PLANNING COMMISSION RESOLUTION NO. 3
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND
APPROVING A PLOT PLAN TO ALLOW THE DEVELOPMENT OF A
DUPLEX APARTMENT BUILDING ON PROPERTY GENERALLY LO-
CATED ON THE SOUTH SIDE OF AVENUE 44 AND EAST OF
MONTEREY AVENUE.

WHEREAS, the Planning Commission of the City of Palm Desert did
receive a verified application from HAL CHAPLIN requesting approval
of a Plot Plan on property located in the R-2 Zone, and situated on
the south side of Avenue 44 and east of Monterey Avenue to allow for
the development of a duplex apartment building; the property being
more particularly described as:
Lot 5, being a portion of the NZ of
the NW4 of Section 20, Township 5 South,
Range 6 East, S.B.B. & M.
WHEREAS, said application has complied with the requirements
of the "City of Palm Desert Environmental Quality Procedure Resolu-
tion Number 74-14", in that the Director of Environmental Services
has determined on July 22, 1974 that the project would not have a
significant impact on the environment and the appeal period did ex-
pire on July 30, 1974, and;
WHEREAS, on September 3, 1974, the Planning Commission did con-
sider this request for Plot Plan approval; and
WHEREAS, at that time, upon receiving and considering the tes-
timony and arguments, if any, of all persons who desired to be heard,
said Commission did find the following facts and reasons to exist to
approve the Plot Plan:
1. Conformance of the proposed project to all requirements of
the Zoning Ordinance.
2. The proposed project does insure the protection of the pub-
lic health, safety, and general welfare.
No,. 3. Compatibility of the proposed project to the existing and
proposed development in the area.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Desert as follows:

1. That the above recitations are true and correct and con-
stitute the findings of the Commission in this case.
2. That it does hereby approve Plot Plan No. 10MF, subject to
the following conditions:
1) The construction of this project shall conform substantially
to the Plot Plan No. 10MF, labeled Exhibit A and the require-
ments herein.
2) Complete and detailed landscaping, irrigation, trash stor-
age, and exterior lighting plans shall be submitted and ap-
proved by the Director of Environmental Services. The con-
struction shown in such plans shall be made a part of the
building permit, and no certificate of occupancy shall be
issued for any dwelling unit until such construction is
completed and approved by the City.
3) Electric service to the residences shall be by underground
feed.
4) The applicant shall submit an agreement to install curb and
gutter constructed to County of Riverside Road Department
Standards for the entire length of the subject property
frontage on Avenue 44. Such construction shall occur at
some future date when said construction shall be deemed
appropriate by the City.
5) Applicant shall fulfill requirements as indicated in the
letter dated July 24, 1974 from the County of Riverside
Department of Fire Protection.
6) Applicant shall fulfill conditions indicated in letter
dated July 24, 1974 from the Coachella Valley County Water
District.
7) All requirements of any applicable law, ordinance, or regu-
lation of the State of California, City of Palm Desert, and
any other applicable governmental entity shall be complied
with as a part of construction.
8) That the trash storage area shall be relocated at least 30
feet southerly of 44th Avenue and additional trash storage
area shall be provided in a manner acceptable to the Director
of Environmental Services.

PASSED, APPROVED AND ADOPTED at a regular meeting of the
Planning Commission of the City of Palm Desert, held on September 3,
1974 by the following vote, to wit:
AYES: Commissioners: Hubbard, Mullins, Seidler, Van de Mark
NOES: Commissioner Wilson
