HomeMy WebLinkAboutRes No 11PLANNING COMMISSION RESOLUTION NO. 11 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOM- MENDING APPROVAL TO THE CITY COUNCIL OF A REQUEST FOR AN AMENDMENT TO THE PALM DESERT INTERIM CORE AREA PLAN FROM HOTEL/MOTEL/EAT- ING/ENTERTAINMENT COMMERCIAL TO SERVICE COM- MERCIAL ON PROPERTY GENERALLY LOCATED SOUTH OF AVENUE 44, WEST OF THE PALM VALLEY STORM CHANNEL, AND NORTHEAST OF STATE HIGHWAY 111. CASE NO. INTERIM CORE AREA PLAN AMENDMENT - 01-74 WHEREAS, the Planning Commission did on the 30th day of September, 1974, hold a duly noticed public hearing to consider an amendment to the Palm Desert Interim Core Area Plan Land -Use Designation, filed by JOSEPH BLUMFELD, from Hotel/Motel/Eating/Entertainment Commercial to Service Com- mercial and to change the plan to show a neighborhood shop- ping center, on property generally located south of Avenue 44, west of the Palm Valley Storm Channel, and northeast of State Highway 111, and more particularly described as: a portion of the NW4 of the NW4 and the NE4 of the NW*, Section 19, T.5S., R.6E., S.B.B.&M. WHEREAS, said application has complied with the require- ments of the "City of Palm Desert Environmental Quality Pro- cedure Resolution Number 74-14", in that this amendment is considered an on -going project of the Interim Core Area Plan and is therefore, covered under the Negative Declaration given to the Interim Core Area Plan, and; WHEREAS, at said public hearing, upon hearing and consider- ing the testimony and arguments, if any, of all persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist which support the approval of the Interim Core Area Plan amendment: 1. The proposed amendment does insure the protection of the public health, safety, and general welfare. 2. Compatibility of the proposed amendment to the exist- ing and proposed development in the area. 3. Existing development adjacent to the site is already service commercial. Resolution No. 11 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That it does hereby recommend approval to the City Council of the requested Interim Core Area Plan amendment from Hotel/Motel/Eating/Entertainment Commercial to Service Commer- cial and a change in the plan design to show a neighborhood shopping center as shown on Exhibit A (Scheme 1), for the reasons set out in this resolution, PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning Commission, held on the 30th day of September, 1974, by the following vote, to wit: AYES: HUBBARD, MULLINS, SEIDLER, VAN DE MARK, WILSON NOES: NONE ABSENT: NONE ABSTAIN: NONE C. -ROBERT HUBBARD, Chairman ATTEST: UL A.
