A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA SETTING FORTH
ITS FINDINGS AND RECOMMENDING TO THE CITY COUNCIL
THAT THE FINAL ENVIRONMENTAL IMPACT REPORT FOR THE
GERALD MOSS PROJECT ON 75 ACRES OF LAND LOCATED
GENERALLY WEST OF PAINTERS PATH AND SOUTH OF THE
WESTERLY EXTENSION OF AVENUE 44 BE CERTIFIED AS
COMPLETE.
CASE NO. C/Z - 01-73-PD
WHEREAS, the Planning Commission of the City of Palm Desert,
pursuant to Section 18.26 of the Palm Desert Zoning Code and Reso-
lution No. 74-14, "A Resolution of the City Council of the City of
Palm Desert Establishing Procedures to Implement the Environmental
Quality Act of 1970", did on September 16, 1974, hold a duly
noticed public hearing to consider the final Environmental Impact
Report, consisting of the draft EIR, the comments received on the
draft EIR, the Staff response to those comments, and the comments
from the public hearing, and;
WHEREAS, at said public hearing, upon receiving and consider-
ing the testimony and arguments, if any, of all persons who de-
sired to be heard, said Commission did find the following facts
and reasons to exist to recommend to the City Council that the
final EIR be certified as complete:
1. The report meets the requirements of the California En-
vironmental Quality Act.
2. The report adequately deals with the environmental fac-
tors involved in this project.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission
of the City of Palm Desert as follows:
1. That the above recitations are true and correct and
constitute the findings of the Commission in this case.
2. That it does hereby recommend to the City Council of the
City of Palm Desert that the final Environmental Impact Report
for the GERALD MOSS PROPERTIES project, Change of Zone - 01-73-PD,
should be certified as complete.

PASSED, APLROVED AND ADOPTED at a regular meeting of the
Palm Desert Planning Commission held on September 16, 1974, by the
following vote, to wit:
AYES: HUBBARD, MULLINS, SEIDLER, VAN DE MARK, WILSON
NOES: None
