HomeMy WebLinkAboutRes No 081volore PLANNING COMMISSION RESOLUTION NO. 81 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMENDING TO THE CITY COUNCIL, APPROVAL OF A TENTATIVE PARCEL MAP AND WAIVER OF A FINAL MAP, FOR A PARCEL CONSOLIDATION ON .71 ACRES OF LAND GENERALLY LOCATED ON THE NORTH SIDE OF EL PASEO, APPROXIMATELY 300 FEET EAST OF SAN LUIS REY. CASE NO. P.M. 7078. WHEREAS, the Planning Commission of the City of Palm Desert did receive a verified application from IRIS CARMEL, requesting approval of a lot consolidation on .71 acres of land, located in the C-P-S zone and situated on the north side of El Paseo, approximately 300 feet east of San Luis Rey, more particularly described as: Lots 27, 28, and 29 of Block S, Palm Desert Unit No. 1 WHEREAS, said application had complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution Number 74-14", in that an Environmental Assessment form was submitted and a Negative Declaration was made by the Director of Environmental Services and the appeal period has expired; and WHEREAS, the Planning Commission did take into consideration, the Tentative Parcel Map as submitted, and the reports of the various reviewing agencies; and WHEREAS, the Planning Commission did find that the subject Tentative Parcel Map does substantially comply with the City of Palm Desert Code (County Ordinance Number 460), and the State of California Subdivision Map Act as amended. WHEREAS, the Planning Commission did find that the subject Tentative Parcel Map does comply with the adopted General Plan; and NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: (1) that the above recitations are true and correct and constitute the findings of the Commission in this case; and (2) that it does hereby recommend approval to the City Council of the City of Palm Desert of the above described Tentative Parcel Map No. PM 7078, and a waiver of a final map subject to the fulfillment of the attached conditions. PASSED, APPROVED AND ADOPTED at a regular meeting of the Palm Desert Planning Commission held on the 15th day of September, 1975 by the following vote: AYES: BERKEY, MULLINS, SEIDLER, AN „DE MARK ThILSON NOES: ABSENT: ATTEST: PALL A. WILLIAMS, SECRETARY WILLIAM SEIDLER,IRMAN P.C. ` RESOLUTION NO. 81 CONDITIONS OF APPROVAL CASE NO. PM7078 1. The tentative parcel map is granted for the land as described in the application and any attachments thereto, and as shown on the plot plan as revised, labeled Exhibit A, and the requirements herein. 2. All requirements of any law, ordinance or regulation of the State of California, the City of Palm Desert, and any other governmental entity shall be complied with as a part of construction. 3. As a part of construction, the applicant shall submit a cash bond for a proportionate share of undergrounding the utility lines for the entire block based on cost estimates determined by the Southern California Edison Company. 4. Street trees shall be planted along the El Paseo frontage in accordance with Riverside County Ordinance No. 457 as amended. 5. Applicant agrees to join any assessment district formed that includes the subject property within its boundaries. 6. The applicant shall grant to the City or other appropriate Agency, easement rights for the parking lot areas.
