HomeMy WebLinkAboutRes No 054Noe Noe PLANNING COMMISSION RESOLUTION NO. 54 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND GRANTING A VARIANCE TO ALLOW AN IDENTIFICATION GROUND SIGN IN THE PUBLIC RIGHT- OF-WAY ON PROPERTY GENERALLY LOCATED NORTH OF BURSERA WAY, EAST OF THE FRONTAGE ROAD, AND WEST OF HWY. 74. CASE NO. VARIANCE-02-75 WHEREAS, pursuant to the provisions of Section 18.26 of the Palm Desert Zoning Code, the Planning Commission did on June 2, 1975, hold a duly noticed public hearing to consider the application of Indian Creek Villas, Inc., for a variance to allow an identification ground sign in the public right-of-way on property located in the R-2* Zone and situated north of Bursera Way, east of the frontage road, and west of Highway 74 and more particularly described as: a portion of the east 2 of Section 30, T.5S., R.6E., S.B.B. & M. WHEREAS, the subject application has been considered non- significant with regard to the requirements of the "Palm Desert Environmental Quality Procedure Resolution Number 74-14". WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, the Planning Commission did find that the following facts and reasons to exist to justify the granting of said variance: 1. Due to the dedication of large parcels of land to provide for the State Highway 74 Frontage Road, which were not required of other planned residential developments in the immediate vicinity, the strict application of the zoning ordinance would deprive the applicant of privileges enjoyed by other property owners in the vicinity and under similar zoning classification. 2. The granting of this variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the same vicinity and zone in which the subject property is located. 3. The proposed project would be compatible with existing and proposed development in the same area. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1) that the above recitations are true and correct and constitute the findings of the commission in this case; 2) that variance is granted subject to confirmation by (Resolution No. 54 the City Council to Indian Creek Villas, Inc , for reasons subject to following conditions: 1. All requirements of any applicable law, ordinance or regulation of the State of California, City of Palm Desert, and any other applicable governmental entity shall be complied with as a part of construction. 2. Applicant shall submit appropriate plans and drawings to Design Review Board for approval prior to the issuance of any building permits. 3. This approval shall become null and void one year after City Council confirmation, unless substantial construction has occurred. 4. This approval shall be submitted to the Planning Commission for review five (5) years after date of City Council confirmation. PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Palm Desert Planning Commission held on June 2, 1975, by the following vote, to wit: AYES: BERKEY, MULLINS, SEIDLER, VAN DE MARK, WILSON NOES: ABSENT: ABSTAIN: 7 SEIER, Chairman ATTEST: PAUL A.
