Case No. CUP 89-15 - KENT ATTRIDGE for the Armenian Apostolic Church of the Desert, Applicant Request for approval of a second one-year time extension to allow a church facility on 4.7 acres on the south side of hovley Lane, 2300 feet east of Monterey Avenue. r... MINUTES PALM DESERT PLANNING COMMISSION MARCH 17, 1992 B. Case No. TT 24866 - SOUTHWEST PARTNERS, Applicant Request for approval of a four year time �M' extension to allow four homesites and open space on 8. 24 acres located on the west side of the Palm Valley Storm Channel across from Sommerset Condominiums. ( Staff recommended a one year extension be granted be state law. ) C. Case No. PMW 92-1 - CULTURAL CENTER BUILDING PARTNERSHIP, Applicant Request for approval of a parcel map waiver to combine lots 9 through 12 into one to allow for an office building on Fred Waring Drive. Commission concurred with staff that a one year time extension for TT 24866 was acceptable. Action: Moved by Commissioner powns, seconded by Commissioner Jonathan, approving the consent calendar by minute motion. Carried 3-0. � VII. PUBLIC HEARINGS Staff requested that item G be heard first since a continuance was being requested. Commission concurred. G. Case No. C/Z 92-1 - CITY OF PALM DESERT, Applicant Request for a recommendation of approval to the city council of the prezoning of parts of Sections 19, 20 and 29 T4S R6E to PC(3 ) (regional commercial ) , SI ( service industrial ) and PCD (planned community development) and a negative declaration of environmental impact as it pertains thereto. 2 � MINUTES PALM DESERT PLANNING COMMISSION MARCH 17, 1992 Mr. Diaz recommended opening the public hearing and continuing this case to April 21, 1992. Continued Case No. PP 91-14 - SCHMZTZ/ANDERSON ENTERPRISES, Applicant Request for approval of a precise plan ta allow construction of a seven unit apartment complex at 44-555 San Rafael Avenue in the R-3 S.O. zone. Mr. Winklepleck reviewed the history of the case and outlined the salient points of the staff report. He noted that the architectural commission granted preliminary approval . Staff recommended approval . Commissioner Jonathan asked if staff was incorporating the � Water and Services District conditions. Mr. Winklepleck replied yes. Vice Chairperson Richards o ened the public testimony and asked the applicant to address the commission. MR. HARRY SCHMITZ, applicant, stated that he took into consideration commission' s comments when designing this project and noted that a letter from the neighbor had been submitted in favor. He indicated that the project was reduced to seven units and requested approval . Vice Chairperson Richards asked if anyone wished to address the commission in FAVOR or OPPOSITION to the proposal . There was no one and the public testimony was closed. Action• Moved by Commissioner powns, seconded by Commissioner Jonathan, adopting the findings as presented by staff. Carried 3-0. 3 i... MINUTES PALM DESERT PLANNING COMMISSION MARCH 17, 1992 Moved by Commissioner powns, seconded by Commissioner Jonathan, adopting Planning Commission Resolution No. 1559 , approving PP 91-14, subject to conditions. Carried 3-0. � B. Continued Case No. PP 92-1 - JAMES FETRIDGE (FOR JAMES PALMER) , Applicant Request for approval of a 7945 square foot two-story office complex located in an office professional zone on the west side of Monterey Avenue, 1000 feet south of Fred Waring Drive. Mr. Smith reviewed the history of the case. He indicated that the applicant received preliminary architectural commission approval on February 25 and recommended approval, sub�ect to the conditions as amended. Commissioner Jonathan informed commission that he would be abstaining. Vice Chairperson Richards opened the public testimony and asked the applicant to address the commission. The applicant was not present. Commissioner powns indicated that he would move for a continuance of two weeks. �► Action• Moved by Commissioner powns, seconded by Vice Chairperson Richards, continuing PP 92-1 to April 7, 1992 by minute motion. Carried 2-0-1 (Commissioner Jonathan abstained) . C. Case No. CUP 92-1 - PALM DESERT OASIS SEVENTH DAY ADVENTIST CHURCH, Applicant Request for approval of a conditional use permit for a 50,000 square foot church and school facility on 4.7 acres on the north side of Country Club Drive 800 feet east of Portola Avenue. Mr. Drell outlined the salient points of the staff report. He indicated that public works condition no. 11 should be amended and recommended approval, sub�ect to �hose conditions. 