A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT,
CALIFORNIA, ANNOUNCING FINDINGS AND DENYING A VARIANCE TO ALLOW A REDUCTION
IN THE MINIMUM DWELLING UNIT SIZE AND THE AMOUNT OF PARKING REQUIRED ON
THE PROPERTY GENERALLY LOCATED AT THE NORTHWEST CORNER OF PANORAMA AND
CANDLEWOOD. CASE NO. VARIANCE 03-75.
WHEREAS, pursuant to the provisions of Section 18.26 of the Palm Desert Zoning
Code, the Planning Commission did on June 30, 1975, hold a duly noticed public
hearing to consider the application of CASITAS INVESTMENT FUND for a variance to
allow a reduction in both the minimum dwelling unit size and amount of parking
required on property located in the R-3 Zone and situated at the northwest corner
of Panorama and Candlewood, and more particularly described as:
Lots 6 & 7 of Panorama Ranch as recorded in book 23,
pages 22-23 of maps in the office of the County Recorder
of Riverside County.
WHEREAS, the subject application is exempted or has been considered non-
significant with regard to the requirements of the "Palm Desert Environmental
Quality Procedure Resolution Number 74-14."
WHEREAS, at said public hearing, upon hearing and considering all testimony
and arguments, the Planning Commission did find the following facts and reasons
to exist to justify the denying of said variance:
1) Special circumstances or conditions do not exist on the property that
cause this property to be different than other properties in the vicinity which
are under identical zoning classification.
2) The granting of such variance will be materially detrimental to the public
health, safety, welfare or injurious to the property or improvements of such
vicinity and zone in which the property is located, because of inadequate parking
and circulation.
3) The granting of this variance is not necessary for the preservation and
enjoyment of substantial property rights possessed by other properties in the
same vicinity and zone.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, as follows: 1) that the above recitations are true and correct

and constitute the findings of the Commission in this case; 2) that variance
is denied.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the City of Palm
Desert Planning Commission held on June 30, 1975, by the following vote to wit:
