HomeMy WebLinkAboutRes No 15PLANNING COMMISSION RESOLUTION NO. 15 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING APPROVAL TO THE CITY COUNCIL OF A REQUEST FOR AN AMENDMENT TO THE PALM DESERT INTERIM CORE AREA PLAN DELETING THE COVERED PEDESTRIAN WALKWAY SHOWN ON THE NORTH SIDE OF EL PASEO BETWEEN PORTOLA AVENUE AND SAN LUIS REY. CASE NO. INTERIM CORE AREA PLAN AMENDMENT - 02-74 WHEREAS, the Planning Commission did on the 14th day of Octo- ber, 1974, hold a duly noticed public hearing to consider an amend- ment to the Palm Desert Interim Core Area Plan, filed by H. A. McCormick, to change the plan by deleting a covered walkway shown on the north side of El Paseo between Portola and San Luis Rey, on property generally located north of the intersection of El Paseo and Prickly Pear Lane, and more particularly described as: Lot 21, Block S, Palm Desert Tract, SE4 of Section 20, T.5S., R.6E., S.B.B.&M. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Reso- lution Number 74-14", in that this amendment is considered an on- going project of the Interim Core Area Plan and is therefore, covered under the Negative Declaration given to the Interim Core Area Plan, and; WHEREAS, at said public hearing, upon hearing and considering the testimony and arguments, if any, of all persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist which support the approval of the Interim Core Area Plan Amendment: 1. The proposed amendment does insure the protection of the public health, safety, and general welfare. 2. Compatibility of the proposed amendment to the existing and proposed development in the area. 3. The circulation improvements recommended in the plan can be achieved by the existing walkway located 2 lots east and the proposed pedestrian passageway included in the plans for the new City National Bank project. 15 RESOLUTION NO. 4. Because of the existing development, the costs of the improvements would severely affect a single owner and render the remaining portion of the lot prohibitively expensive to develop. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1. That the above recitations are true and correct and con- stitute the findings of the Commission in this case. 2. That it does hereby recommend approval to the City Council of the requested Interim Core Area Plan amendment deleting the covered walkway on the north side of El Paseo between San Luis Rey and Portola, as shown on Exhibit A (Scheme 1), for the reasons set out in this resolution. PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning Commission, held on the 14th day of October, 1974, by the following vote, to wit: AYES: MULLINS, SEIDLER, VAN DE MARK, WILSON, HUBBARD NOES: NONE ABSENT: NONE ABSTAIN: NONE .