4 � MINUTES PALM DESERT PLANNING COMMISSION MARCH 17, 1992 Commissioner Jonathan noted there was no outside play area. Mr. Drell indicated there was an indoor gymnasium. ''r' Commissioner Jonathan noted that parking calculated at 152 spaces was deemed adequate or in compliance with the ordinance; with a 456 seat church, he did not feel there was adequate parking on important holidays. He asked if there were any accommodations for overflow parking; Mr. Drell stated that the code calls for one parking place for every three seats and it assumed that on big holidays people would come together as families to church and on average that number was sufficient. Commissioner Jonathan felt that there would probably be occasional problems. He also asked if there was provision for a deceleration lane going west on Country Club; Mr. Holtz indicated there was a public works department condition no. 8 that required it. Vice Chairperson Richards noted a concern that the building was large and was concerned that for a child care facility there was no place for them to be outside. He indicated that child care facilities have a lot of pick ups and drop offs. Mr. Drell indicated that this was a fully operating school and it had drop off area in front. Commissioner Jonathan asked if there were any access points other than Country Club considered. Mr. Drell replied that � staff didn't and in the long-term there could be an alternate access because the city owns property to the east and north and ultimately when that was developed, depending on what was developed, an access could be developed. Vice Chairperson Richards opened the public testimony and asked the applicant to address the commission. NEWMAN FARLEY, pastor of the church, noted that the • church was probably known by Loma Linda University, which was part of the sisterhood of the school they were in and their church organization. He stated that in this community there were many health personnel who had graduated from that university and serve the community. He indicated that the reason for the existence for their church was to create leadership within the community for people who would serve the community. He stated that there were several individuals present to address the commission in favor of the project. 5 �... MINUTES PALM DESERT PLANNING COMMISSION MARCH 17, 1992 Commissioner Jonathan asked about the parking situation; Mr. Farley replied that they had 220 members at the present time and their concept of church was family and so their proposal � was to keep the church small. They also had other churches in the area: Palm Springs, Desert Hot Springs, Indio, and Thermal. He said that the largest congregation they anticipated would be 400 members. He noted that their worship was on Saturday, so their membership number was usually smaller. Commissioner powns asked him about anticipated parking for 400 members; Mr. Farley stated that the parking was calculated at one parking space per three people. Their people would come as families and felt the parking provided would represent the 400 people coming to their congregation. Mr. Diaz noted that in no case was the church parking established based on the highest holy days of that church. The one to three ratio was designed for the whole year. He indicated that shopping malls were not designed for Christmas or Easter holidays. He stated that there had not been any parking problems reported for any churches already approved. Commissioner Jonathan indicated that he was not suggesting that the standard be changed or more parking be incorporated into the project, but the difference for now was that other churches/temples were in a more built-out location and they make arrangements with neighboring facilities for the overflow r of parking and right now that was not available. Mr. Diaz stated that he did not feel there would be a problem here and the standards would meet the requirements. Vice Chairperson Richards asked if the day care facility would be restricted in any way; Mr. Farley indicated that this was not something the church originally conceived of, but originated from the city offices, but was a felt need in the community. He noted that this facility would be open to the public. Mr. Drell clarified that there would be 70 child care positions and 150 students in the academy. He stated that those figures were calculated within the traffic counts. Mr. Farley stated that Mr. Johnson, their civil engineer; Mr. Nelson; and Marian Katts, Director of Nursing at C.O.D. were present to speak about the project. MR. LARRY JOHNSON, civic engineer, 73-255 Desert Rose Drive in Palm Desert. He indicated that the street improvement w,.. plans were designed and approved showing the deceleration � lane and they had kept the entrance at the same place. He said that when the tracts were done they had to stand on their own and blend in with the others, which made the I church compatible. He indicated that this was