A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROV-
ING A PLOT PLAN TO ALLOW THE DEVELOPMENT OF A SHOPPING
CENTER ON PROPERTY GENERALLY LOCATED AT THE NORTHWEST
CORNER OF THE INTERSECTION OF HIGHWAY 111 AND MONTEREY
AVENUE.
CASE NO. 14MF
WHEREAS, the Planning Commission of the City of Palm Desert
did receive a verified application from STOTTER-CAPLOW requesting
approval of a Plot Plan on property located in the C-P-S Zone, and
situated at the northwest corner of the intersection of Highway 111
and Monterey Avenue to allow for the development of a shopping cen-
ter; the property being more particularly described as:
a portion of the SE 4 of the NE 4 of
Sec. 19, Township 5S, Range 6E,
S.B.B.&M.
WHEREAS, said application has complied with the requirements
of the "City of Palm Desert Environmental Quality Procedure Reso-
lution Number 74-14", in that a final Environmental Impact Report
was presented and City Council has certified the Environmental
Impact Report as being complete, and;
WHEREAS, on November 12, 1974, the Architectural Review Board
reviewed the project and did recommend approval subject to the
attached conditions; and,
WHEREAS, on November 18, 1974, the Planning Commission did
consider this request for Plot Plan Approval; and,
WHEREAS, at that time, upon receiving and considering the
testimony and arguments, if any, of all persons who desired to
be heard, said commission did find the following facts and reasons
to exist to approve the Plot Plan:
1. Conformance of the proposed development to all require-
ments of Zoning Ordinance and Cove Communities General Plan.
2. The proposed development does ensure the protection of
public health, safety and general welfare.
3. No adverse environmental affects being created.
4. Compatibility with the proposed General Plan for the City.
5. Compatibility of the proposed development to existing and
proposed development in the area.
RESOLUTION NO. 18
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission
of the City of Palm Desert as follows:
1. That the above recitations are true and correct and con-
stitute the findings of the commission in this case.
2. That it does hereby approve Plot Plan No. 14MF, subject
to the attached conditions.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Planning Commission of the City of Palm Desert, held on 18th
of November, 1974, by the following vote, to wit:

1. That the approval is granted only for the land as described
in the application and any attachments thereto, and as shown
on the revised plans submitted and approved and labeled as
follows: Exhibits G, H. Subject to the effective date of
the appropriate zoning.
2. That the location and design of all buildings, fences, signs,
roadways, parking areas, landscaping, and other facilities
or features shall be located, designed and maintained sub-
stantially as shown on the plans submitted and approved, un-
less otherwise indicated on the approved plans.
3. That prior to the issuance of any building permits all de-
tailed building plans, detailed landscaping plans, lighting
plans, sign plans and material boards shall be considered
and approved by the Architectural Review Board and the Plan-
ning Commission. That upon the approval of any final plans
by the Architectural Review Board and prior to any permits
being issued, the applicant shall submit to Staff two complete
and final sets of all plans to the Planning Division. Such
plans shall detail all of the revisions and changes required
by the Board.
4. That unless the use is inaugurated or the construction of
the structure or facility is commenced not later than twelve
months after the date the approval of the construction plans
is granted and is diligently pursued thereafter, the approval
will automatically become null and void.
5. That no final occupancy permit will be granted until all con-
struction is completed and all improvements and landscaping
are installed in accordance with the plans approved and the
conditions required by the Architectural Review Board and
Planning Commission.
6. That all materials and colors used in construction and all
landscape materials shall be as represented to or specified
by the Architectural Review Board and Planning Commission
and any deviation will require the express .approval of the
Board. Once constructed or installed, all improvements.
shall be maintained in accordance with the approved plans
and in a manner acceptable to the Architectural Review Board
and Planning Commission.
7. All trash storage areas shall be enclosed in a manner accept-
able to the Architectural Review Board.
8. That there shall he no exposed exterior plumbing lines or
electrical conduits visible to the public.
9. That all adopted City Council policies shall be met as a part
of development.
10. That all sign bracing shall be below parapet walls or screened
in a manner acceptable to the Architectural Review Board and
Planning Commission.
That all landscape areas adjacent to parking areas shall be
enclosed by a raised concrete curb or low wall. All planters
adjacent to the street right-of-way shall be constructed with
weep holes.
12. That all existing and proposed utility facilities shall be
placed underground, including overhead lines in adjacent
public right-of-way.
That this approval is subject to the applicant's paying of all
fees and assessments to the City of Palm Desert as required by
Ordinance.

