HomeMy WebLinkAboutRes No 078yam, 'tee PLANNING COMMISSION RESOLUTION NO. 78 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING A PLOT PLAN TO ALLOW THE DEVELOPMENT OF A COMMERCIAL OFFICE -RETAIL BUILDING ON PROPERTY GENERALLY LOCATED AT THE NORTHWEST CORNER OF THE INTERSECTION OF EL PASEO AND SAGE LANE. CASE NO. 18C. WHEREAS, the Planning Commission of the City of Palm Desert did receive a verified application from CURT DUNHAM requesting approval of a Plot Plan on property located in the C-P-S Zone, and situated at the northwest corner of the intersection of Sage Lane and El Paseo to allow for the development of a commercial retail -office building; the property being more particularly described as: Assessor's Parcel No.s 627-192-024 & 627-192-011 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution Number 74-14", in that the project is a ministerial action and is exempt under the provisions of the California Environmental Quality Act of 1970; and WHEREAS, on September 2, 1975, the Planning Commission did consider this request for Plot Plan approval; and WHEREAS, at that time, upon receiving and considering the testimony and arguments, if any, of all persons who desired to be heard, said Commission did find the following facts and reasons to exist to approve the Plot Plan: 1. Conformance of the proposed development to all requirements of the General Plan and Zoning Ordinance. 2. The proposed development does ensure the protection of the public health, safety and general welfare. 3. Compatibility of the proposed project to the existing and proposed development in the area. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. That it does hereby approve plot plan no. 18C, subject to the attached conditions. RESOLUTION NO. 78 PASSED, APPROVED AND ADOPTED at the regular meeting of the Planning Commission of the City of Palm Desert, California, held on September 2, 1975, by the following vote to wit: AYES: BERKEY, MULLINS, SEIDLER, VAN DE MARK, WILSON NOES: ABSENT: ABSTAIN: ATTEST ephen A. Fleshman, ASSOCIATE PLANNER CONDITIONS OF APPROVAL CASE # 18C 1. The development of this project shall conform substantially to all develop- ment plans submitted in behalf of this case (Exhibit (s) A-1, B, C) and as revised according to Planning Commission action. Any minor changes require approval by the Director of Fnvironmental Services. Any substantial changes require approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City and other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project commencing within one year from approval date and being promptly completed. Applicant shall also submit plans approved by Palm Desert Property Owners Association prior to construction. 4. Curb, gutter, sidewalk, curb cuts, tie-in paving and parking lot improve- ments shall be provided in conformance with Riverside County Standards and Palm Desert Zoning Ordinance requirements. A. The full frontage of both Sage Lane and El Paseo, adjacent to the parcel shall be improved with sidewalk, curb, gutter and tie-in paving to standards as specified by the Riverside County Road Department. The road shall be built to conform to the existing curb returns. 5. Alley shown along rear of property shall be paved to a minimum of 20 feet to Riverside County Standards. 6. Traffic control provisions shall be provided as required by the Director of Environmental Services. 7. Lighting of parking areas and premises shall be approved by the Director of Environmental Services. 8. Applicant shall submit a drainage plan considering the building site and adjacent properties to the Director of Environmental Services for approval. 9. A complete and detailed landscaping and irrigation plan shall be provided to the Director of Environmental Services for approval. Said improvements shall be made a part of the construction and no permit for final occupancy shall be approved until installed. 10. A noncombustible trash storage area built to City Standards, location to be determined by the Director of Environmental Services. 11. All service lines shall be placed underground or a cash bond shall be provided for the costs of undergrounding distribution lines. 12. Roof mounted exhaust or air conditioning equipment shall be screened from view. 13. Elevations are approved as shown. 14. Signage shall be provided in accordance with comprehensive signage plan to be submitted to DRB for final approval. 15. The precise design of the parking lot shall be determined at a later date. The Director of Environmental Services will work with the Redevelopment Agency and other commercial groups to develop a workable plan for this block. Any future design shall not include less than 57 spaces.
