A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROV-
ING A PLOT PLAN TO ALLOW THE DEVELOPMENT OF SANDPIPER
SQUARE NEIGHBORHOOD SHOPPING CENTER ON PROPERTY GENER-
ALLY LOCATED AT THE INTERSECTION OF HIGHWAY 111 AND
44TH AVENUE (SOUTHEAST CORNER)
CASE NO. 2C
WHEREAS, the Planning Commission of the City of Palm Desert
did receive a verified application from JOSEPH BLUMENFELD request-
ing approval of a Plot Plan on property located in the C-P-S Zone,
and situated in area bordered by Highway 111, Avenue 44 and Palm
Valley Storm Channel to allow for the development of a neighbor-
hood shopping center, the property being more particularly des-
cribed as:
a portion of the NE4 of the NA

of Section 19, Township 5S, Range
6 East, S.B.B.&M.
WHEREAS, said application has complied with the requirements
of the "City of Palm Desert Environmental Quality Procedure Reso-
lution No. 74-14", in that the project is exempt as a ministerial
action,
WHEREAS, on November 12, 1974, the Architectural Review Board
reviewed the project and did recolluhiend approval subject to the
attached conditions; and,
WHEREAS, on November 18, 1974, the Planning Commission did
consider this request for Plot Plan Approval; and,
WHEREAS, at that time, upon receiving and considering the
testimony and arguments, if any, of all persons who desired to be
heard, said commission did find the following facts and reasons
to exist to approve the Plot Plan:
1. Conformance of the proposed development to all require-
ments of Zoning Ordinance and Cove Communities General Plan.
2. The proposed development does insure the protection of
public health, safety, and general welfare.
3. No adverse environmental affects being created.
4. Compatibility of the proposed General Plan for the City.
5. Compatibility of the proposed development to the exist-
ing and proposed development in the area.

NOW, THEREFORE, BE IT RESOLVED by the Planning Commission
of the City of Palm Desert as follows:
1. That the above recitations are true and correct and con-
stitute the findings of the commission in this case.
2. That it does hereby approve Plot Plan No. 2C, subject to
the attached conditions.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Planning Commission of the City of Palm Desert, held on November
18, 1974, by the following vote, to wit:

CONDITIONS OF APPROVAL
CASE: #2C
1. All requirements of any law, ordinance or regulation of the State, City,
and applicable government entity shall be complied with as part of the
development process.
2. That the approval is granted only for the land as described in the ap-
plication and any attachments thereto, and as shown on the plans sub-
mitted and approved.
3. That the location and design of all buildings, fences, signs, roadways,
parking areas, landscaping, and other facilities or features shall be
located, designed and maintained substantially as shown on the plans
submitted and approved, unless otherwise indicated on the approved plans.
4. That prior to the issuance of any building permits, all construction
and landscape plans, and sign plans, shall be filed with the Planning
Division and scheduled on the calendar of the Architectural Review
Board and Planning Commission.
5. That upon the approval of any plans by the Architectural Review Board
and prior to any permits being issued, the applicant shall submit to
Staff, two complete and final sets of all plans. Such plans shall de-
tail all of the revisions and changes required by the Board.
6. That unless the use is inaugurated or the construction of the structure
or facility is commenced not later than twelve months after the date the
approval is granted and is diligently pursued thereafter, the approval
will automatically become null and void, unless an extension is granted.
7. That no final occupancy permit will be granted until all construction
is completed and all improvements and landscaping are installed in ac-
cordance with the plans approved and the conditions required by the
Architectural Review Board.
8. That all materials and colors used in construction and all landscape
materials shall be as represented to or specified by the Architectural
Review Board and any deviation will require the express approval of the
Board. Once constructed or installed, all improvements shall be main-
tained in accordance with the approved plans Bad in a manner acceptable
to the Architectural Review Board.
9. That a trash enclosure shall be provided and maintained of a size and
at a location as approved by the Architectural Review Board. Said
trash storage area shall be enclosed with a well of sufficient height
to adequately and aesthetically screen the area and shall include a
solid gate.
10. That any mechanical and/cr electrical equipmert to be located on the
roof of the structure or "pad" mounted on the site shall be screened in
a manner as approved by the Architectural Review Board.
11. That there shall be no exposed exterior plumbing lines or electrical
conduits visible to the public.

12. A landscape plan, specifying type and size of plantings and irrigation
system shall be submitted for review and approval by the Architectural
Review Board.
13. Pedestrian/Pathway access shall be provided as shown. Width of path-
way system shall be at least 12 feet exclusive of CVWCD property.
14. Access road off of Highway 111 shall be repositioned as shown, with
alignment centering on large parapet wall of Market.
15. Shape of parapet walls on Market shall be revised as shown to carry
out "tapered theme" on buildings and to avoid "box -like mass".
16. Development of proposed banking facility and related parking in the
south corner of parcel (as shown in outline) shall be permitted only
after specific plans have been submitted to the Architectural Review
Board and approved.
17. Full landscaping shall be provided in areas between curb and gutter
and setbacks therefrom, along Highway 111 and 44th Avenue. Undulating
berms, covering at least 75% of the aforementioned landscaped areas,
shall be provided. Height of berms shall average 3 feet at crests.
Maintenance shall be borne by the developer in perpetuity and an ease-
. ment shall be granted to the City for public access.
18. Landscaping shall be provided along the eastern property line extend-
ing outward a distance of 40 feet. (This condition is based upon the
stated intent by the applicant.)
19. All landscaping shall be maintained by the developer including the
public easement along Highway 111.
20. An architecturally integrated "signage program" for the shopping center
and respective facilities therein, shall be submitted for approval by
the Architectural Review Board, showing location of sign areas on build-
ings, range of colors to be used, and "signage theme".
21. A meandering bike path (6 feet wide) shall be provided within the land-
scaped strip along Highway 111.
22. That all landscape areas adjacent to parking areas shall be enclosed
by a raised concrete curb or low wall. All planters adjacent to the
street right-of-way shall be constructed with weep holes.
23. That all utility facilities shall be placed underground.
24. That this approval is subject to the applicant's paying of all fees
and assessments to the City of Palm Desert as required by Ordinance.
25 . As a part of construction, the following off -site improvements shall
be as follows:
a) Curb, gutter and tie-in paving to street standards, shall be con-
structed for the full frontage of the property on Highway 111.
Landscaping shall be installed in the parkway.
b) Curb, gutter, tie-in paving, 10 foot wide sidewalk, and tree wells
at 40 ft. on center, shall be constructed for the full frontage
of the subject property on 44th Avenue.
26 . That prior to construction the applicant shall submit a drainage plan
to the Building Official for consideration and approval.

27. That this approval is subject to the City of Palm Desert receiving
all necessary dedications and easements from the applicant.
Z8. That all areas shown as open parking areas shall be surfaced with
asphalt concrete and shall he suitably marked, outlining individual
parking spaces and traffic flow. Said surfacing and marking shall
be completed prior to final inspection of the structure or structures
by the Building Division. All open parking spaces shall be a minimum
9 feet wide by 20 feet deep and the surface shall be maintained in a
reasonable state of repair at all times.
