HomeMy WebLinkAboutRes No 045PLANNING COMMISSION RESOLUTION NO. 45 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING A PLOT PLAN TO ALLOW THE DEVELOPMENT OF PHASE III EXPANSION OF THE PALMS TO PINES SHOPPING CENTER ON THE PROPERTY GENERALLY LOCATED AT THE SOUTHWEST CORNER OF THE INTERSECTION OF HIGHWAY 111 AND PLAZA WAY. CASE NO. 10C. WHEREAS, the Planning Commission of the City of Palm Desert did receive a verified application from BILL CARVER requesting approval of a Plot Plan on property located in the CPS Zone, and situated at the southwest corner of the intersection of Highway 111 and Plaza Way to allow for the development of the Phase III addition to the Palms to Pines Shopping Center; the property being more particularly described as: Assessor's Parcel # 629-060-039 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution Number 74-14", in that a Notice of Exemption was issued by the Director of Environmental Services as a result of project initiation prior to State Environmental Report requirements, and; WHEREAS, on April 14, 1975, the Planning Commission did consider this request for Plot Plan Approval; and WHEREAS, at that time, upon receiving and considering the testimony and arguments, if any, of all persons who desired to be heard, said commission did find the following facts and reasons to exist to approve the Plot Plan: 1. The proposed development does ensure the protection of the public health, safety, and general welfare. 2. The proposed development conforms to existing ordinances and regulations. 3. The proposed development conforms to the Palm Desert General Plan. 4. The proposed development conforms to roadway and pathway circulation plans developed for the general vicinity. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That it does hereby approve Plot Plan No. 10C, subject to the following attached conditions: PASSED, APPROVED and ADOPTED, at a regular meeting of the Planning Commission of the City of Palm Desert, held on April 14, 1975 by the following vote to wit: AYES: BERKEY, MULLINS, SEIDLER, VAN de MARK, WILSON NOES: ABSENT: ABSTAIN: ATTEST: PAUL WILLIAMS, SECRETARY (Commercial) CONDITIONS OF APPROVAL CASE # 10C 1. The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibits C-1, A-1, L-1, P-2,P-3, A-2 and S1) and as revised according to Planning Commission Action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City and other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project commencing within one year from approval date and being promptly completed. 4. Any roof mounted, exhaust or air conditioning equipment shall be fully con- cealed from view from any public right-of-ways and adjoining properties by means of architecturally integrated means as shown, as approved by the Director of Environmental Services. 5. All utility lines shall be placed underground. 6. Curb, gutter, sidewalk or approved pathways, curb cuts, and tie-in paving shall be provided in conformance with Riverside County Standards and State Highway Standards where applicable. 7. Landscaping (with irrigation system) shall be provided with modifications. Final landscaping plans shall be submitted for approval as part of the final construction plans. 8. Noncumbustible trash storage areas shall be provided for as shown and as approved by the Director of Environmental Services. 9. Storage and loading areas shall be screened as shown and as modified. 10. Lighting of parking areas and streets shall be provided for as approved by the Director of Environmental Services. 11. The Signage as submitted is not approved. A signage plan shall be submitted to the DRB and Planning Commission for final approval. 12. Elevations are to be modified according to annotated changes. 13. Walkways/pathways shall be provided as modified, and shall be submitted for approval as part of final construction plans. 14. Circulation plan shall conform to circulation plan for vicinity as developed by Staff. Interior circulation patterns shall be provided as shown. -2- 15. Architectural treatment shall be common throughout the project. Except for building A, all buildings shall have the same roof design and materials. 16. All materials and colors shall be common throughout the project. 17. Main East West pathway shall be provided as shown. Pathway shall be a minimum of 10' wide and shall accommodate both pedestrians and bicycles in distinctly marked sections of the pathway. All points of intersection between the pathway and various streets and traffic aisles will be ramped rather than curbed. Final details of the pathway system shall be submitted for approval as a part of final construction plans. 18. Pathway access from El Paseo shall likewise be provided as annotated. 19. Pathway treatment shall be extended across streets and aisles by means of unique cement work, color, etc. 20. A lighting plan for the exterior of the buildings and of pedestrian areas shall be submitted for approval as part of final construction plans. 21. Final construction plans of each facility shall be submitted for review and approval by the Design Review Board. These elevations shall include provisions for architecturally integrated signage and lighting. 22. Sewer hookups for all buildings shall be made in conformance with the Coachella Valley County Water District requirements. 23. Wall on east elevation to screen service area shall be brick or block and shall be a minimum of 10' high (to block trucks and large refuse containers). 24. Drive up aisle and facility on west end of building D shall not protrude into normal 24' driveway aisle. No banking or auto intensive use shall be permitted therein. 25. The Marquee as proposed is not approved. 26. A signage plan for traffic control shall be submitted for approval as part of the final construction plans. 27. A "materials board" shall be submitted as part of the final construction plans. 28. All landscaped areas adjacent to parking areas shall be enclosed by a raised concrete curb or low wall. All planters adjacent to roadways shall be con- structed with weep holes. 29. Landscaping on the parkway portions of the public right-of-way along Highway 111 shall be installed and maintained by the applicant. 30. Access to and from Highway 111 at the west boundary of the property shall be provided as shown and as approved by the Division of State Highways in accordance with required State and local standards. Accelleration and de- celleration lanes shall be provided in conformance with State requirements. Accessway shall be dedicated from Highway 111 along west property line for a distance of 150'. -3- 31. Prior to construction, the applicant shall submit a drainage plan to the Building Official for review and approval. 32. Fire protection as required by the County Fire Department shall be provided. 33. The developer, as part of his application for building permits shall enter into an agreement with the City to pay the cost of one -eighth of the installation of a traffic signal system at the intersection of Highway 111 and Plaza Way at the time that said intersection meets the warrants for a traffic signal system. Accompanying said agreement shall be a bond in the amount of one -eighth of the cost for the installation of said traffic signal system to State standards at the time of agreement. 34. Provision shall be made to integrate this project with future development to the west via pathway extension and parking arrangements which allow for flexibility and adaptation to future development. 35. An additional row of parking spaces shall be provided along the west side of the project to provide for additional parking. Fifty-five (55) of these spaces shall be permanently retained in order to meet current ordinance requirements. Landscaping on the west side shall be provided as approved by the Director of Environmental Services. 36. Roof lines on structures C, D, and E shall be as shown on the original plans; and the roof lines on buildings F and G shall be as shown on the applicant's revised plans with the exception of the beams on building F, and that all materials on the roof and sides shall be similar. 37. Traffic aisle fronting along the north side of the building comples shall be straightened out as shown (by annotated changes to a "T" intersection with the accessway off of Highway 111). 38. Film dispensing building shall be deleted.
