A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS
AND RECOMMENDING TO THE CITY COUNCIL, APPROVAL OF A TEN-
TATIVE MAP TO ALLOW A 100-UNIT PLANNED RESIDENTIAL
DEVELOPMENT BY THE MARRAKESH BUILDING AND COUNTRY CLUB
ON 27 ACRES OF LAND, GENERALLY LOCATED WEST OF PORTOLA,
SOUTH OF GRAPEVINE STREET, AND NORTH OF HAYSTACK ROAD.
CASE NO. TRACT 6229.
WHEREAS, the Planning Commission of the City of Palm Desert,
did receive a verified application from MARRAKESH BUILDING AND
COUNTRY CLUB, requesting approval of a tentative map for a 100-
unit planned residential development on 27 acres of land, located
in the R-1-10,000 zone and situated west of Portola, south of
Grapevine, and north of Haystack, more particularly described as:
a portion of the SW4 of the NE4 and the
NW4 of the SE4 of Section 29, T5S, R6E,
S.B.B. & M.
WHEREAS, said application had complied with the requirements
of the "City of Palm Desert Environmental Quality Procedure
Resolution Number 74-14", in that the project was initiated prior
to the effective date of the California Environmental Quality
Act and is therefore considered to be exempt as an on -going pro-
ject, and;
WHEREAS, the Planning Commission did take into consider-
ation the Tentative Map as submitted, and the reports of the
various reviewing agencies, and;
WHEREAS, the Planning Commission did find that the subject
Tentative Map does substantially comply with the City of Palm
Desert Code (County Ordinance Number 460), and the State of
California Subdivision Map Act, as amended;
WHEREAS, the Planning Commission did find that the subject
Tentative Map does comply with the adopted General Plan, and;
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission
of the City of Palm Desert as follows:
1. That the above recitations are true and correct and
constitute the findings of the commission in this case;
2. That it does hereby recommend approval to the City
Council of the City of Palm Desert of the above described

Tentative Map No. 6229, subject to fulfillment of the following
conditions (copy attached):
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Palm Desert Planning Commission held on the l4th day of October,
1974, by the following vote, to wit:

CONDITIONS OF APPROVAL
TRACT NO. 6229
1. All improvements shall conform with County Subdivision Stan-
dards Schedule A unless modified by these conditions.
2. a) All street improvements shall be designed and constructed
in conformance with Riverside County Road Improvement
Standards.
1) Interior drives shall be platted as driveway ease-
ments.
2) Improvements shall be required as approved by amended
Variance No. 948.
b) Other street improvements and requirements shall be as
follows:
1) Haystack Road shall be improved with match -up asphalt
concrete paving and concrete curb and gutter located
32 feet from the centerline within a 44-foot half -
width dedicated right-of-way, for the full frontage
of the subject property.
2) Lot access shall be restricted on Portola Avenue and
Grapevine Street and so noted on the final map.
3) Corner cutbacks shall be shown on the final map.
3. If the subdivider does any lot grading he shall submit one
reproducible brownline and four prints of a comprehensive
grading plan to the Riverside County Surveyor's Office.
Prints of the grading plan will subsequently be transmitted
from the Surveyor's Office to the Flood Control District and
Division of Building & Safety for review and approval and shall
be in compliance with the Uniform Building Code, Chapter 70, as
amended by Ordinance No. 457.
4. The subdivider shall submit for approval a soils report for
stability and geological study to the Riverside County Sur-
veyor's Office prior to recordation of the final map.
5. Street names for the proposed subdivision shall be subject
to approval by the County Road Commissioner and Director of
Environmental Services.
6. A water and sewer system shall be installed in accordance
with the provisions set forth in the Riverside County Health
Department letter dated August 29, 1974, a copy of which is
enclosed.
7. Prior to recordation of the final subdivision map, the appli-
cant shall submit to the Commission the following documents
which shall demonstrate to the satisfaction of the Commission
that the total project will be developed and maintained in ac-
cordance with the intent and purposes of the approval:
a. The document to convey title.
b. Covenants and restrictions to be recorded.
c. Management and maintenance agreement to be entered into
with the owners of the units of the project.
8. The approved documents shall be recorded at the same time that
the subdivision map is recorded.
9. A home owners association with the unqualified right to assess
the owners of the individual units for reasonable maintenance
costs shall be established and continuously maintained. The

management company shall have the right to lien the units of
the owners who default in the payment of their assessments. Such
lien shall not be subordinate to any encumbrance other than a
first deed of trust provided such deed of trust is made in good
faith and for value and is of record prior to the lien of the
management company.
10. In regard to flood control protection and sewer service, the
following requirements as outlined in the Coachella Valley
County Water District letter, dated September 19, 1974, shall
apply:
a. Area shall be annexed to Improvement Districts No. 54
and 80 of the Coachella Valley County Water District for
sanitation service.
b. The interior drainage shall conform to the provisions of
the "Comprehensive Plan for Surface Water Drainage for
Palm Desert" approved by the Board of Supervisors in 1968.
11. The subdivider shall provide Schedule A fire protection. The
California Division of Forestry shall review and approve the
water plan map relative to location, setting, spacing, and in-
stallation of fire hydrants prior to recordation of the final
subdivision map.
12. A valid variance shall be in effect at the time of recordation
of the final map.
13. The impact of nuisance water run-off originating on -site shall
be minimized through the use of retention basins or dry wells
in open space areas with one on Marrakesh Drive at Grapevine
and an interceptor on Portola north of Grapevine. Plans for
such improvements shall be submitted to the Director of En-
vironmental Services for approval.
14. All requirements of any applicable law, ordinance or regulation
of the State of California, City of Palm Desert, and any other
applicable governmental entity shall be complied with as part
of construction.
