A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM
DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING PLOT,
CONSTRUCTION, AND SIGNAGE PLANS TO ALLOW THE DEVELOPMENT OF
A NEW RESTAURANT ON PROPERTY GENERALLY LOCATED AT THE NORTH-
WEST CORNER OF EL PASEO SQUARE SHOPPING CENTER. CASE NO.5C
WHEREAS, the Planning Commission of the City of Palm Desert did receive
a verified application from ROY CARVER requesting approval of plot, construc-
tion, and signage plans on property located in the CPS Zone, and situated at
the northwest corner of the El Paseo Square Shopping Center to allow for the
development of a new restaurant; the property being more particularly described
as: Building E of Plot Plan 1050.
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Environmental Quality Procedures Resolution Number 74-14", in
that the County of Riverside has determined that the project would not have
a signficant impact on the environment and;
WHEREAS, on January 27, 1975, the Planning Commission did consider this
request for plot, construction, and signage plan Approval; and
WHEREAS, at that time, upon receiving and considering the testimony and
arguments, if any, of all persons who desired to be heard, said commission did
find the following facts and reasons to exist to approve the Plot Plan:
1. The project does contribute to the health, safety and welfare of
the community.
2. The project is in conformance with all applicable regulations and
ordinances.
3. The project is in conformance with the General Plan of the City of
Palm Desert.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of Palm Desert as follows:
1. That the above recitations are true and correct and constitute the
findings of the commission in this case.
2. That it does hereby approve Case No. 5C, subject to the attached
conditions:
PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning Commission
of the City of Palm Desert, held on 27 January 1975 by the following vote, to wit:

CONDITIONS OF APPROVAL
CASE 115C
1. The development of this project shall conform substantially to all development plans sub-
mitted in behalf of this case and as revised according to ARB action.
2. All requirement of any law, ordinance or regulation of the State, City, and applicable
government entity shall be complied with as part of the development process.
3. Action taken previously on this case by the ARB shall be nullified.
4. Building E shall be relocated westerly 31' from the existing curb line to the east to
permit a distance of 26' between buildings D & E and a common loading area to serve
both buildings.
5. Parking stalls in front of the restaurant to the east shall be deleted.
6. Pathways shall be provided as shown, with all points of intersection with access streets
being "ramped" rather than "curbed". (A small curb cut onto the frontage road shall
be provided to accomodate bicycle access.)
7. The open space created immediate to the east of the restaurant shall be extensively
landscaped, as reviewed and approved by the Director of Environmental Services. (Land-
scaping shall include extensive turf area, berming, shade trees, flowers, fountain,
accent lighting, and irrigation system).
8. Landscaping shall be provided as a transistion between buildings E & D as reviewed and
approved by the Director of Environmental Services.
9. All rooftop ventilation, exhaust and air conditioning equipment shall be concealed by
parapet crown.
10. Signage or north elevation shall be permitted as shown.
11. Signage on east elevation shall be reduced in size by 25% or shall be redesigned to
complement the verticle mass of the wall behind it.
12. No other signage shall be permitted.
13. Illumination of signage should be by eave lights if possible.
14. Landscaping shall be provided and maintained as shown.
15. Accent lighting on landscaping shall be automatically activated during hours of darkness.
Light sources shall not be visible from public right-of-ways.
16. Service area shall be provided as shown with a loading area to be 30' in depth to
accomodate delivery trucks.
17. Access to the trash area of Building D shall be off the service area rather than
off the access street if at all possible.
18. Window area shall wrap around south east corner of building E to extend a minimum of 8'
in order to further create a sense of openness with the stores to the south.
19. Driveway between buildings E & C shall be-24' in width to permit 2 way traffic. Planter
adjacent to it on north side shall be a minimum of 31" deep.
