HomeMy WebLinkAboutRes No 043PLANNING COMMISSION RESOLUTION NO. 43 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND GRANTING AN EXTENSION OF AN EXISTING PUBLIC USE PERMIT TO ALLOW A PRE-SCHOOL IN AN R-2 ZONE ON PROPERTY GENERALLY LOCATED AT 73-081 GUADALUPE AVENUE. CASE NO. PUP-01-74 WHEREAS, pursuant to the provisions of Section 18.26 of the Palm Desert Zoning Code, the Planning Commission did on April 14, 1975, hold a duly noticed public hearing to consider the applica- tion of Theta Logan for a Public Use Permit to allow a pre-school on property located in the R-2 Zone and situated at 73-081 Guadalupe Avenue and more particularly described as: a portion of the N 2 of the NW 4 of Section 20, Township 5 South, Range 6 East, S.B.B. & M. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution Number 74-14", in that the project is exempt as an on- going project for which a Negative Declaration has previously been filed and which has not substantially changed in character and; WHEREAS, at said public hearing, upon hearing and considering all testimony and argument, the Planning Commission did find the following facts and reasons to exist to justify the granting of said Public Use Permit: 1. Project would be compatible with surrounding uses. 2. Project would not be detrimental or adverse to the public health, safety, or welfare. 3. Project is in conformance with the adopted P. D. General Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. Resolution No. 43 2. Subject to confirmation by the City Council, Public Use Permit 01-74 is granted to Theta Logan for reasons subject to the following conditions: see attached sheet. PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Palm Desert Commission held on April 14, 1975 following vote, to wit: AYES: BERKEY, MULLINS, SEIDLER, VAN DE MARK, WILSON NOES: ABSENT: ABSTAIN: ATTEST: PAUL A. WILLIAMS, Secretary by the IA • Chairman PROPOSED CONDITIONS OF APPROVAL PUP-01-74 April 14, 1975 1. The development of the premises shall conform substantially with that as shown on plot plan marked "Exhibit A" on file with Public Use Case No. 01-74-PD in the office of the Palm Desert Planning Division, Department of Environmental Services, unless otherwise amended. 2. In the event the use permitted hereby ceases operation for a period of one year or more, this permit shall become null and void. 3. Operation is limited to hours between 6:30 A.M. and 6:30 P.M. 4. No signs shall be permitted on the premises. 5. This permit shall expire and the use shall terminate on April 14, 1980. 6. Premises shall not be occupied by more than 15 children at any single time. 7. All requirements of any applicable law, ordinance, or regu- lation of the State of California, City of Palm Desert, and any other applicable governmental entity shall be complied with.
