HomeMy WebLinkAboutRes No 063PLANNING COMMISSION RESOLUTION NO. 63 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND GRANTING A VARIANCE TO ALLOW A REDUCTION IN THE PARKING REQUIREMENTS AND A REDUCTION IN THE MINIMUM DWELLING UNIT SIZE ON PROPERTY GENERALLY LOCATED AT THE NORTHWEST CORNER OF CANDLEWOOD AND PANORAMA CASE NO. VARIANCE 03-75 WHEREAS, pursuant to the provisions of Section 18.26 of the Palm Desert Zoning Code, the Planning Commission did on July 14, 1975, hold a duly noticed public hearing to consider the application of CASITAS INVESTMENT FUND for a variance to allow relief from the requirements of Sections 18.12, parking; and Section 18.11, minimum dwelling unit size; of Ord. 348. Precisely, reducing the parking from 12 covered parking spaces to 6 covered parking spaces and 3 open parking spaces; and reducing the minimum size of 750 square feet to 630 square feet for four units and 619 square feet for two units on property located in the R-3 Zone and situated at the northwest corner of Candlewood and Panorama, and more particularly described as: Lots 6 and 7 of Panorama Ranch, recorded in Book 83, pages 22-23 of Maps in the Office of the County Recorder. WHEREAS, the subject application is exempted or has been considered non -significant with regard to the requirements of the "Palm Desert Environ- mental Quality Procedure Resolution Number 74-14". WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, the Planning Commission did find that the following facts and reasons to exist to justify the granting of said variance: 1. Special circumstances or conditions are applicable to the pro- perty or intended use that do not apply generally to other properties in the vicinity which are under identical zoning classification. 2. The granting of such variance will not be materially detrimental to the public health, safety, welfare or injurious to the property or improvements in such vicinity and zone on which the property is located. 3. The granting of such variance will not adversely affect the General Plan. -1- RESOLUTION NO. 63 Page 2. 4. The granting of this variance is necessary for the preservation and enjoyment of substantial property rights possessed by other property in the same vicinity and zones. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1) that the above recitations are true and correct and constitute the findings of the Commission in this case; and 2) that the variance is granted subject to confirmation by the City Council, subject to the following conditions: 1. The entire parking area, including the 10' easement shall be 22" A.C. paving, to County Standards. 2. The driveway exit should be 20' wide and tie into the existing street paving, to County Standards. 3. The proposed 5' high fence along Panorama should be cut back to allow greater visibility for traffic. 4. The size and shape of the laundry room should be studied for possible redesign to provide for the best layout for the users. 5. Floors of the carport area shall be 3" Port land Cement. 6. Overhead storage areas should be provided in the carports. 7. A trash storage area should be provided. 8. The proposed carports shall be relocated two spaces westerly and the carports shall be enclosed on the south and easterly sides. PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Palm Desert Planning Commission held on July 14, 1975, by the following vote, to wit: AYES: BERKEY, MULLINS, SEIDLER NOES: WILSON ABSENT: VAN DE MARK ABSTAIN: WILLI'M SE H'IAN ATTEST: PAUL A.