one of the ; two entrances onto Country Club for the entire piece, iexcluding the Smallwood and Stoltzman pieces. � Vice Chairperson Richards asked if anyone wished to address the commission in OPPOSITION to the project. There was no one ; and the public testimony was closed. ' Commissioner Jonathan commented to staff that the day care and � school would have people not just from Palm Desert involved � in the traffic and they would be using the Monterey interchange, which he felt was inadequate. He urged staff to expedite the Cook Street interchange. Case No. PM 27136 - J.M. WILSON � ASSOCIATES, Applicant Request for approval of a parcel map to divide an existing 18, 354 square foot lot, located on the east side of McLachlin Circle, in Avondale Country Club into two lots each having 9, 177 square feet and minimum lot frontage of 89 feet. Mr. Smith outlined the salient points of the staff report and recommended approval, subject to the conditions. He noted 7 rr.+ MINUTES PALM DESERT PLANNING COMMISSION MARCH 17, 1992 that the proposal was a class 15 categorical exemption for the purposes of CEQA and no further documentation was necessary. ari Commissioner powns asked if staff would still be in favor of the project even with all the letters in opposition; Mr. Smith stated that he believed staff would have to be in favor because it complied with all aspects of the ordinance. Mr. Diaz stated that this was the first case coming in from the newly annexed area and indicated that he urged the homeowners association of the Avondale Homeowners Association to revise their CC&R' s, noting that while the city could not enforce them, we would cooperate with them and they would have grounds for a civil action. Vice Chairperson Richards noted that across the street there were lots the same size; in the other direction lots were much bigger. He indicated that this met the general plan for minimum lot size. He also stated that the commission always takes public testimony under strong consideration, but this was a difficult decision and there would have to be reasons not to approve the application. Mr. Hargreaves stated that he would need time to review the ordinance. Commissioner powns indicated that he would prefer that the city attorney get back to commission and give the homeowners a chance to get together and possibly resolve this. � Vice Chairperson Richards opened the public testimony and asked the applicant to address the commission. MR. PAUL SEVAY, Wilson Engineering in Upland, stated that they did the engineering for the lot split and noted that the owner was also present. He asked if commission had any questions. Vice Chairperson Richards asked the owner to address the commission. � MR. RON CORN, owner, 38-900 Kilimanjaro in Avondale, addressed the commission. He stated that it was his intention to divide the lot as shown and build quality homes that would exceed the size of the homes across the street and within the interior of the circle, there were six dwelling units of larger sizes from 3, 000 to 3, 500 square foot homes. He said that the houses directly 8 � MINUTES PALM DESERT PLANNING COMMISSION MARCH 17, 1992 across the street were 2, 300 to 2, 500 square foot homes, some possibly larger. He did not feel the development � of his two parcels would be detrimental . Vice Chairperson Richards asked if anyone wished to address the commission in FAVOR or OPPOSZTION to the proposal . MR. LARRY KELFER, a McLachlin resident, stated that he was delighted that Avondale was now part of Palm Desert. In the regard to the division of the lot, he felt there was strong opposition because lot one in question would be triangular and lot two would be rectangular. He agreed that the CC&R' s should be changed. He stated that if this was approved, and knowing the homes in the area, then Mr. Corn could build homes 1, 500 square feet. He felt this was small and would change the character of the area. Vice Chairperson Richards asked if Mr. Kelfer would be in favor if the applicant was required to build a specific size of home. Staff indicated that if a minimum was established, it should be 2, 500 square feet. Mr. Kelfer said that would mean a great deal to him. He indicated that he bought a home in this area because of the large lots and he had over a third of an acre. He noted that some of the letters of opposition were from residents who have acreage who did not want to � divide. He said they did not want any division of the existing lots. They built expensive homes, maintained expensive landscapings and felt this was the Beverly Hills section of Avondale. He felt they were unique in that they were in a circle and off the circle was Blossom Lane where Mr. and Mrs. Thompson �ust completed a 4,000 square