CALL TO ORDER Chairperson Campbell called the meeting to order at 6:04 p.m. II. ROLL CALL Members Present: Sonia Campbell, Chair Dave Tschopp, Vice Chair Connor Limont Mari Schmidt Van Tanner Members Absent: None Staff Present: Lauri Aylaian, Director of Community Development Bob Hargreaves, City Attorney Tony Bagato, Acting Principal Planner Ryan Stendell, Associate Planner Phil Joy, Associate Transportation Planner Tonya Monroe, Administrative Secretary III. PLEDGE OF ALLEGIANCE Chairperson Campbell led in the pledge of allegiance. IV. APPROVAL OF MINUTES Request for consideration of the April 17, 2007 meeting minutes. Action: It was moved by Commissioner Tanner, seconded by Commissioner Limont, approving the April 17, 2007 meeting minutes. Motion carried 5-0. V. SUMMARY OF COUNCIL ACTION Mr. Bagato summarized the pertinent April 26, 2007 City Council actions. MINUTES PALM DESERT PLANNING COMMISSION MAY 1, 2007 VI. ORAL COMMUNICATIONS None. VII. CONSENT CALENDAR A. Case No. VAR 06-02 - WILLIAM R. HANOUSEK, SR., Applicant Request for approval of a first one-year time extension of a variance to allow a reduction of the R-1 20,000 zone side yard setbacks from 15 feet to 8 feet on both side yards to allow the expansion and remodeling of a single family home on a 75-foot wide lot located at 45-644 Verba Santa Drive. Commissioner Tanner moved for approval. Commissioner Limont requested that the item be pulled from the Consent Calendar. She expressed concern about encroachments in established neighborhoods and if a variance was granted to allow development closer to neighboring homes, the height should also be reviewed. She requested that the item be pulled from the Consent Calendar to allow staff to provide the Commission with all the background information on this case when it was originally approved in 2006. Staff concurred and indicated that the information would be provided and the item would return on May 15 under the Miscellaneous Items agenda section. Ms. Aylaian advised that the Commission should vote to remove the item from the Consent Calendar, then discuss it as an item withheld from the Consent Calendar and then at that time make a recommendation. Commission concurred and Commissioner Tanner withdrew his original motion. Action: It was moved by Commissioner Limont, seconded by Commissioner Schmidt, withdrawing Case No. VAR 06-02 from the Consent Calendar and continuing it to the next meeting (May 15) by minute motion. Motion carried 5-0. VIII. PUBLIC HEARINGS Anyone who challenges any hearing matter in court may be limited to raising only those issues he, she or someone else raised at the public hearing described herein, or in written correspondence delivered to the Planning Commission at, or prior to, the public hearing. 2 MINUTES PALM DESERT PLANNING COMMISSION MAY 1. 2007 A. Case No. CUP 07-05 - ATHLETIC ADVANTAGE / LESLIE SHUFFLETON, Applicant Request for approval of a conditional use permit to operate a 140 square foot massage room within an existing exercise facility at 72-780 EI Paseo, Suite E4 (APN 640-160-028). Mr. Stendell reviewed the staff report and recommended approval, subject to the conditions contained in the draft resolution. Commissioner Tanner asked about the hours of operation. Mr. Stendell deferred the question to the applicant. There were no other questions and Chairperson Campbell o�ened the public hearing. MS. LESLIE SHUFFLETON with Athletic Advantage at 72-780 EI Paseo, Suite E4, expiained that the business is a personal training studio and she's the third owner in the suite in the last 15 years. She wanted to provide massage therapy, especially for her clients with multiple sclerosis. She has 14 people who come in that have multiple sclerosis and they receive training twice a week, as well as one massage every two weeks. The massage therapist was being brought in especially for those people, but would also be available to other clients. It would be by appointment and they were allotting an hour and a half for each hour of massage for prep and tear down. Ms. Shuffleton indicated that the massage therapist has been practicing at The Parker for 15 years, so she's already established in the desert and has a great