14. That this approval is subject to the applicant installing all
necessary off -site improvements as required by the Director
of Environmental Services, and shall include but not be
limited to the following:
a) Curb, gutter, 10 foot wide sidewalk, and tie-in paving
to County Standards for the full: frontage of the subject
property on Monterey Avenue. Said sidewalk shall include
tree wells with 40 foot spacing on -center.
b) Curb, gutter, tic -in paving and landscaping 'to State Stand-
ards for the full frontage of the subject property along
,State Highway 111.
15. That prior to construction the applicant shall submit a drain-
age plan to the Building Official for consideration and ap-
proval.
.16. That this approval is subject to the City of Palm Desert re-
ceiving all necessary dedications and easements from the ap-
plicant.
17. That all areas shown as open parking areas shall be surfaced
with asphalt concrete and shall be suitably marked, outlin-
ing individual parking spaces and traffic flow. Said sur-
facing and marking shall be completed prior to final inspec-
tion of the structure or structures by the Building Division.
All open parking spaces shall be a minimum of '`3 feet wide by
20 feet deep and the surface shall be maintained in a reason-
able state of repair at all times.
18. Prior to the issuance of any building permits, the applicant
shall dedicate to the City an easement on the 30 foot: wide
area for the full frontage of the subject property on State
Highway 111. Said easement shall provide for the usage of
the area for public access. The installation of the indica-
ted improvements and future maintenance of the area shall be
the responsibility of the developer and at his cost. The
form of the agreement shall be subject to the approval of the
City Attorney.
19. All buildings shall be connected to a public sewer system and
the "developer shall meet all requirements of the Coachella
Valley County Water District.
20. Fire protection as required by the County Fire Department
shall be provided.
21.. Prior to final occupancy, a parcel map shall be filed and
approved by'the City on the subject property. All require-
ments attached to said map shall be met as a part of de—
velopment.
22• A landscaped strip along the frontage of Highway 111, 47 feet
in width shall be provided and maintained. (This area shall
consist of a 17 foot parkway and a 30 foot setback.) A mini-
mum of 19 shade trees shall be provided therein, along with a
6 foot wide meandering bike path and undulating berms averag—
ing 3 feet in height. An easement encompassing this area
shall be given to the City for public circulation. Mainten-
ance of this area shall be the responsibility of the developer
in perpetuity.
23. A landscaped strip along the frontage of Monterey 30 feet in
width shall be provided and maintained. Within this area, a
10 foot wide sidewalk and 3 foot high wall as shown shall be
provided.

24. Landscaped area around auto service area shall include a
6 foot high wall adjacent to it with berming or embanking
provided therefrom.
25. A 6 foot high wall, 40 feet in length, shall be provided
along the west frontage road adjacent to the loading dock area
behind the Market in order to conceal it from public view.
26. A landscaped strip 25 feet wide along the frontage of the west
property line adjacent to the parking area shall be provided
and maintained to include a 10 foot wide sidewalk, turf, berm-
ing to an average height of 3 feet, and the planting of palm
trees evenly spaced every 20 feet.
27. A landscaped strip 30 feet wide along the frontage of the west
property line adjacent to the Market shall be provided and
maintained to include a 10 foot wide sidewalk, turf, berming
to an average height of 3 feet, and the planting of palm trees
evenly spaced every 20 feet.
28. A landscaped screen (minimum 6 feet in height) shall be pro-
vided along north property line. The prescribed height shall
be obtained within 6 months from the time construction begins.
29. Shade trees as prescribed by ordinance (one tree per five
parking spaces) shall be provided and maintained throughout
the parking area.
30. The sign location and design shall be referred back to the
Architectural Review Board for consideration and recommenda-
tion.
31. All window areas on store fronts of all stores shall be "tinted
smoke".
32. Overhangs on all sides of building shall be a minimum of 4 feet.
33. Regarding the proposed tramway/pathway route (15 feet wide)
along and adjacent to the sidewalk area on the south side of
store fronts, the applicant shall submit an alternative as
a part of the construction plans to the Architectural Review
Board for consideration and approval.
34. Arched wall on south side of plaza area shall be deleted or
placed along the north side.
35. An automatic underground sprinkler system shall be provided
to all landscaped areas.
36. A strip of sidewalk 10 feet wide shall be provided along the
north side of the main entrance drive off of Monterey Avenue
37. All sidewalks at intersection points with streets shall be
ramped instead of curbed.