foot home. Diagonally across from Mr. Corn' s area there was a new home of 3, 600 square feet beginning in two or three weeks. He felt these were magnificent homes and architecturally interesting. Commissioner Jonathan asked if there was an architectural review committee within their association. Mr. Kelfer replied yes. Commissioner Jonathan noted that Mr. Kelfer' s concerns were size and appearance, so the aesthetics would be taken care of by their architectural committee. On the size, commission could add in a condition with a minimum size home of 2, 500 square feet and Commissioner Jonathan asked if that would address Mr. Kelfer's. Mr. Kelfer answered not completely. He noted that there were homes being built in 9 �.. MINUTES PALM DESERT PLANNING COMMISSION MARCH 17, 1992 the $1 million range and smaller homes would depreciate the value of the properties. � MS . SUE SHOEMAN, resident of Lot No. 112 and owner of Lot No. 113. She felt that the continuity of McLachlin Circle would be missed if the lots were divided. The homes to the west were smaller, but the ones inside the circle were nice sized lots. She felt it would not be the same to have two smaller lots and homes. Vice Chairperson Richards stated for the record that there were 19 letters of opposition. Mr. Sevay indicated that there was one ob�ection to a condition of approval that required full public improvements to city standards. The area did not have any curb and gutters and was privately maintained by the homeowners association and they objected to putting in the curb and gutter. It would not fit aesthetically and did not feel it would be agreeable to the homeowners association. Mr. Diaz noted that there were also private street standards that would have to be met and in some cases curb and gutter was not required if it was not already in the area. Mr. Diaz said that the condition would stand as it is and in this case there would be private street standards with a rolled curb w/ similar to what was there. Mr. Sevay stated they would not object to that. Commissioner powns noted that 19 out of 25 people objected to the lot division and asked Mr. Corn if there was any way he could be persuaded to change his plan or get together with them to reach an agreement. Mr. Corn stated that he would like the parcels split into two and did not know what they would have to discuss. The two parcels were well within the square footage allowed. Vice Chairperson Richards asked staff what staff would suggest. Mr. Smith stated that he looked at the triangular lot and placed the typical setbacks of 20' in the front, 20 ' in the rear, and a combination of 20' on the sides. He said it left 2, 800 square feet of buildable area for a dwelling 10 w MINUTES PALM DESERT PLANNING COMMISSION MARCH 17, 1992 and garage. The swimming pool could go in the setback area, so that was not a problem. •.. Mr. Corn indicated that he did not have a problem with a 2, 800 square foot minimum for these houses and he planned to build quality homes. He said that he lived there and he would not build something that was detrimental . Vice Chairperson Richards closed the public hearing. Commissioner powns asked counsel if the requirement could be set at 2, 500 square feet. Vice Chairperson Richards noted he would take 2, 800; Commissioner powns stated that there would still have to have a garage. Mr. Diaz felt that since the applicant agreed on the record to accept 2, 800 square feet, there was no problem. Commissioner powns said that he was prepared to move for approval of the findings. Commissioner Jonathan stated that he could see the merits of both sides and felt there was not a lot of room for compromise; either the lot is split or it wasn' t. On one hand, as long as there was compliance with code and the requirements for approval of a parcel map, the owner has a right to do with his property what he deems fit; on the other hand it is within a development and a homeowners association r.. in which the CC&R' s don' t prohibit it. He felt that the compromise of a minimum size made sense, but would still result in a lot split. Mr. Diaz noted that the design of the house and how they are laid out on both lots and with the architectural committee reviewing it, there were things that could be done to make the lot look larger which they do have control over. He suggested that the architectural committee review it with the intent of designing the homes in the best manner. Vice Chairperson Richards stated that he could not remember an occasion like this where the request totally complied with the laws/ordinances and there was a lot of opposition. After further discussion, Vice Chairperson Richards stated that he would like the city attorney to make a determination. Mr. Hargreaves indicated that a two-week continuance would be sufficient time to review the ordinance. Mr. Sevay concurred with the continuance. 