reputation. As far as hours of operation, they would be by appointment only, but mainly between the hours of 6:00 a.m. to 7:00 p.m. Massages would typically follow a training session. Chairperson Campbell asked if they were open seven days a week. Ms. Shuffleton said they are closed on Sundays; Saturdays are by appointment and Saturdays are usually make-up sessions for people who miss during the week. The massage therapist might be more regular in the summertime on Saturdays. That hadn't been established yet and right now she works at The Parker a few 3 MINUTES PALM DESERT PLANNING COMMISSION MAY 1, 2007 weekends. In the summer traditionally business slows down and she could pick up clients on the weekends for people that work. Right now she didn't want to work on Sundays and it was by appointment. There were no other questions. Chairperson Campbell asked if anyone wished to speak in FAVOR or OPPOSITION to the proposal. There was no one and the public hearing was closed. Chairperson Campbell asked for Commission comments. Action: !t was moved by Commissioner Tschopp, seconded by Commissioner Tanner, approving the findings as presented by staff. Motion carried 5-0. It was moved by Commissioner Tschopp, seconded by Commissioner Tanner, adopting Planning Commission Resolution No. 2442 approving Case No. CUP 07-05, subject to conditions. Motion carried 5-0. B. Case No. TPM 35483 - GF COOK 8� I-10 INVESTORS, Applicant Request for approval of a tentative parce! map to subdivide a 1.42-acre lot into one parcel for condominium purposes at 75- 178 Gerald Ford Drive (APN 653-410-023). Mr. Stendell reviewed the staff report, noting a correction to Finding No. 8 of the draft resolution; he indicated the second sentence should be removed. With that change, he recommended approval of Case No. TPM 35483. Looking into the audience, he informed Commission that he didn't see the applicant. Commissioner Schmidt asked for clarification regarding the sale of each parcel or each unit. Mr. Stendell explained that the map was misleading. Those were units on the map, not physical parcels. The applicant could sell them individually or in combination. Commissioner Schmidt asked if the units could be subdivided into additional units. Mr. Stendell said yes; the use would remain the same, the amount of square footage would remain the same, and the amount of parking would remain the same. In his opinion nothing would be increased, so that ability was there. Commissioner Tanner informed them that if they look at some of the units currently under construction, condo units start at $210,000, so he thought it was just parceled out. Mr. Stendell thought best case scenario would be one; 4 MINUTES PALM DESERT PLANNING COMMISSION MAY 1, 2007 if two people got together and requested that it be chopped in half, that wouldn't be an issue to staff. Chairperson Campbell o�ened the public hearing, noted that no one was present in the audience to speak on behalf of the applicant or in FAVOR or OPPOSITION, closed the public hearing and asked for Commission comments. Action: It was moved by Commissioner Tschopp, seconded by Commissioner Tanner, approving the findings as amended by staff. Motion carried 5-0. It was moved by Commissioner Tschopp, seconded by Commissioner Tanner, adopting Planning Commission Resolution No. 2443 approving Case No. TPM 35483, subject to conditions. Motion carried 5-0. IX. MISCELLANEOUS None. X. COMMITTEE MEETING UPDATES A. ART IN PUBLIC PLACES Chairperson Campbell reported that the last meeting was informational. B. LANDSCAPE COMMITTEE Commissioner Connor reported on the issues discussed at their last meeting. C. PROJECT AREA 4 COMMITTEE Commissioner Conner noted that the next meeting would be in June. D. PARKS & RECREATION Commissioner Tanner reported on the items discussed at their last meeting. 5 MINUTES PALM DESERT PLANNING COMMISSION MAY 1. 2007 XI. COMMENTS Commissioner Schmidt asked for and received clarification that Case No. VAR 06-02 from the Consent Calendar would be on the next meeting agenda as a Miscellaneous item. XII. ADJOURNMENT It was moved by Commissioner Schmidt, seconded by Chairperson Campbell, adjouming the meeting by minute motion. Motion carried 5-0.
