HomeMy WebLinkAboutRes No 26PLANNING COMMISSION RESOLUTION NO. 26 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND GRANT- ING A CONDITIONAL USE PERMIT/PUBLIC USE PERMIT TO ALLOW A PARKING LOT ON PROPERTY GENERALLY LOCATED AT 44-850 LAS PALMAS AVENUE. CASE NO. CUP - 15-74 WHEREAS, pursuant to the provisions of Section 18.26 of the Palm Desert Zoning Code, the Planning Commission did on December 16, 1974, hold a duly noticed public hearing to consider the ap- plication of TONI O'MALLEY for a Conditional Use Permit/Public Use Permit to allow a parking lot on property located in the R-3 Zone and situated at 44-850 Las Palmas Avenue, and more particularly described as: Lot 40 of Palm Village, Plaza Tract, as per map recorded in Book 23, Page 2 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Reso- lution Number 74-14", in that the Director of Environmental Ser- vices has determined on November 21, 1974 that the project would not have a significant impact on the environment and the appeal period did expire on November 29, 1974, and; WHEREAS, at said public hearing, upon hearing and considering all testimony and argument, the Planning Commission did find the following facts and reasons to exist to justify the granting of said Conditional Use Permit/Public Use Permit: 1. Conformance of proposed development with all requirements of zoning ordinances and the Cove Communities General Plan. 2. Compatibility of the proposed development with existing and proposed development in the area. 3. Compatibility of the proposed development with the Interim Core Area Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1. That the above recitations are true and correct and con- stitute the findings of the Commission in this case. RES. NO. 26 2. Subject to confirmation by the City Council, the Condi- tional Use Permit/Public Use Permit is granted to TONI O'MALLEY, subject to the attached conditions of approval. PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Palm Desert Commission held on December 16, 1974 by the fol- lowing vote, to wit: AYES: SEIDLER, VAN DE MARK, MULLINS, WILSON NOES: NONE ABSENT: HUBBARD ABSTAIN: NONE IAM R i ER, Vice Chairman ATTEST: PAUL A. WILLIAMS, Secretary CONDITIONS OF APPROVAL CASE NO. C.U.P. - 15-74 1. The development of this project shall conform substantially to all development plans submitted in behalf of this case and as revised according to ARB action. 2. All requirement of any law, ordinance or regulation of the State, City, and applicable government entity shall be com- plied with as part of the development process. 3. Adjacent alleys shall be paved in conformance with Riverside County standards. 4. Parking areas (and related landscaping) shall be constructed in conformance with the City of Palm Desert's Parking Ordin- ance.