11 .... Case No. RV 91-5 - MR. ROBERT BARBOZA, Applicant Request for approval to park a recreational vehicle and a trailer in the front yard area at 74-691 Candlewood Street. Mr. Diaz indicated that in the case of the Candlewood application it was virtually impossible to screen the vehicles; therefore, staff was recommending denial and noted there were letters of opposition received. Vice Chairperson Richards opened the public testimony and asked the applicant to address the commission. MR. ROBERT BARBOZA stated that 1 ) he did not at any time sign or make an application for a permit as was stated. What he did do was go to the planning department and he talked to staff and showed a drawing of the property and the location of where he wanted to place a 22 foot trailer. Mr. Winklepleck was not able at that time to � locate the papers he needed to fill out. He said he would send them in the mail . Shortly thereafter he was in�ured and was in the hospital for disc surgery. He was released by Dr. Tamarisi on the 27th of last month from Eisenhower Medical Center. He asked who started this application, who did the leg work, etc. , because he did not know. • Mr. Diaz noted that Mr. Barboza was cited for not meeting the reguirement for recreational vehicle ordinance, as well as the trailer ordinance. Mr. Diaz noted that there was a hearing in his office on this matter and he indicated that they could start all over again, but the bottom line was that Mr. Barboza was in violation of the city' s ordinances and he did not have a permit. He had to apply for one. Mr. Diaz said that he did not want Mr. Barboza to go through a useless act, but he did not see how Mr. Barboza could adequately screen the trailer or recreational vehicle. He noted that he did not have a signed application. 12 � MINUTES PALM DESERT PLANNING COMMISSION MARCH 17, 1992 Mr. Barboza stated that he did not want to do anything that was against the area or his neighbors. He lived in �+ that home for eight years, he owned a recreational vehicle since 1971, and he had not ever had a problem with his recreational vehicle in all his years and did not want one now. As far as the report as to where the area could not be blocked off, he disagreed 100$. He said that it had been sprinklered and he had contacted Neel ' s Nursery for approximately 30 Japanese oleanders � to be planted through that area as a hedge, so he disagreed with the findings. He said there was only one recreational vehicle involved here--a 22 foot trailer. He indicated that the picture taken with the motor home on it was not a permanent part of the residence and happened to be parked there that one day and someone took a picture of it. He felt it was obvious that someone in that area was against it and went to a great deal of trouble to go through all of this. He noted that none of the letters received were from the immediate area, but the street behind him. He stated that the trailer would be moved and that should end it. He just wanted the commission to know what was going on. He again said that he did not make the application and did not know how this thing started. It was determined that a when a permit was requested, staff � did the work of getting together mailing labels, etc. Vice Chairperson Richards said that some clarification was still needed as to where Mr. Barboza could park his trailer. Mr. Diaz stated that he would go back and research the matter. Vice Chairperson Richards advised Mr. Barboza to contact Mr. Diaz later in the week to get things started and back on an even keel. Mr. Barboza stated that he was not trying to cause anyone any problems, he ,just wanted to do what was right. Mr. Diaz indicated that a continuance to April 21 would be appropriate so that he and Mr. Barboza could get together. Mr. Barboza stated that he would be happy to get together with Mr. Diaz and if he felt that at any time it could not be done properly, then other arrangements would be made. Mr. Diaz stated that he would give Mr. Barboza a call to set up the time. 13 �.... MINUTES PALM DESERT PLANNING COMMISSION MARCH 17, 1992 Vice Chairperson Richards asked if anyone wished to speak in FAVOR or OPPOSITION. � MR. DAVID HERETIA, 74-746 Candlewood, across the street and three houses down, stated that he and his wife were opposed to the recreational vehicle out front. He noted that about a year ago someone went down the street and instructed everyone to either screen the vehicles or get them off the street. He said they all did that and did not see any reason why this person should not do this also. He indicated that he would not