Chairman Spiegel called the meeting to order at 7 : 00 p.m.
II • PLEDGE OF ALLEGIANCE
Commissioner Jonathan led in the pledge of allegiance.

IV. APPROVAL OF MINUTES:

Action:
Moved by Commissioner Jonathan, seconded by Commissioner
Beaty, approving the February 1, 1994 meeting minutes as
amended. Carried 3-0-1 (Commissioner Whitlock abstained) .
V. SUMMARY OF COUNCIL ACTION:
Mr. Diaz indicated no items pertained to planning commission
at the February 10, 1994 city council meeting.
VI . CONSENT CALENDAR
A. Case Nos . CUP 91-14 and VAR 91-5 - ROM DE GUZMAN,
Applicant
Request for approval of a one year time
extension of a conditional use permit
and variances to the setback
requirements of the R-3 zone to allow
construction of a 3055 square foot
professional office building located on
the north side of Alessandro Drive, 135

Beaty, approving the consent calendar by minute motion.

VII . PUBLIC HEARINGS
A. Case No. PM 27925 - LOWE ENTERPRISES, Applicant
Request for approval of a commercial
parcel map implementing conditions of an
approved precise plan for a 500,000
square foot retail commercial center at
the southwest corner of Fred Waring
Drive and Highway 111 .
Mr. Diaz said that this was a relatively minor alteration of
an already approved precise plan and tract map which was part
of a development agreement that the commission heard in 1992 .
Staff recommended approval .
Commissioner Jonathan asked what was meant by the rear pad
being eliminated because of marketing problems; Mr. Diaz
stated that they couldn't get anyone to locate in the back �
because of the visibility needed for commercial development.
Chairman Spiegel indicated that the staff report said that
the most notable variation involved the alignment of Painters
Path. Mr. Diaz explained that Painters Path would be
realigned and would stop at the wash; all properties to the
north that were west of the wash would have access to
Painters Path.
Chairman Spiegel opened the public testimony and asked the
applicant to address the commission.
MR. MICHAEL TANDY, Lowe Enterprises, 1318 E. 7th Street
Suite 200, Los Angeles 90015, stated that they concurred
with the staff report and were present to answer
questions .
Chairman Spiegel asked about the tenants that would be going
into the center; Mr. Tandy said that right now they had
Target, Marshalls, and T.J. Maxx--mostly large major anchor
stores; they were in the process of negotiating those leases
now.

""" Chairman Spiegel asked if anyone present wished to speak in
FAVOR or OPPOSITION to the proposal . There was no one and
the public testimony was closed.
Commissioner Whitlock said she was present when the original
plan was approved and she had no problem with the changes and
moved for approval .
Action:
Moved by Commissioner Whitlock, seconded by Commissioner
Jonathan, approving the findings as presented by staff.
Carried 4-0.
Moved by Commissioner Whitlock, seconded by Commissioner
Jonathan, adopting Planning Commission Resolution No. 1639,
approving PM 27925, subject to conditions . Carried 4-0 .

IX. ORAL COMMUNICATIONS

X. COMMENTS
1 . Commissioner Jonathan thanked staff for making
arrangements for a tour of the sewage treatment plant
which would take place March 1 at 2 :00 p.m.
Z . Mr. Diaz informed commission that a letter had been
received addressed to them regarding a dispute between
some property owners in the Palm Desert Property Owners
Association. He explained that it was under the purview
of the architectural commission and they were aware of
the situation and the Ietter would be referred to them.
