PLANNING COMMISSION RESOLUTION NO. 80
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM
DESERT, CALIFORNIA APPROVING A THEATRE MARQUEE FOR THE PALMS
TO PINES, PHASE III PROJECT, LOCATED ON THE SOUTH SIDE OF
HIGHWAY 111, BETWEEN HIGIIWAY 74 AND EL PASE. CASE NO. 10C.
WHEREAS, the Planning Commission of the City of Palm Desert
did receive a verified application from Roy W. Carver requesting
approval of a theatre marquee sign on property in the C-P-S zone
and situated on the south side of Highway 111 between El Paseo and
Highway 74; more particularly described as:
Assessor's Parcel No. 629-060-036
WHEREAS, said application has complied with the requirements
of the City of Palm Desert Environmental Quality Procedure Reso-
lution Number 74-14", in that the project is a ministerial action
and is exempt under the provisions of the California Environmental
Quality Act of 1970; and
WHEREAS, on September 15, 1975, the Planning Commission did
consider this request for sign approval; and
WHEREAS, at that time, upon receiving and considering the
testimony and arguments, if any, of all persons who desired to be
heard, said Commission did find the following facts and reasons to
exist to approve the sign.
1. Conformance of the proposed development to all require-
ments of the General Plan and Zoning Ordinance.
2. The proposed development does ensure the protection of
the public health, safety, and general welfare.
3. Compatibility of the proposed project to the existing
and proposed development in the area.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of
the City of Palm Desert as follows:
1. That the above recitations are true and correct and con-
stitute the findings of the Commission in this case.
2. That it does hereby approve the signage plan, subject to
the attached conditions.

PASSED, APPROVED AND ADOPTED at a regular meeting of the
Planning Commission of the City of Palm Desert, held on September 15,
1975 by the following vote, to wit:

CONDITIONS OF APPROVAL
CASE #10C
1. The development of this project shall conform substantially
to all development plans submitted in behalf of this case
(Exhibit (s) SA1, SA2) and as revised according to Planning
Commission action. Any minor changes require approval by
the Director of Environmental Services. Any substantial
change requires approval by the Planning Commission.
2. All requirements of any law, ordinance, or regulation of the
State, City and other applicable government entity shall be
complied with as part of the development process.
3. This approval is applicable, subject to the development of
this project commencing within one year from approval date
and being promptly completed.
4. Landscaping (with irrigation system) shall be provided
around the base of the sign as approved by the Director of
Environmental Services for installation prior to final in-
spections.
5 Elevations are approved as shown.
6. The colors are approved with dark brown letters at 92" on
an ivory colored background.
7. The overall height shall not exceed 14' above natural
grade.
8. The light intensity of the sign shall be a maximum of 10
candlepower at a distance of 10 feet.
9. Wood members of the sign shall be dark brown as per material
board.
10. Casing shall be metal and painted a dark brown to be compatible
with the other colors of the sign.