have a problem if it were properly screened, but would have other questions if it were jus� a shrubbery screen. He stated that he has children and he did not want them getting into a trailer that they could get hurt in. He said that he had lived there six and a half years and felt the street had improved tremendously in those years. He noted that La Rocca was next to him and was being annexed into Indian Wells. He mentioned a problem with the apartments in that area also. Vice Chairperson Richards noted that there was a good plan established on how people could hide vehicles. Commissioner Downs stated that the reason the ordinance was adopted was because some council members did not want to see any motor homes, boats, recreational vehicles, etc. , in a private area in Palm Desert. This was the alternative and if anyone '� complains about a vehicle, the matter came to the commission for a decision. He stated that he has a boat and a recreational vehicle and he was lucky enough to have a half acre lot that was completely fenced and oleandered in and had no complaints that he knew of. He said that he had sympathy, but if it could not be screened properly, it would have to be moved. Vice Chairperson Richards called for a motion. Action: Moved by Commissioner powns, seconded by Commissioner Jonathan, continuing RV 91-5 to April 21, 1992 by minute motion. Carried 3-0. F. Case No. RV 92-1 - MR. & MRS. CARLO TOZI, Applicant Request for approval to park a recreational vehicle in the front yard 14 � MINUTES PALM DESERT PLANNING COMMISSION MARCH 17, 1992 area on private property at 72-920 Homestead Road. �. Mr. Diaz felt this case could be screened with increased planting and a gate across the front similar to the other one commission approved. Staff recommended approval . Mr. Diaz also noted that letters of opposition had been received. He believed that with the increased planting and the solid gate in the front, the use was acceptable. Commissioner powns stated that the purpose of the ordinance was to allow residents to do this. Mr. Diaz also indicated that if people were willing to do this, they would be screening the vehicles. The alternative was that in terms of traffic regulations, people could park vehicles in the street for 72 hours and then moved. Staff recommended approval with the conditions listed in the report. Vice Chairperson Richards opened the public hearing and asked the applicant to address the commission. MR. AND MRS. CARLO TOZI, 72-920 Homestead, stated that he had lived there for 22 years. He said that he had a recreational vehicle parked on his cement driveway. The vehicle was solely on his property and he had bushes on both sides, but he was willing to increase them. He ..r indicated that he did not know how he could place a gate across a 20 foot driveway to shield a 12 foot high motor home. He noted that the motor home he was talking about cost approximately $100, 000 and would not be feasible to put it in a storage lot. He stated that he bought it new in 1988 and he had 46,000 miles on it and it was very seldom there. Commissioner powns stated that the gate would not have to be • 12 feet. He felt that a six foot fence would be high enough to hide it from the line of sight. He noted that it was on a double driveway and did not see any reason why a gate could not be installed. Mr. Tozi said that he could live with that. He noted that across the way was a condominium up on a knoll and there was no way to shield it from them. Vice Chairperson Richards indicated that this ordinance was a compromise and while some of the neighbors were saying that 15 .� MINUTES PALM DESERT PLANNING COMMISSION MARCH 17, 1992 the vehicle should be parked somewhere else, the city was saying that with proper screening it can be allowed. It was � noted that Commissioner powns was an active member on the committee that came up with this ordinance, which was after approximately 20 hours of ineetings. Vice Chairperson Richards indicated that what was finally arrived at was that if a reasonable attempt was made by the owner to cover part of the vehicle, that was the essence of the ordinance. Mr. Tozi said that he had no problem with that. Mr. Diaz indicated that a 12 foot gate would not be required; it would be five to six feet in height. Mr. Tozi said that even if they put in a regular gate there, it would have to be determined where to locate it, back by the motor home or in the front. Mr. Diaz clarified that it could be back by the motor home. He said that it should screen the motor home and also have it in a convenient place for Mr. Tozi to open and close it. It could be worked out with staff. Vice Chairperson Whitlock asked if anyone wished to speak in FAVOR or OPPOSITION to the request.
