A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA ANNOUNCING FINDINGS AND GRANTING
AN AMENDMENT TO PREVIOUSLY APPROVED CONDITIONAL USE PERMIT
#1395 TO ALLOW FOR A .DELETION OF SIX RESIDENTIAL UNITS AND
A SUBSTITUTION OF FOUR TENNIS COURTS ON PROPERTY GENERALLY
LOCATED WITHIN THE KINGS POINT DEVELOPMENT PROJECT ON THE
SOUTH SIDE OF PINE COURT. CASE NO. CUP 1395 (ADDENDUM)
WHEREAS, pursuant to the provisions of Section 18.26 of the
Palm Desert Zoning Code, the Planning Commission did on June 2, 1975,
hold a duly noticed public hearing to consider the apolication of
KINGS POINT DEVELOPMENT COMPANY for an amendment to Conditional
Use Permit #1395 to allow a deletion of six residential units
and a substitution of four tennis courts on property located in the
R-2-6000 Zone and situated on Pine Court within the Kings Point
project and more particularly described as:
Lot 2 of Tract 4380-1, being a
portion of Sections 19 & 30, T5S,
R6E, SB & M, MB 31 pgs. 10 & 11.
WHEREAS, said application is exempt of the requirements of the
"City of Palm Desert Environmental Quality Procedure Resolution
Number 74-14", in that the original approval was granted prior to
E.I.R.'s being required on projects of this type.
WHEREAS, at said public hearing, upon hearing and considering
all testimony and argument, the Planning Commission did find the
following facts and reasons to exist to justify the granting of
an amendment of said Conditional Use Permit #1395:
1. The proposed amendment does ensure the protection of
the public health, safety & welfare.
2. The proposed amendment conforms with all city ordinances.
3. The proposed amendment is compatible with surrounding
development.
NOW, THEREFORE BE IT RESOLVED by the Planning Commission of
the City of Palm Desert as follows:
1. That the above recitations are true and correct and
constitute the findings of the commission in this case.

2. Subject to confirmation by the City Council, an
amendment to Conditional Use Permit #1395 is granted to KINGS
POINT DEVELOPMENT COMPANY subject to the following conditions:
a. The proposed tennis courts shall be unlighted
property.
b. Final construction plans (to include landscaping
and decorative lighting, if any) shall be reviewed
and approved by the Design Review Board.
c. The area shown as future courts shall be land-
scaped and maintained.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
City of Palm Desert Planning Commission held on June 2, 1975
by the following vote, to wit:
