HomeMy WebLinkAboutRes No 072PLANNING COMMISSION RESOLUTION NO. 72 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA ANNOUNCING FINDINGS AND GRANTING A CON- DITIONAL USE PERMIT TO ALLOW A TEMPORARY SUBDIVISION SALES OFFICE ON PROPERTY GENERALLY LOCATED AT THE NORTHEAST CORNER OF SOMERA ROAD AND ALAMO DRIVE. CASE NO. CUP-05-75. WHEREAS, pursuant to the provisions of Section 18.26 of the Palm Desert Zoning Code, the Planning Commission did on August 18, 1975, hold a duly noticed public hearing to consider the application of FEATURE HOMES, INC. for a Conditional Use Permit to allow the applicant to operate a temporary subdivision sales office on property located in the R-1-10,000 Zone and situated at the NE corner of Somera and Alamo and more particularly described as: Assessor's Parcel # 630-301-C10 WHEREAS, said application has corrplied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution Number 74-14", in that the Director of Environmental Services had deter- mined on August 7, 1975 that the project would not have a significant impact on the environment and the appEal period did expire on August 15, 1975; and WHEREAS, at said public hearing, upon hearing and considering all testimony and argument, the Planning Commission did find the following facts and reasons to exist to justify the granting of said Conditional Use Permit: 1. Conformance of the proposed project to the provisions of the Zoning Ordinance. 2. The project is compatible to the existing development in the area in that it will be located inside the garage of one of the units and will not require any other structure. 3. The project does ensure the protection of the public health, safety, and general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1. That the above recitations are true and correct and con- stitute the findings of the Commission in this case. r RESOLUTION NO. 72 2. Subject to confirmation by the City Council, the Conditional Use Permit is granted to FEATURE HOMES, INC. for reasons subject to the conditions as attached. PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Palm Desert Planning Commission held on August 18, 1975 by the following vote, to wit: AYES: BERKEY, MULLINS, SEIDLER NOES: ABSENT: VAN DE MARK & WILSON ABSTAIN: IA!': SE AIRMAN ATTEST: PAUL A. WILLIAMS, SECRETARY RESOLUTION NO. 72 CONDITIONS OF APPROVAL CUP-05-75 1. The proposed use shall conform substantially to the Plot Plan for CUP-05-75, labeled Exhibit A, and the requirements herein. 2. All requirements of any applicable, law, ordinance, or regulation of the State of California, City of Palm Desert, and any other applicable governmental entity shall be complied with as a part of construction. 3. Unless the use is inaugurated not, later than one year after the date of the final approval is granted and is diligently pursued thereafter, this approval will automatically become null and void. 4. No signs or advertising of any type whatsoever shall be erected or installed until plans therefore have been approved by the City of Palm Desert. 5. Any minor changes may be approve& by the Director of Environmental Services. Any substantial change will require the filing of an application for an amendment to be considered by the Planning Commission. 6. This approval shall expire 2 years from the date of final approval or when the last unit shown on the plot plan Exhibit A has been sold, or whichever comes first. ' 7. Upon closing of the sales office, the sales office shall be con- verted back to a garage.
