HomeMy WebLinkAboutRes No 073PLANNING COMMISSION RESOLUTION NO. 73 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOM- MENDING TO THE CITY COUNCIL, APPROVAL OF A TENTATIVE PARCEL MAP AND WAIVER OF THE FINAL MAP REQUIREMENT FOR A PARCEL SPLIT ON 0.499 ACRES OF LAND, GENERALLY LOCATED ON THE NORTH SIDE OF PALM DESERT DRIVE, APPROXIMATELY 500 FEET EAST OF MONTEREY AVENUE. CASE NO. P.M. 6912. WHEREAS, the Planning Commission of the City of Palm Desert did receive a verified application from P. ELDON PROCK, requesting approval of a parcel split on 0.499 acres of land, located in the C-P-S zone and situated on the north side of Palm Desert Drive, approximately 550 feet each of Monterey Avenue, more particularly described as: Lots 156, 157, and 158 of Palma Village Unit No. 7 being a portion of the south 2 of the northwest 4 of Section 20, T5S, R6E, SBB & M. WHEREAS, said application had complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution Number 74-14", in that an Environmental Assessment form was submitted and a Negative Declaration was made by the Director of Environmental Services on July 11, 1975, and the appeal period has expired, and; WHEREAS, the Planning Commission did take into consideration, the Tentative Parcel Map as submitted, and the reports of the various reviewing agencies, and; WHEREAS, the Planning Commission did find that the subject Tentative Parcel Map does substantially comply with the City of Palm Desert Code (County Ordinance Number 460), and the State of California Subdivision Map Act, as amended; WHEREAS, the Planning Commission did find that the subject Tentative Parcel Map does comply with the adopted General Plan, and; NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: (1) that the above recitations are true and correct and constitute the findings of the Commission in this case; and (2) that it does hereby recommend approval to the City Council of the City of Palm Desert of the above described RESOLUTION NO. 73 Tentative Parcel Map No. PM 6912 and a waiver of the requirement for the filing of a final map, subject to fulfillment of the following conditions (copy attached): PASSED, APPROVED AND ADOPTED at a regular meeting of the Palm Desert Planning Commission held on the l8th day of August 1975, by the following vote, to wit: AYES: BERKEY, MULLINS NOES: ABSENT: VAN DE MARK, WILSON ABSTAIN: SEIDLER ATTEST: PAUL A. WILLIAMS, SECRETARY 1• • CONDITIONS OF APPROVAL Case No. PM 6912 1. The tentative parcel map is granted for the land as des- cribed in the application and any attachments thereto, and as shown on the plot plan as revised, labeled Exhibit A, and the requirements herein. 2. All requirements of any law, ordinance or regulation of the State of California, the City of Palm Desert, and any other governmental entity shall be complied with as a part of con- struction. Algem 3. As a part of construction, the applicant shall underground all electrical, telephone, cable television and other utility service lines to the unit. In addition, the applicant shall underground the overhead distribution lines along the front and rear property lines of both parcels. At the discretion of the Planning Com- mission or where partial undergrounding is feasible, the applicant may submit a cash bond for a proportionate share of undergrounding the utility lines for the entire block based on cost estimates determined by the Southern California Edison Company. 4. As a part of construction, the applicant shall install a full - width paved alley along the entire rear property line of parcel 1 and build to Riverside County Standards. Said improve- ment shall be based on a consideration of the drainage require- ments for the entire alley between Monterey Avenue and San Marcos Avenue and shall be subject to review and approval by the Director of Environmental Services. Applicant may submit a cash bond for the value of the proposed construction where immediate installation is infeasible. 5. Street trees shall be planted along the Palm Desert Drive frontage in accordance with Riverside County Ordinance No. 457, as amended. 6. Area shall be annexed to Improvement District Nds. 54 and 80 of the Coachella Valley County Water District for sanitation service. 7. Install a super fire hydrant in accordance with Riverside County Ordinance #546 so that no point of the building is more than 250' from a fire hydrant measured along street or other auto travelways. Fire hydrant shall not be located closer than 25' to any building. 8. Install a water system capable of carrying 1000 GPM fire flow for a two hour duration in excess of domestic supply. The computation shall be based upon a minimum of 20 PSI resid- ual operating pressure in the street main from which the flow is measured at the time of measurement. 9. Prior to the issuance of a Building Permit, the Developer shall furnish the original and four copies of the water system plan to the Riverside County Department of Fire Protection for review. Upon approval, two copies will be sent to the City of Palm Desert Department of Building and Safety, Land Use Divi- sion and the Original will be returned to the Developer. 10. The water system plans shall be signed by the Water Company with the following certification: "I certify that the design of the water system in PM 6912 is in accordance with the requirements prescribed by the Riverside County Department of Fire Protection.
