HomeMy WebLinkAboutRes No 065PLANNING COMMISSION RESOLUTION NO. 65 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNA, ANNOUNCING FINDINGS AND APPROVING A PLOT PLAN TO ALLOW THE REMODEL OF 2 EXISTING COMMERCIAL STRUCTURES ON PROPERTY GENERALLY LOCATED AT THE NORTHWEST CORNER OF PALM DESERT DRIVE AND SAN PABLO. CASE NO. 14C WHEREAS, the Planning Commission of the City of Palm Desert did receive a verified application from TONI O'MALLEY requesting approval of a Plot Plan on property located in the C-P-S Zone, and situated at the north- west corner of Palm Desert Drive and San Pablo to allow for the remodel of two existing commercial buildings; the property being more particularly described as: A portion of the south 1/2, northwest 1/4, Section 20, T.5 S., R. 6 E., S.B.B. & M. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution Number 74-14", in that the project is a ministerial action and therefore exempt from the requirements of C.E.Q.A. and; WHEREAS, on July 14, 1975, the Planning Commission did consider this request for Plot Plan Approval; and WHEREAS, at that time, upon receiving and considering the testimony and arguments, if any, of all persons who desired to be beard, said commission did find the following facts and reasons to exist to approve the Plot Plan: 1. Conformance of the proposed project to the General Plan and Zoning Ordinance. 2. Conformance of the proposed project to the existing and pro- jected development in the area. 3. The proposed development does insure the protection of the public health, safety, and general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. -1- Resolution No. 65 2. That it does hereby approve Plot Plan No. 14C, subject to the following attached conditions: PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning Commission of the City of Palm Desert, held on July 14, 1975, by the follow- ing vote, to wit: AYES: BERKEY, MULLINS, SEIDLER, WILSON NOES: ABSENT: VAN DE MARK ABSTAIN: ATTEST: PAUL A. WILLIAMS, Secretary WIIAM SEIDLE', Ch.'rman -2- (Commercial) RESOLUTION NO. 65 CONDITIONS OF APPROVAL CASE #14C 1. The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibits A, B, & C) and as revised according to Planning Commission action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City and other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project commencing on eyear from approval date and being promptly completed. 4. Any roof mounted, exhaust or air conditioning equipment shall be fully concealed from view from any public right of ways and adjoining properties by means of architecturally integrated means. 5. Landscaping (with irrigation system) shall be provided as modified and approved by the Director of Environmental Services for installation within 12 months of approval. 6. Lighting of parking areas and premises shall be provided for as approved by the Director of Environmental Services. 7. Signage shall be provided in accordance with signage plan to be submitted to the DRB and Planning Commission for final approval. 8. Traffic control provisions shall be provided as required by the Director of Environmental Services. 9. Elevations are approved as shown. 10. This project will not be phased; this project will be constructed in its entirety at one time.
