HomeMy WebLinkAboutRes No 058PLANNING COMMISSION RESOLUTION NO. 58 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND GRANTING A PUBLIC USE PERMIT TO ALLOW A SCHOOL FOR RETARDED AND HANDICAPPED CHILDREN ON PROPERTY GENERALLY LOCATED AT 74-109 LARREA, CASE NO. PUP-01-75. WHEREAS, pursuant to the provisions of Section 18.26 of the Palm Desert Zoning Code, the Planning Commission did on June 16, 1975, hold a duly noticed public hearing to consider the application of the RIVERSIDE COUNTY DEVELOPMENT CENTER for a Public Use Permit to allow a school for retarded and handicapped children on property located in the R-3-4000 Zone and situated at 74-109 Larrea, more particularly described as: Assessor's Parcel No. 625-132-024 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution Number 74-14", in that the Director of Environmental Services has determined on June 5, 1975 that the project would not have a significant impact on the environment and the appeal period did expire on June 13, 1975; and WHEREAS, at said public hearing, upon hearing and considering all testi- mony and argument, the Planning Commission did find the following facts and reasons to exist to justify the granting of said Public Use Permit: 1. Conformance of the proposed project to all requirements of the General Plan and Zoning Ordinance. 2. Such a permit would be in the interest of furtherance of the public welfare by providing a needed use in an appropriate area, instead of in a low density or commercial district. 3. The proposed use will not be detrimental to other neighboring properties because school hours will be from 8:30 a.m. to 2:30 p.m. and will be conducted mostly indoors. 4. This site is appropriate since there is an existing church next door and it is a corner lot with streets on 2 other sides. 5. The project will not create much traffic since there are only 5 staff members and the children are brought to and from the school by mini -bus. PLANNING COMMISSION SOLUTION NO. 58 2. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. Subject to confirmation by the City Council, the Public Use Permit is granted to RIVERSIDE COUNTY DEVELOPMENT CENTER for reasons subject to the attached conditions. PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Palm Desert Planning Commission held on June 16, 1975 by the following vote, to wit: AYES: BERKEY, MULLINS, SEIDLER, VAN DE MARK, WILSON NOES: ABSENT: ABSTAIN: ATTEST: PAUL WILLIAMS, SECRETARY PLANNING COMMISSIOttESOLUTION NO. 58 June 16, 1975 CONDITIONS OF APPROVAL CASE NO. PUP-01-75 1. All requirements of any applicable law, ordinance, or regulation of the State of California, City of Palm Desert and any other applicable governmental agency shall be complied with as a part of construction. 2. Said approval shall be submitted to the Planning Commission for review no later than two (2) years after date of final permit approval. 3. A detailed landscaping, irrigation and fencing plan shall be submitted for review to the Design Review Board. Said plan shall be submitted no later than thirty (30) days from the date of initial occupancy. 4. The existing structure shall be inspected by the Building & Safety Division for compliance with appropriate building and housing codes. 5. At least five (5) off-street vehicle parking spaces and one (1) passenger loading space, designed in conformance with Section 18.12 of the Zoning Ordinance, shall be installed. CITY OF PALM DESERT (06/11/75) STAFF REPORT To: PLANNING COMMISSION Report On: Request for Public Use Permit Case No.: PUP-01-75 Applicant: RIVERSIDE COUNTY DEVELOPMENT CENTER I. REQUEST: That the Planning Commission approve a request for a public use permit to allow a school for mentally retarded and multiply -handi- capped children operated by the Riverside County Development Center and which would be located in an existing structure at 74-109 Larrea, between Portola & Lantana. II. STAFF RECOMMENDATION: That the Planning Commission approve the request and adopt Resolution No. sB , subject to the attached conditions. Justification is based upon: 1. Conformance of the proposed project to all requirements of the General Plan and Zoning Ordinance. 2. Description - A portion of the south 1/2, northwest 1/4, southwest 1/4, Section 21, T5S, R6E. B. Location - 74-109 Larrea; assessor's parcel no. 625-132-024. C. Size - Parcel is 135' x 177' = 23,895 square feet. D. Units - 1 existing dwelling unit which was formerly used as the office for Desert Magazine; containing 3200 sq. ft. of space. E. Existing Zoning - R-3-4000 F. Adjacent Zoning - North - CPS South - R-3-4000 East - R-3-4000 West - R-3-4000 G. General Plan - The Palm Desert General Plan shows the subject property to be potential medium density residential (5-7 du/acre). H. EIR Finding - This project was evaluated by staff, resulting in a finding of Negative Declaration. Appeal period expired 06/13/75. STAFF REPORT Case No. PUP-01-75 -2- 06/11/75 I. Parking - Site has ample open space in rear yard for off -site parking. J. Previous Actions - None. IV. DISCUSSION OF PUBLIC USE: The proposed use is a public school operated by the County of Riverside. It serves as a development center for 20 children and 5 adults, generally between the years 3-21, who are mentally retarded• For the past 51 years, this center has operated at 74-020 Chicory. The purpose of the school is to provide physical and mental training to allow its students to develop to their full potential and live in their own homes. The center contains no dangerous or destructive children. Noise should not be a problem since many of the children are unable to speak or engage in strenuous and loud activities. Between the months of September - May, the center is open from 8:30 a.m. - 2:30 p.m. In the summer, the school is open between 8 a.m.-12:30 p.m. The school is operated by 5 staff members who arrive by car. The children are brought in 2 mini -buses, which return in the afternoon to take them home.
