed scenario and + indicated that there would be a right-turn in, right-turn out Highway 111 access; access from the frontage road to El Paseo would be eliminated; two-way traffic along the existing frontage road for property to the east would be allowed; no access would be allowed from Panorama; access would be available to E1 Paseo. He indicated that this would be the solution in the short-term. In the long-term when the property to the east fully development, the frontage road would be completely eliminated. Commission and staff discussed aspects of the scenario and commission concurred with the presentation. Chairperson Whitlock opened the public testimony and asked if the applicant wished to address the commission. MR. BILL CUSACK, applicant, stated that he was present to answer any questions. 2 MINUTES PALM DESERT PLANNING COMMISSION JULY 16, 1991 Chairperson Whitlock asked if anyone wished to speak in FAVOR or OPPOSITION; there was no one and the public testimony was closed. Commissioner Downs felt his questions were answered and that a good job was done. Commissioner Richards concurred. Action: Moved by Commissioner Downs, seconded by Commissioner Richards, approving the findings as presented by staff. Carried 4-0. Moved by Commissioner Downs, seconded by Commissioner Richards, adopting Planning Commission Resolution No. 1523, approving PP/CUP 89-3 Amendment and PM 26994, subject to conditions. Carried 4-0. B. Case No. CUP 91-11 - MAPLE LEAF PLUMBING, Applicant Request for approval of a Negative Declaration of Environmental Impact and conditional use permit to allow conversion and remodel of existing apartments to office use at 44-865 Santa Ynez Avenue. Mr. Winklepleck outlined the salient points of the staff report and noted that two letters were received in support of the project, none in opposition. Staff recommended approval . Commission and staff discussed window treatments. Mr. Winklepleck indicated that the applicant would be willing to eliminate the windows. Chairperson Whitlock suggested clerestory windows that would allow light in, but would be too high to see out. Chairperson Whitlock opened the public testimony and asked if the applicant wished to address the commission. MR. RANDALL WILLIAMS, applicant, indicated that he was in agreement with the commission regarding the windows. He stated that there were two windows facing the residential area, one that was of obscured glass for a restroom and one that would be for a break room. 3 MINUTES PALM DESERT PLANNING COMMISSION JULY 16, 1991 Commission felt the windows would be acceptable provided they were clerestory and/or obscured glass. The applicant concurred. Action: Moved by Commissioner Downs, seconded by Commissioner Jonathan, approving the findings as presented by staff. Carried 4-0. Moved by Commissioner Downs, seconded by Commissioner Jonathan, adopting Planning Commission Resolution No. 1524, approving CUP 91-11, subject to conditions as amended. Carried 4-0. C. Case No. PM 27044 - SMJ DEVELOPMENT, Applicant Request for approval of a lot subdivision within an approved project at the end of Caroline Court. Mr. Diaz outlined the salient points of the staff report. He indicated that a condition should be added that a mutual access and parking agreement approved by the City of Palm Desert shall be recorded with the final map. Staff recommended approval subject to conditions as amended. Chairperson Whitlock opened the public testimony and asked if the applicant wished to address the commission. MR. VICTOR VILLENEUVE, project engineering, stated that he was present to answer questions. He noted that drainage and signalization fees had been collected with Precise Plan 90-2 and the public works condition requiring payment again should be waived. Mr. Diaz concurred that fees would not be paid twice and indicated that the words, "unless fees have been paid" would be added to the appropriate condition. Mr. Villeneuve noted that this would be recorded with Precise Plan 90-2. Mr. Diaz stated that he would like it recorded with the parcel map also. 4 MINUTES PALM DESERT PLANNING COMMISSION JULY 16, 1991 Mr. Villeneuve also indicated that all the lots have approved right-of-way. low Mr. Diaz indicated that he would also like this to be recorded. Chairperson Whitlock asked if anyone wished to address the commission in FAVOR or OPPOSITION; there was no one and the public testimony was closed. Moved by Commissioner Downs, seconded by Chairperson Whitlock, adopting Planning Commission Resolution No. 1525, approving PM 27044, subject to conditions as amended. Carried 3-0-1 (Commissioner Jonathan abstained) . D. Case No. PM 27082 - JOHN HOOTEN, Applicant Request for approval of a four lot industrial subdivision northeast of Sheryl and Cook Streets. low Mr. Diaz outlined the salient points of the staff report and indicated that access would be provided by the common access road to the rear of the project; no access would allowed onto Cook Street and the applicant concurred. Staff recommended approval . Chairperson Whitlock opened the public testimony and asked the applicant to address the commission. MR. LARRY SHANE, 74-040 Desert Star, informed commission that drainage and signalization fees had been paid and he wanted credit. Mr. Diaz explained that there was a difference because these parcels were vacant. He noted that at one time there was a master subdivision of these parcels and drainage fees were not in effect at that time. He indicated that if fees were had been paid, he would get credit for them. 5 MINUTES PALM DESERT PLANNING COMMISSION JULY 16, 1991 Mr. Shane indicated that they were working with the fire department on the emergency access and might have to make some changes with placement on the lot to comply with fire department requirements. Mr. Diaz indicated that if it did not work out, they would have to return to the planning commission. Chairperson Whitlock asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposal; there was no one and the public testimony was closed. Action: Moved by Commissioner Richards, seconded by Commissioner Downs, approving the findings as presented by staff. Carried 3-0-1 (Commissioner Jonathan abstained) . Moved by Commissioner Richards, seconded by Commissioner Downs, adopting Planning Commission Resolution No. 1526, approving PM 27082, subject to conditions as amended. Carried 3-0-1 (Commissioner Jonathan abstained) . VIII. MISCELLANEOUS A. Case No. RV 91-2 - JAMES ARMSTRONG, Applicant Request for adoption of a resolution of approval to allow parking of a recreational vehicle in the front yard area at 72-868 Skyward Way. Staff explained that at the last meeting planning commission instructed staff to prepare this resolution of denial . He noted that the matter had been appealed and would be going to city council. Action• Moved by Commissioner Downs, seconded by Commissioner Richards, approving the findings as presented by staff. Carried 4-0. Moved by Commissioner Downs, seconded by Commissioner Richards, adopting Planning Commission Resolution No. 1527, approving RV 91-2. Carried 4-0. 6 MINUTES PALM DESERT PLANNING COMMISSION JULY. 16, 1991 IX. ORAL COMMUNICATIONS wow None. X. COMMENTS Commissioner Downs noted that Mr. Armstrong' s recreational vehicle was exactly what the committee was looking for when it recommended the ordinance. Commissioner Richards requested and received a follow-up from staff on the status of the landscaping replacement and maintenance issue. XI. ADJOURNMENT Moved by Commissioner Downs, seconded by Commissioner Richards, adjourning the meeting to the next regular meeting date of August 6, 1991. Carried 4-0.
